Judge Canna, who Wend the writ, (and who, by the way, has always been a leading democrat,) used the fot. lowing langasge : 'lie had not the least hesitation in Baying that It was competent for the Sheriff of this county, noting on the order of the Court in the issuing of the capias to have arrested these de fendants, no matter what may have been their position in reference to any other Court in the land. Under a Government like this there is no refuge for crime, and the perpetrator can oc• copy no position which would render him irre sponsible to the laws which regulate the punish ment of crime. It was therefore competent , for the Sheriff to arrest the parties though they were before the United States Court on a trial es to whether they were fugitives from labor. It struck the mind of this Court that after the te eming of the capias by the State Court, It wee the duty of the United States Court in allpro priety, and even under the rules of comity, forth with to have terminated their proceedings so far as the question of the negroes being fugitives from justice was concerned, and hand them over to answer for the crime committed in the mean time. To hold any other doctrine would be to say that fugitives from labor were irresponsible for crime. This would be entirely outrageous, to say the least of it. Under the oircumatance that the defendants were now without the jurisdiction of the State the Court would suggest to the Prosecuting At torney that he had better get a requisition from the Governor of Ohio." It was a great pity, we think, that the State Courts did not assert their authority when they had the power. As it wee, they Buffered the 11. 8, Court to take prisoners from - them and remove them beyond their jurisdiction, reserving to themselvos the simple privilege of calling it "out meow." Fr. Gaines, the owner ot the negroes charged with the murder, promised, when he obtained poeseselon of them, to hold them subject to a requisition from the Governor of Ohio; but he no gooney got them upon Kentucky soil than he sold them to go South. On Thursday evening Pioneer Live Oak Club, No. 1, held a meeting in that city and adopted resolutions repudiating the nomination of Mr. Fillmore, on the allege. ground that after the secession of many of its members the body that made the nomination •cannot be called a convention any more than six men can be called ajury." The resolutions were eAvocated by Dr. Lyons, of La., one of the delegates; H. N. Wild, the president of the club; Hon, Henry Hildreth, of Meas., and C. Edwards Lester. A. Smith and a MuErans opposed them. ' In answer to a remark of Mr. Lester that Mr. Fillmore was not a member of the order, Mr. Smith said he was. "Col. Sevier said that the veritable Gustavus Adolphus Somas, the honorable candidate fo Lieutenant-Governor of the State of New York, informed him the past week, at Philadelphia, of Fillmore's initiation, by himself, in his own par lor, and his having duly wowed through three degree!. This fact was undoubted; bat whether Fillmore was a member of the Know-Nothing order or not mattered not with him. George Low was his candidate and he enoold gb for him."
