Booth and Byecraft, the recent con victs of the United States District Court for this State, are hero on a writ of habeas corpus, is sued by the Supreme Court of this State, to have the merits of their conviction and impris onment inquired into. The writ was unanimous hr granted-by the Court on this ground, vu: that while these gentlemen were convicted for rescuing a “fuaitivifrom labor,” it was not even averred in tho indiotment that Glover, who was rescued, was-a “fugitive from labor, nor was there a particle of evidence before the Court to establish the feet. It was us if a man had been arraigned, tried and convicted of murder, with out a particle of proof-before the Court that a murder had been committed. It is understood that advices have been received from Washing ton to the effect that the energies of the Gov ernment wtil be employed to enforce the decision of the D. 8. Court. On the other hand, you may depend upon it that the forces of the State will be employed to enforce the decision of oar State Court, and what will be the result, it is hardly worth while to speculate.
