The last Blare case at Chicago is marked by it, eral features deserving of serious attention. The manner of the seizure and its consequences illustrate the enormity of the pretence that claim ants of fugitive 'slaves can on all occasions take the law into their own hands, and dispense at their choice with its recognized forms and . ap pointed agents. The legal investigation of the case ehows that three men from Missouri armed to the teeth, appear in the streets of Chicago at mid-day, and. seize the person of a colored in habitant of that city as their Blare. Tho resist ance of the man is a Matter of course, whether legally free or an escaped slave. A street dis 1 turbance, if not ii bloody and d ' tractive fight, is inevitable. The captors do of pretend to any particle of legal authority d rived from any court or-magistrate of Illinois, d not invoke the assistance of any peace officer o that State, but pretend to act in pursuance of ii . warrant, from .the Governdr of Missouri. Iris not possible that any assumptionlot this kind can be toleta ted by any Northern State, without a practical chandotuncnt,of ita . povereign jturiadiction within ownlimits. , In examining- the details of this case we can dot but notice the eagerness of a portion of the press, even in the free States, to throw odium upon every community opposed to the Fugitive Act, and to toady the South. The telegraphic accounts described the last affair nt Chicago as a riot, and t asserted that the tame was rescued from hiiTnaster by a mob. Now all. this is false. There was no riot at all, nor was there any unseemly popular commotion. lihe southerners Felted their victim in the streete, beat him via- lently, and fired upon him with their pistols. A crowd of persons of course collected to witness the transaction. To magnify these occurrences into d.riot and a mob, and to charge the guilt of them upon the people of Chicago, is a malignant misrepresentation. —But I nm free to admit ttiat I look with concern. upon the popular disorders which this atrocious and unconstitutional Fugitive act has provoked. Obedience to law is the only safety of civilized society. The necessary repudiation of even bad and wicked laws has a manifest tendency to anarchy, causing grief and apprehension among all good citizens. The operation of this particu lar statote may be much mitigated without ab solutely nullifying it. But 'whatever is done should ho by legal authority. Believing, myself, that the law is palpaLly unconstitutional, and knowing that on all sectional questions the Su preme Court is a packed jury, so that no relief can be hoped for from that quarter, it appears plain to me that the true remedy resides in a ' i go rous exercise of the power of tho State Legis. 'Mores.. Vermont and Connecticut have passed lxws regulating the mode of enforcing the Fugi tive act, which seem well adopted to the protec tion of their citizens against its abuses, as well . as to the preservation of the public peace.— Similar laws should be passed by all the free States.lt is true that appeals Might be taken. to tho federal courts, in which case 'it is proba- Lle that the judges, who are practically appoint ed by a cabal of Southern Senators, would pro -41 ounce them unconstitutional; but three appeals would not prove serious impediments to the for mation of a body of Free State juri.lrudence quite sufficient to roll back the tide of encroach ment upon the liberty of the citizens and the rights of the States. In respect to the abstract right of a slave to escape from his servitude it is not necessa ry to dogmatize. That is a point which may be loft to speculative casakts. But it is safe to as sume that the groat body of the people in the free States do not npprovo of encouraging and Licilitatinglimir escape. There can be no ques tion that the condition of fugitive negroes at the North subjects them to great hardships and dis tresses. 'TIM climate is Uncongenial. They have been brough,t up in dependence upon the will of others, and are helpless as children.— They ale fit subjects for the sympathies of the humane and charitable; but can hardly be con sidered a desirable class of population. Once raving us, however, they are to be protected in those rights Which every inhabitant not accused of crime is entitled to enjoy. There may be some danger that in the present state of the mind at the North, the practice of aiding slaves to escape will be regarded with un due favor. It proceeds, douhtless,lrom a gen erous and christian motive, but is altogether wrong and ought not to he tolerated.- The shameful violation of the Missouri Compromise Lae undoubtedly inspired thepeople of the North with a feeling of contempt and hatred towards the South. Which it will be difficult to erudicdte.• Under the influence of this sentiment it is possible some= precipitate and unjust mea sures may be adopted, . in those localities roost subject to excitement on this topic.— Some allowance must be mnde for the habits of southern society. When slave-bunters burst into a peaceful community with pistol and bowie lodfe, exciting riots and maiming men in the streets, they must be made to feel the weight of the law; but it should be the care of••good and order-loving citizens that its provisions are en forced, not with mob demonstrations, but with decent deliberation and in all quietness. And in extenuation of the offence it should he re tiemberell that nt the Smith degrees are gener ally not regarded as men, but as brutes, and any degree of violence necessary . to enforce submission to the commands of the limiter or his agent is held to be justifiable. We of coarse regard this as a most -pernicious and lamentable gate or public opinion; but when brought into contact with it, we should treat it :with all the leniency which justice to our citizens will ad mit of. Already the fugitive low has become valueless to the Soutb„while to the North it is the fruit ful source of disorders which are producing alarming social evils. A uniform system of State legislation, commanding the sympathy, nod support of the superior classes of the com munity, designed to correct those abuses which have grown up under the administration of this offensive act, would suppress the spirit of dis affection- and poptdar tumult. It will probably he Urged against this suggestion thatll looks to state nullifleatiOnof an act of Congress. Perry, of the-16th regiment; whose cars has excited immense atten tion as disclosing the profligate habits o r the of ficers of the army, has pronounced him, guilty on two counts, but gives him "remission to sell out The Times and other journals comment savagely on the verdict as unjust. THE. Trltoor Farm Sottn.—The fever is on' the increase in Galveston. The Times of the Bth says: I •Theepideraie is increasing both in the num ber of cases and the fatality attending:them-- At this early date in the prevalence of the fever as an epidemic, the number of interments for a day have reached within two or threo of the highest numberinterred any ono day during the summer of 1858." Houston is healthy. There has not been a (1120 of yellow fever in the city. Lettere received at Galveston state that the health of the country on tho Erases is not by any means good. The bilious fever is prevail ing. In the town of Bastrop, the sickness was reported by a physician to be a pernicious inter mittent. accompanied with congestion. It was epidemic in its character. From the Journal of the itti we take the fel- lowing: ' "We fievet remember to have witnessed, at this season of the year, upon the gulf coast, such a succession of bad weather. The sickness seems by no means confined to the: cities and towns, but we hear that tho wholes country is suffering, more or less, with fevers of the most dangerous type. We cannot atti;thate it to any thing but the large quantities of rain which have fallen, and, until la terly,' tho excessive heat" AWlrrt. Scenes AT SAVANNAH.—The subjoin - . .1 private letter tram n gentleman in Savannah` to his brother iu.Thiladelphitt, will show the ter rible condition of things : "I have but a moment to write to let you know that and myself are olive, every man in the store having deserted us in consequence of the epidemic. We are determined to stay and take our chances, to see they sit smut of it. 1 enclose our report of interments yesterday (51) out of a population of not over 13500 white people. Interments for the week, 210. Everything is in an awful state, anti death and destruction stare us in the face everywhere. The gale was enough to have ruined us at most thine:. ' and now all that is required to fill our cup is fire. Vie work night and day and spend our money as if it was public property, for the benefit of the sick and destitute, and you cannot begin to imagine what distress prevails here. We cannot procure coffins enough to bury the dead, and to day all the house carpenters in town have quit everything else and gone to makiffg them. Our own citizens have to take the'spade and dig graves. It is really awful. Ile satisfied that we are all doing nur duty, and hope Ood will help up to do good." _ THE BEATS or MR. F. X. MURPS.—A tele graphic despatch to the §t. Louis Republican announces the death at Santa Fe on the 20th of August last, of Mr. F. X. Aubrey, a gentleman Trho for years has been widely known as one of the must daring and enterprising of American traders and travellers. fie wasjfinally stabbed in a fracas with Major Weightmen, who was an officer in the army during the Mexican war, and who two years since was the delegate to Congress from New Mexico. Mr. Aubrey was first intro duced to the American public in ,'lB4B, as having performed one of the most remarkable travelling feats on record. He had been previously known as a Santa Fe merchant of great energy and en terprise. In September of that year ho perfor med the trip from Santa Fe to Independence a distance of eight hundred miles, in five days and fifteen hours, during which time he slept brit two hours, ate only six meals, broke down ell horses, walked twenty miles on .foot, and swam numerous creeks. By the aid of a steamer he made the entire distance to St. Louis, about twelve hundred mile,, in a little more than ten days. In ono of his ex pe4itiens Mr. Aubrey discovered - n new route be tween Independence and Santa Fe, which was much better in every teapect than any which had been previously travelled. In 18.52 Mr. Aubrey drove several thousand sheep across the mountains from New Mexico to California. On his return trip he adopted a new lino of travel with the design of ascertaining the practicability of a railroad to the Rio.Gtande.— This trip, as 'will be remembered by many read ers of the Journal, was full or interest arid ad venture. The Indians who are said to have used golden bullets for their guns, were discovered during this expedition. A short time previous to Ids death Mr. Aubrey had been to Californiaion a business adventure. Ile made the return trip from pan Francisco to Santa Fe in twenty-two days,--the quickest time on record. The trip was made for a wager, which was won by the active traveller. Ile had hardly arrived in Santa Pe, when he became In volved in the quarrel which replied in his death. Nay, Soar, Sept. 'tl.—An arrival from Saint 'Domingo with dates up to the 2011 ult. reports that the yellow fever prevail4d to an alarming extent among the shipping in .port. Many had died.
