The Commissioners of Knox county.—This was one or the most important cases of the terns, and- was argued on a demurrer to slut declarations, with signal ability, by Mr. Judah and Mr. N. C. McLean for the plaintiff, and Mr. McDonald op Mr (loves for the defendant. The facts of the case were substantially the following: The Board of Commissioners of Knox county: before the adoption of the constitution in pur 'trance mf the terms of A statute authorizing the same, subbcribml $200,000 to the capital stock of the Ohio and Mississippi Railroad company, :slid after the constitution took' effect, issued their bonds with coupons, for the payment of the stock, its the signal form. The county failed to pay the interest coupons when they became due, and this suit was brought to recover the amount of the coupon , . held by the plaintiff. as the bearer. The defence rested upon several grounds. I That tete subscription ma• void, the coun ty ha•ing no right to make it for railroad par poses. 2. That the bonds were void, having been is sued After the taking effect of the Constitution of 1821. 3. That the coupons were void for the want of power to is.eue them, even if the !omits were 4. That the law of the State submitting the question to the people of Knox county, whether the I:omminsioners shall subecrilx, the stock, was unconstitutional and Void. We may .hare submitted some subordinate points; but these were the main objections taken. Judge McLean in an able and lengthy opin ion covering the whole ground of the action and defence, held that the action could be maintained upon the coupons; that oath of the points raised in the defence was unsustainable in point of law; that the subscription was valid and binding up on theeounty of Knox; that the Court would have compelled by mandantits the 190110 of the bonds, had the Commissioners refused to DMus them; that the subscription having been made before the Constitution of Indiana of Mil was in force, could not be affected by that in strument: that the issue of the bonds is not in hibited by the State Constitution, which only eppumtvso initnicripminia anode oiler tutiiin took effect: nor could the Constitution af fect these bonds, efen if bonds were named in its prohibition, as they were not a new contract, but merely the consUmniation of the previous con tract of subscription that was made before the adoption of the Constitution, therefore, both the subscription and bonds were protected by the Constitution of the United States; that the coupons were merely incident to the bonds, and derived all their legal effect from the bonds, and were clearly authorized to be attached to the bonds as n [natter of convenience, and to Swill- Rilboloterp . It was in 180, during the...setting contest of Foote and Davis for the governorship, that Mr. Jenkins, editor of the &Wind, a peaceable and estimable man, having commented on the conduct of Crabbe, was assailed by him in the streets of Vicksburg; a terrible combat 'ensued, Jenkins rising his bowie knife with great effect before Crabbe could draw his pistol. The lat ter, however, though terribly out, succeeded at last in discharging his pistol into the side of Jenkins, who fell mortally wounded, dying in a few bouts after. Two. But while the inferior instruments, through whom the frauds were accomplished, receive the punishment proper for their crimes, it is-to he regretted that nothing con be done to reach anti punish the men who counseled and planned the schemes of fraud, and who are at this moment occupying high stations of responsibility, which they have risen to by means of the crime of which Philip Rump has been convicted. Fraser, and Iron City, Capt. Turner, arrived front Lake Superior yesterday forenoon. The former left Ontonogon on Satur day last, and the latter on Sunday. The Mineral Rock brought down a heavy load of copper, as follows: Front the Cliff Mine, 118 tons; Copper Falls, 90 do.: Minnesota, 02 do.; Rockland, 52 do.; North American, 21i do ; Cen tral, 10 do.; other mines about 30 do. Some of the masses on the deck of the Mine rod Rock are the largest and purest yet brought clown from the mineral district of our State— weighing from 4 1 500 to over 7,000 pounds each! Nine of these big specimens, from the North American, and a like number from the Cliff Mine, average more limp two tons and a halt each I Eight, from the Copper Falls Mine, are a little above these. Most of these masses seem I to be as pure as coin, and, we should judge, con tain from 80 to 90 per cent. of clear metal. There is considerable silver in small particles scattered through some of thern. TUE streets are kept cleaner in Europe than it the United States, and at less expense. In some European towns there ie no expense incur red for street cleaning, and in others the system produces a revenue. Paris is cleaned every night, and the city is paid a bonus for the priv ilege of sweeping. In American cities, the coat of cleaning the streets is ,a very considerable item of municipal expenditure, and the duty is not performed as it ought to be for the cost, or for the public health, which ie of much greater importance.
