The British statutes, the great habeas terra; act of Cromwell and the Commonwealth, (the 81 Car., 2 ch. 2,) is of no force in this coun try, and we must look entirely to the acts of Con gregator the power and course of proceeding on this writ. Then what is the law of habeas cor ing for the United States Courts? "No law of the United States," says Chief Justice Marshall, iu the case of Tobias Watkins, 8 Peters' reports, 201, "prescribes the cases in which this great writ shall be issued, nee the power of the Court over the party brought upby it. The terra is used in the Constitution as one which was well under stood; and thejneliciel act authorizes this Court to Issue the writ for the purpose of inquiring into The cause of the eVfnentstsfil." "This general ref. erence," he continues, "to a power which we are required to exercise without precise definition of that power, imposes on us the necessity of making some inquiries into its use. The writ of habeas corpus is a high prerogative writ known to the common law, the great object of which is, the lib eration of those who may be imprisoned without sufficient cause. It is in the nature of a writ of error to examine the legality of the commit- meat". So far of Chief Justice Marshall on the nature of this writ- Let us, as shortly as possible, inquire what is the common law on the subject of the power of the highest and most powerful Courts of England, from which we inherit whatever of the common law is, in force in this country. And let no fret inquire of the duty of the Courts, in the ca ms of returns' to write of habeas corpus. Bacon's, Abridgment, a high authority, informs us that "fora false return to habeas corpus there is reg ularly no remedy against the officer but no action on the ease by the party aggrieved, and an is. formation on indictment at the mit of the Sing." 4. Abr. 181 °William's Ed. by Dodd, for which he cites Salkeld's Reports 845.852. .; And again: "But it has been holden that if 'a jailor returns one •languides' when the party himself brings his habeas corpus and le in good health, an attachment will against him, nintne, if the habeas corpus was bmtight - b - y another." ;Bois Abr. 181, but for thich he cities no author ity. This exception (assuming it to be law,) as the lawyers eay, proves the rule, for the conellazy is that If the party himself due not bring the writ, the false return of the jailor, that hie prisoner was sick, although he was in good health, must be taken for true by the Court, and the party would be pat to his action or in dictment for perjury. Now in the case of Williamson, the abducted negroes did not bring the writ; they had made no complaint of their liberty being vestrained; but the writ was issued at the instance of Col. Wheeler, and not for their benefit hot for his own. In such serum the above case says "Isecue," (that Is, on the other handOif the Habeas Corpus Is brought by Col. Wheeler and not the negroes, the false return most be adopted by the Court although he, defendant knew that they were not "languid," but were in good health. And as Lord Holt, in the cue in Salkeld, where a non conformist who had been imprism•el toren:dug, as the odious law of England then stood, within five miles of a borough that sends burgesses to parliament, was brought before him on • Habeas Corpus, said, he must be discharged, because "it al not appear by the return that London sends burgesses to parliament, though all the word brows they do." Again, Bac. Abr. 188, says that the party to whom a habeas corpse issues "mud return the truth of the whole matter under peril of an ac tion." Thus the peril is of en scam: but not as Judge Rue lays down the law, under peril of a commitment for a contempt of Court. So the same book again says ; "Although it 4seerns to be agreed that no one in any , ease can controvert the truth of the return to a habeas cues or plead or suggest any matter repugnant to it—yet it . But what seems to ale to settle the question of the power end ditty of the Courts, according to the common law, in cases of returns to writ of habeas corpus, is what was add by all the Judges of England, on a great and so. leeth occasion. In, 1776, as the Habeas Corpus Act (31 Car. 2,0 h. 2 only provided for the writ in cases of or supposed criminal matter, a bill was passed through the Commons for issuing the writ in all cases of detention and restraint of liberty. Loss or ens KICITUOiti Hare .—The Cincin nati Coormareist of yesterday gives the details of the lose of the Kentucky Horne: 'On Monday night, between nine and ten o'clock, the new stern-wheel steamer Kentucky Home, Capt. Geo IV. - Iteed, bound for Louisville, from Pittsburgh, came in collision with the huge Cincinnati and Louisville 11. 8. Mail steamer Telegraph No. 8, Capt. Sam. Hildrith, in Sugar Creek Bend, about five miles above Warsaw, Ky., and In less than five minutes went down in twen ty feet water. It appears that both steamers were, under fall headway—the Telegraph as cending the Indiana shore, when the Kentucky Home rounded the point. Capt. Phillips, the pilot of the Telegraph, gave the rental signal by blowing the whistle twice, for the starboard, which was properly answered from the other boat. From some unknown cause, however, when within two hundredyards of the Telegraph, the Kentucky Home suddenly chengctl her course, making across the Telegraph's bow. The engines of the Telegraph were immediately re versed, and had made two or three revolutions backward, when her bow struck the Kentucky Home on the larboard aide, forward of the boilers. and directly opposite the hatch, cutting nearly through her, sweeping away the boiler deck, to gether with her bell, derricks, freight on boiler deck, "nigger" engine, and contents of the bar, and several state rooms. • The officers of the Telegraph immediately ran out lines and made feat to the wreck, and used every exertion to rescue those on board. In one moment Capt. Hildreth and the watchman man ned the yawl to rescue those that might been fallen or leaped overboard from the wreck, while Capt. Phillips very properly ordered the engi neers to stop the starboard engine. and examine the wheel, where three men were found clinging to the buckets awl saved. From all accounts there were only two persons drowned—a deck baud and a fireman, who were in the hold of the Kentucky Home getting out freight for Madison. They are probably lost, 68 they were not seen after the accident occnirred. The Telegraph remained at the wreck two hours, and brought the passengers and craw here, ex cept Capt. Reed. and Mr. Kliliams,. pilot on the Kentucky Home, Who remained. The Kentucky Home. lies near the Indiana shore, sunk to the hurricane deck, and will, doubtless, prove a total loss. She had on board but few passengers, and fifty tone freight for Louisville. She was built at Pittsburgh by Capt. Geo. M. Reed, clerk lea. Mellen and others, for $17,000, with insurance to that place for $l2, 000. Capt. Headline been very unfortunate.
