About 12 o'clock that night, Mayor Bingham took the deposition of the wounded man at the office at Dr: McCook, whither he had been con veyed by his friends. It was in these words: "Commonwealth vs. James Shaler and John Slicer. On last night, the 16th, about 0 o'clock, while I was at the corner of Market street and the Diamond the above named defendants did com mit upon the said deponent, a grievous assault and battery, and did then and there cut with a knife the said deponent, and otherwise ill-treat the said deponent, William Caldwell." The Mayor issued warrauts for the arrest of the 'accused, and about 1 o'clock, on Saturday morning, Shaler was arrested at the residence of his father, Judge Shaler, on Liberty street, and committed to jatl. At three o'clock, on Saturday afternoon, he had a hearing before the Mayor. Mr. Stanton appeared on his behalf, and the following testi mony was elicited: W. H. Bean, sworn—Was at the corner of the City Hall lard night, with Caldwell, Deka end Woods. As we were coming on the corner, Shaer and three *there came across, and Shake looked, and we asked him what he wanted? He tapped Caldwell on the shoulder, and said that he had a breast-pin of hie; Caldwell said -he hadn't and asked him when he lost it; Shaler said he lost it in the Bank Exchange. They stood looking at each other, when Caldwell said, "yen are one of the ones that Struck me in the flank," and then he struck him about tbo head and knocked him back, Sltler's hat fell off, and be shrunk down—Shaler raised and went into the fightas far as he knew, and Daniel Woods, ran in to strike, but 1 stopped him ; he didn't get no lick in. Roger Jeffrey drew his coat off and run in, and called fair play. They fought up the pavement twenty-five or thirty feet; they wore both on a dead stand ; fighting on a dead equate. Wood struck Jeffrey; a young -man With a long hat and a standing collar ran along, and struck down and..then Caldwell cried, "enough, enough, murder, murder," and Shaer stopped the fight, as soon as he hollered. I was standing close by - him.— Shaer need no weapons that I could see, and I was watching hint particularly; it was fair fight between Shaer and Caldwell. Some boy came to me and said my friend was. cm; I told Jeffrey, and ho said it must hao,o been my friend Woods; I add no that he would have cut Shaler rather than Caldwell; fifteen minutes af terwards the man that cat came back, end I woe told his name was Slicer. Caldwell had been taken away, and I did not know for three quarters, of en hour after the fight that he was cut; Shaer and I were talking in the Seetin 1.101180. David Woods sworn—l came to town with Hugh Ellis ; tact Caldwell and Bean on Market street, about Maim hour before the fight.
