Gardner, of Massachusetts, to remove Judge Loritig from . office, on the address of the Legislative; has produced a great shout of grat ulation on the part of the southern press, gene rally, and the pro-slavery presses of the North. The Philadelphia North American heads an arti cle on the subject "the Constitution vindicated," though what the Constitution had to do with it would be hard to define. The cue is simply this. The large majority of the peopleof Massachusetts deem the Fugitive Blare l.aw unconstitutional, oppressive and de grading to the Free States, and they have, there fore, itrthe most unequivocal manner indicated theirwishes that no citizen of that commonwealth should consent to.aot as Slave Commissioner nn der its provisions. As there was no compulsion 'in the matter this was an easy and quiet way of nullifying an insulting and unconstitutional enactment. Mr. Loring held a high and respon - eßle office from :the state, that of Judge of Probate, and yet he stooped to accept the office. of Slave Commissioner, and exercised his dutiee under it in the' rendition of the , fugitive Bemis. The people of Massachusetts were nat urally exceedingly indignant that one of their Judges should thus degrade the office he held from the State, and outrage their cherished opinions, and they called for his removal—not from the office of slave Commissioner, over which they had no direct control; but from that of a -Judge of one of the state courts, which they con gifted disgraced and degraded by his conduct. The Legislature of the State, by a large majori ty, in obettiencs to the will' of the people, ad dressed the Governor in the legal form for his retnovaL That functionary, setting up his opin ion-against that of his constituents, refused to • comply, and the whole pro-slavery press, North and South, has set up a shout of trimilph . .. The North American says the “Constitution is vindi cated !" Now who are to be the judges of what is con , atitutional for the people of ?5 vvachnsetts—the people of South Carolina and Missouri, or the citizens of Massachusetts themselves? and who have the beet right to say what is fitng or not fitting in the conduct of one of their jUdges, the . people of -Massachusetts or pro-elavery editors? Suppose one of the Supreme Judges of and State should accept the o ffi ce of hangman; and should exercise that disagreeable office; would not the people of thiititate feel outraged and degraded by each I prostitution of the Judicial office) and would theynot demand, and justly too, his zesig nation or removal? Now the office of hangman is much superior to that of Comadseloner under • • the Firth:tie Slave Law. It is more reputable, and its dada are not half so degrading. The one execates the eentence of the law upon a con . 'rioted murderer the other sends an innocent, fehmdleas human being into hopeless slavery, with all . his posterity, for no crime whatever, and he pockets en additional five-dollar fee for so domg Is there any compulsion upon any citizen of Massachusetts to act as Slave Commissioner?— Certainly hot. Have not the people of Massa chusetts s right to ray that their Judges shall not degrade themselves? Who can doubt this 'that recognize any rights in a soiereign State ? If one of our Supreme Judges should accept the office of hangman from the Federal Government, and the people of this State should demand his removal said the deMand should be refused, would the Nora Ameriam raise the shout, "The Con= -stitation is vindicated?" We repeat, the office of.hangman is more constitutional,' stadia:more - - reputable in the eyes of the people of Massieim ' setts than the office of Blare Commissioner- If the North Americo — a says the public opinion of Massachusetts is wrong, we would ask, who has authority to be judge in the ease? Hare they not the best right to decide what is proper and fitting in the conduct of their own public officer? But Our. Gardiner, Uremia', was only WIZTY/1:1 out Snow Nothing principles. The North Arne* - "We are more gratified that he adopted the course he did for the reason that he is understood to have been elevated to his office by the vote of a party which, In view of the control it seems destined to exercise in the future in oar national government, - we have been anxious to see taking lofty national ground in its creed and action. - Had he faltered in the grave juncture in which be was placed by the circumstances which sur rounded him he would have inflicted a disastrous blow upon the character bf that political move ment of which, in his own State, he is regarded as the representative. We are glad that GOT. Gardner in the very centre of a fanaticial tation, Letile to the Union, has planted himself, a leader of the America:yarn, on the platform of the Federal Constitution, and thus afforded ' a signal pledge of the sound and liberal loyalty of that political community to which he belongs. Areal who represent it in public station, bear the same noble testimony to the faith that is in them, the lasting triumph of the cause will be put be yond peradventure." We shall see. We rather think the North will • not consent to perform the ignoble work of slave catching much longer for the haughty slave masters who would not soil their fingers with such dirty work. If the /Innis-Nothing party is to take up the work, and if its leaders are to be honored sad glorified fist in proportion to • their servility to the-pro-slavery sentiment, the "trimaph of the cause" will be as evanescent as the" Anti•Blavery sentiments of the /lota- Ariericais.
