who saw no reason, except to prevent the prose

arguments, in any course the defence. might
take.
After s.lengthy discussion, the Court decided
that If the defence made no address to the jury,
the Commonwealth could have but one argument.

circulation' orforeign bank notes of a less -de . -
nbmination thin five dollars, and that it was the

-notes of that description: the jury cannot find
the defendanti or any of them guilty open those

notes of foreign banks of a less denomination

by so doing incurred the penalty imposed by the
48th section of the act of 16th April, 1850; and

learned. He cited numerous authorities in sup
port of the positions he assented, and descanted
upon the motives of the prosecutors in the case
—whom be 'limited was the Pennsylvania Rail
road Convent',
As Mr.. Hamilton declined speaking. Mr.
Stokes for the Cortimonwealth succeeded, making
the closing argument. We have rarely listened
to a more eloquent and effective speech, and dur
.ing its delivery the most profound attention was
paid. Ile attackedthe arguments of the oppo
site comaset, showing their fallacy, and present
el a formidable chain of testimony to the con
sideration' of the jury. •

WATER PIPE BURSTT.D.-,-OR Thursday evening,
we learn from the Allegheny Enterprise, the main
pipe which supplies that city with water from the
reservoir, bursted at the bridge over. Butcher's
Run, (the city lint,) at Straub's brewery. The
water gashed up out of the ground, throwing the
planks in every direction, and threatened to in
udate the low ground in that vicinity; but, - very
fortunately, ono of the employees of the works,.
who lived near at hand, had a plug-wrench with
which he stopped off the water both above and
.beloweho break. Mr. Ray, the Superintendent,
"taid3lr. Painter, one of the Water Committee,
were'soon at the scene of disaster. and men were
bneily employed all night in remedying the evil;
the whole extent of- the damage was not ascer
tained, and it is feared that n duplicate pipe
could not bo procured, so the one which bursted
was of the largest size (20 inch.) It is, there
fore, impossibTe to say when it will he repaired;
it may not befor several daps.
All the manufacturing establishments which
relied on the Water Works for their supply of
water, will, jn consequence, have to suspend op
erations Until] the break is repaired, and the cit
izens will be compelled to get their supply of
water from the river.

Conosnit's Lnurnsr.—The body of a man ens
found yesterday under the wheel of the steamer
Alliance. Ile is supposed to be the German who
was drowned off the steamer Pittsburgh,-some
weeks ago. Coroner Lowry held an inquest upon
the body.
STEAMED. JAS. BOBS SOLD.---Olpt. Carroll yes
terday disposed of nuedialf of the Jos. Robb to
Captain Folger,_ late of the White river - packet
Caroline, and Mr. Clark, of C.hiengo. Captai ,
Clark retains tho command, and Capt. Folger
takes the desk or clerk's office. The sale was
made at the rate or $45,000 for.the whole boat.
She returns to New Orleans and from thence to
St. Louis.
Aectnlsr.-1 man, whose name we could not
ascertain, injured himself 'very badly yesterday
morning, in Allegheny. lie was passing up Fed
eral street, intoxicated, with a knife in his hand;
he fell, and the knife entering the abdomen, in
flicting a very severe wound. It was thought,
from the man's appearance that he was employ
ed on a steamboat, and had but recently arrived
in the city.

A Cabinet courier has been dispatched to
England and France from Russia with the ulti
matum returned, and with the announcement
that rio reply would be made. The result was
announced by the Queen to Parliament on the
27th. -- The 4nessage concluded with the decla
ration that the Queen relied on the bravery of
the 'army and navy in any emergency. Perlis

- A deetaration of war. appears in the London
Gazette of the 28th. On the same day the Leg
islature at Paris- received a message from the
Emperor Napoleon declaring that Russia had
_been placed bra state of war with France. The
French government announces that it will not
grant letters of _marque to American vessels.
Napier's fleet anchored pit Kiel on the 27th.—
Eighteen trumsandltussiana crossed the Danube
on the 21d of March, and 85,000 crossed at Mal
shin without molestation.
A skirmish occurred between the Russians and
Turks on the bridge at ()eland Tubatai. The
Turks destroyed the bridge and --- a,lOO Russians
were precipitated into the river and-drowned.
The Duke of Pamir. was stabbed. by an assas
sin, Imrl died the next day. .
There Was great excitement in Russian pro
duce. Hemp and tallow have again advanced at

VIESNA; Friday.—A dispatch has just been re
ceived announcing that on the 39th the Russians
attacked Kalafat., and took 3 redoubts.
The rupture between the Greeks and the Sul
tan is complete.
The Austrian Bnnk declined to advance the

CONSTA?iTINOPLE, 20th.—The steamers Retri
bution and Caton have returned from the mouth
of the Danube without succeeding in freeing its
mouth from the obstructions placed there by pie
Russians. .
LOSDON, Saturday Morning.—The debate in
Parliament ,on the Queen's address was very
large. War was formally proclaimed yesterday
at the 'loyal Exchange by the civic authorities.
LvrEsr.—Liverpool, Saturday morning.—
There is nothing important. A telegraphic re
port received this morning that Napier had taken
a Russian frigate, is contradicted. The report
that a Russian ship hadbeen ached at Water
ford and the crew held as prisoners of war, was
also doubted.
Thri fire articles of the tri-pattito treaty are.:
let. England and Prance engage to support
Turkey by force of arms until the conclusion .of
a pence that shall secure independence and in
tegrity to the Sultan's dominions. 2d. That the
Porte shall not conclude a pence williout the
consent of the allies. lid. The - allies shall erac
unto the Turkish territories after the war. 4th.
This treaty to remain open for adhesion by the
other powers of Europe. fitl. Turkey guaran
tees to all subjects of the Porte, without distinc
tion of creed, perfect equality in law.
Meanwhile that the campaign has begun in
earnest is confirmed.
The Russians have crossed the Danube in great
force to strike a decisive blow before the arrival
of the Anglo-French force.
On the 23d, Gottschakoff crossed the Danube
above Tulska, and captured eleven guns, 200
prisoners and occupied Tulska, and several forts
on the west bank. Gen. Luders crossed with the
main body from Galata without. much loss. There
are now full 50,000 Russians on the right bank
On the 23d Luders commenced preparations
for the Beige of
~51elsehein. On the same
day the Russians attempted to cross the Dan
ube at Oltenitao whore a desperate battle en
sued, in which the Russians wore repulsed and
the carnage was dreadful; 3000 Russians were
killed. The Turka were so badly cut up that
they/ -ere obliged to retire from their entrench-
Men s. The Russians, however, effected their
passage at three different points. On the very
day that the Russians cro - med the danube, Omer
Pectin had intended to attack the Russian head
quarters at POgana. The plan of the battle was
drawn up and the entire force put under march:
