Mr. Marshall made an application to die

Attorney stated that be could not consent to a

Mr. T. B. Hamilton mooed for the discharge
of James Berger, tried and convicted for Belling
liquor under' the act of 1866 The Court, be•
log banded an authenticated copy of the new
act. proceeded to say that it repealed the act of
'66, and all proceedings under it , nomatter what
stage they may be in, meet be arrested The
Court quoted a similar case
James Berger was then brought into Court,
and discharged. Our readers will recollect that
be plead hts own case; in the language of a by
stander, on Saturday, he doubtless found the
new law of much more effect than constitutional
Law, upon which he dwelt with much earnestness
before the jury, when on trial.
About one hundred indictments under the law
of 1866, whioh caroled the hasty departure from
town of a great many liquor sellere about the
commencement of the sessions of December, and
Parch, of course all fall to the ground, too.
On motion of Mr. Negley, Esquire McKee, of
Birmingham, was appointed a Commissioner to
call a jury in the me of Andrew Genet, of that
borough, a Janine.. .: -- Judge McClure said that
he bad received s'it;tter from the physician of
_the State Lunatic Atrium at Harrisburg, stating
that Allegheny county had sent far more than
her proportion to the Asylum, and more than
any other county in the State
At this point the Grant Jury came into Court
with a Presentment, and announced that they
had risen. After the Court perused the pre
sentment, they remarked that it was the moot
sensible they ever rend.
The document in in these words:
"To the Hon. William B McClure, President,
and his associate Jugee of the Court of Quar
ter Bessione for the 4ounty of Allegheny.
"Tbe Grand Jury in and for mild county, as•
sembled at an inquest inquiring for the body of
the county of Allegheny, do reepectfuily present
"That they congratulate the county on the
comparatively small amount of hills presented
before them for great offenses committed, and
they return their sincere thanks to District At
torney Roberta and his assistant Mr. Stuwart,
for their attention and promptness in all cases
preheated before them.
"After visiting the Jail, they take pleasure in
stating their entire satisfaction in the manner
in which it is conduoted, under the control of Mr.
-Phillips, who appears to study the comfort of
the inmates in cleanliness, and the good order
apparent throughout. At tthe same time this
Jury would recommend that some provision be
made for the moral and religious instruction of
the inmates at least on the Sabbath day, concur
in former presentments of Grand Juries, where
in they recommend the employment et labor of
committed vagrants. After visiting the Peni
tentiary, under the control of Major Beckham,
they state they found that establishment in very
good order, neat and (dean, and the proviAorts
for the inmates ample and good, so far as sub
mitted to them." Signed by the Grand Jury.
The Grind Jury passed upon two hundred
and fifty-seven bills of indictment.

Tata& Railroad Company, presented a petition to
the Court praying a release from the taxes as
sessed upon the Duquesne Depot by the County
Commissioners, which amount to
Comity Taxes,
Ward School Taxes

The petition sets forth that Depot and grounds
cost a large amount of money, and was need for
the benefit of the citizens, there being no char
gee for storage or other profits derived there
from. The matter is brought into Court under
the act of 6th May, 1864, relative to appeals
from assessments. The matter will, be argued
In June.

against George Hall, Wm. Maguire, Jos. Holly
and Sum Wade, they were brought into Court
and disaliarged- n
William Johnston, alias Martin Gorman, the
Damon and Pythias cave which-was published
some time ago, was brought into Court: When
the officers were in Bearch'of 51..rtin orman (or
a violation of the liquor law of 1856; this man
represented himself to be the man, and was
looked in jail. He afterwards repented, but the
various processes of law was unable to effect his
release. A release for Martin,Gorman woe sent
in but he refused to be releaseff under that name.
When brought into Court; Judge McClure,
after catechizing him, told that the law under
which he was held, a true bill being found
against him under the name of Gorman was re
pealed, and he was thart:fore discharged.
Prisoner—" Thank ybur Honor."
Court—.oh, don't thank no. Thnok the
Legislature."
Prisoner—(Leaving the bor.) - "Well, thank
the Legislature toe."

of disinterested 'friendship that may prompt him

dieted for Mail Robbery, which had been certi
fied Into the United States Circuit Court (or the
pirpotie of obtaining the decision of that Court
,on the motion to quash the indictment. The
application of the District Attorney was based
'upon the fact that the case was improperly be •
fore the Circuit Court, inasmuch as the prisoner
had been tried and convicted of the charge
against him. finch also was the opinion of
Judge Grier, to whom he had written
The Court granted the application, and the
cue was certified bank.
The District Attorney then asked the Court
for its decision on the motion in arrest of judg
ment and for a new trial made by defendant's
ConneeL
Judge Irwin—l bare carefully and.aeliberate
ly examined this case, and after a reference to
the several authoritier, having a bearing on the
point at hone, I have coma to the oonelnslon the
objections raised are fatal to the indictment.
There is one reason that judgment should be
arrested I deem conclusive. I refer to the font
that there was no allegation in the indictment
that the property alleged to have been stolen be
longed teeny person. This omisslap I believe
to be fatal
to the indictment. In "Ids opinion
Judge Grier concerts, though he had uo intima
tion of what would be my opinion in the matter.
With regard to the point raised by Col. Black
that the Government bad no right to challenge
peremptorily at Common Law, having the right
only to Make the juror etand aside until the
panel became exhausted, when he should be
sworn, unless challenged for cause, it is not
necessary to say anything, as the first objection
if/ fatal to the indictment. Let judgment there
for* be arrested.
pd. Black, in justice to the Counsel for the
Government, said the question just decided had
never before been rained, and that in other din
tricte •the forma were similar to that used by
Judge klhaler.

Carron, 0., April 6.—On Thursday last, while
the Jailor at Canton, Ohio, was taking a prieon ,
er from the Court House, where he had been un
der trial for passing counterfeit money, he en.
a number of suspicious looking persons around,.
and called to his aid three or foar citizens.—
Nothing transpired until he unlocked the door
of the cell, when the prisoners, some flye or six
in number, rushed on the Jailor, knocking him
down. Ills wife, hearing a noise in the hall,
looked the inside door, thereby keeping the pris
oners still safe. On looking out of the front
door, — these suspicions personpie were seen
lurking around; immedis ly locked that
door also. The prisoners wer put in irons
Considerable excitement is manifested in the
town and 'home fears are entertained of an at
tempt! to rescue the prisoners by their friends
to-day, as they aro still/there ; but they are
prepared for them. /

sell the better grades without submitting to some
slight redaction. The export demand is limited,
and the home trade will not purchase more than

6,200 bole At $6,50®56,75 for common to good
State and Western; $6,87®57,26 for extra
State, $6,87®57,75 for low to good, medium
grades of extra Western, and $8 to $11) for ex
tra SC. Louis and Genneksee. At latter prices,
the sales are only of a retail charaoter. In Ca
nadian Flour we can hear of no transactions to
report, and prices are nominally the same.
The market for Southern Flour is one shilling
lower, with only limited demand; sales 1200
Ws. et $7,25®7,75 (or mixed to choice, an
$7,87®8,87 for fancy and extra. Rye Flour;
supply moderate and doll at s4®6 for fine and
superfine. Coro Meal heavy at $8,26 for Jersey
and $8,75 for Brandywine Rather more doing
in Wheat for home consumption, but the market
dote not show any material change; sales 8500
hush.: at $1,96 for prime white Southern and St.
Louis,' and $1,04 for prim% white Canadian and
$1,65®1,70 for red Southern. Rye is abund
ant and dull at $lOl,OB for inferior to prime
parcels. Barley and Barley Malt remain as last
noticed.
The corn market in dull and unsettled, and 1
02 lower. The demand both for export and
home consumption is quite moderate. Sales
