The alleged robbery took place in Jan , nary last, on the Perrysville Plank Road. „ Defendants ides& not guilty and a Jury was inspanzelled according to _the usual forms. For the Commonwealth, Prosecutor Roberta .and a. W. Black; Esq. For the defence, J. D. Mahon and N. B. Batch, Zsq's. John Fisher, the [prosecuting witness wais call , ed and testified-1 litre four miles from Hargteny on the pleat road; on the 28th of January last I was coming to Allegheny with some cattle; I had two cows and tiro heifers; the heifers were worth $3O; the copra were worth about $26 each; they were my . property; I know_ the defendants; when I got near a little tavern on the plank road the defendants came out towards me; they were running; when I get -to the toll gate, another man, I don't know his name, joined them; it was about six o'clock in! the'evening; it was not quite -dark; when we got 'through . the toll-gate they set th e i r d o g at my cattle 40t1 made them ran off; they said they wanted to buy.the cattle; I said I did'nt want to sell them on Sanday; they asked what I would take forthem; they offered $2O for the two cows; I begartto be afraid; itwas near a piece of woods; they offered me $25, again and then $3O; when this third man came up, •I was neared lain more and thought it was best to sell the cows to-them far „SW; I Zia 'so; they gave me a slolmterand h $2O note; L took the money and put it in ray poeket; the defendants had hold of me by theccllar; can't tell whether they were angry; they pullednse about and said the money was enough and to take it; if I hati'cit been scared by them I wonld'nt hare soli the cattle-et - that price; I was afraid because - it was night and their manner also made me afraid; at first I sold them the two cows; then I told them we must go to Colebengh's house to see the money; they were not for going there and hissed the dogs on the cattle; they got four cattle altogether from me; when they hissed the dog on the cattle they drove them all off; iI. ran around them and drove them back; then they asked, what I would take for the two heifers; they still had hold of ntit pulling me around; then I agreed to take $23; I was afraid of them; they paid me all but 25 cents; it ems dark and; I could not count the money; they made one take the money; I wanted them to go tack too the tavernto see if the money was good but they would not do it; then they went off and drove off the cattle with them; I was on foot; it was about four miles from town; • it was on the plank road they first took hold of ' me; the two deferidnute went off. and the third man staid with me;. I told him I would go, back to the tavern and stay all night; he told me . not to do it that the other two were bad men and would kill me; tho-third man had nothing to do with the _buying:cif the cattle; he and myself came to ;own together that night; we stoppedat a little 'store near ;Allegheny and looked at the money; the storekeeper examined it and min there was $BO of had money in took all the money to thejliarir's Office on Allegheny; gave all the money into Mayor Adams' hands; (witness identifiedthe money;) related the affair to Mayor Adsine and asked him for advice; I never knew the ileferidante befing I yea afraid of my life; I was afraid of the third man also till Igot to know him; thought he was one of.the gang; if I had got to market Monday morning I would have asked s2Bor $3O tar the two heifers; it was be came .1.
