Fitch, setting forth that he was elected a Elena tor by the, Legislature of Indiana and moved that the oath be administered to ,him. Mr. Trumbull said he had plated Weis hands by a special messenger from that State& protest of the Senate against the legality of the election and also a protest signed by 34 members of the House of Representatives of Indiana to the same effeot. Mr. Bright said it was not necessary to read the protest as he believed his colleague moor& log to precedent was entitled to bo sworn in. Thiprotests were read. Mr. Trungnell 'objeited to tio idifikdstration of the oath. I .; I Mr. Douglas thought D. hither thitt Ur. The Committee on the Judiciary have recently ' investigated and reported upon a ease involving the some principles which are involved in the present ease. They reported that Mr. Harlan was not entitled ° a mat because he had not been elected by &quorum of each branch of the LogiMatare of his State and the Senate had dis cussed the matter fully and sustained the Com mittee. How then maid there be a doubt to the present case where a similar etata of things presented. Mr. Toombs thought there was but one ques tion before the Sonata and that was on the entie eleney of the credentials. Every argument of the Senator from Illinois, Mr. Trumbull, had advanced, from behind the credentials, and therefore be had no pertinacity to the present question. He contended that the universal rule of the Senate had been that where creden tials aro in proper form, on that prise facie evidence the claimant took his Beat He urged that the oath ought to be administered in the present ease.
