The case for the defence rested here. dire.. Stokes for the Commonwealth, read the authorities -which would, be referred to during She course of argument. The defence offered - to read the points to be argued - by them, but objected to by Mr. Stokes; who saw no reason, except to prevent the prose • cation from making two speeches to the jury: by the defence not replying to tho first speech. Ileasked the Court to guarantee the right to two arguments, in any course the defence. might take. After s.lengthy discussion, the Court decided that If the defence made no address to the jury, the Commonwealth could have but one argument. It Was a piece, of - getienllShip ; the defence had the right to ufanage their own case as they saw fit. ; • • • Mr. Flanigin then opened for the Common wealth, in his usual calm but convincing style, anti occupied' the attention-of the Court until the hour of recess. Arrwoos Mr. Darragh, on the part of the defence, ad dressed the jury. Ile---ftnt read a number of points as follows: • The Court are 'respectfully asked to charge the jury on part of.the Arterolotar,_ Ist, In order to constitute a conspiracy, it is necessary either that the purpose to be affected by it,. must be unlawful either in respect of its object;.orin respect of the moans, to be employ ed to accomplish it. 2d, That concert is the of ca_espiracy, and to make it. such, elthei the means agrecslup on, and concerted, or tbe object of it must be sin lawtid s Bd, That ifVe‘jury shoirld believe the object of the alleged conspiracy to hare been to solicit, indnep, and procure the corporations and indi.ri duals mentioned in the indictment, to vitnate and disobey, the 48th end 49th sections of the act of 16th April, 1850; prohibiting the issuing and circulation' orforeign bank notes of a less -de . - nbmination thin five dollars, and that it was the ordinary &Saltless of saidcorporations and indi viduals to pay opt and put in circulation bank -notes of that description: the jury cannot find the defendanti or any of them guilty open those counts, in the indictment charging such purpose to have bcpn the object of the conspiracy. .4th, That tho, depositing of Bank notes with the . torpomtions and individuals named in the indictment, and checking - it out in unequal amounts, idid that the payment of said checks to notes of foreign banks of a less denomination than fire dollars, was therebya voluntary act on the porter:said corporations.and individuals. Lth, Thai the depositing of bank notes - with the said corpontions and individuals, and check ing the same out on checks calling for money generally of naeloolamannts, did not impose upon said comer:laths and individuals 'any cam pulsidn; obligation, or give them a right to pay inch checks in notes of imm"denemination than • five dollars, in foreign hank notes; they having • itin'their- power to pay.said thecko in notes of • one dollar and upiards, and less sums in specie and'9tate scrip. That if the jury should believe the object of the alleged conspiracy , was to obtain the pen alties imposed by the 48th and 49th sections or tle.ect 'qf..l6th April, 1850, the. conspiracy Is not imbiwful in-respect of its restore and object. .7tli. That tho . depositing of bank notes ..with raid corporations for money generally in unequal =mints are not unlawful acts, and therefore the object of the alleged conspiracy is not unlawful byzeison of the means employed to accomplish 79th. That if the jury believe the cashier of the 'Farmers' Depotit Barak paid out the fourteen notes - describe:l.in the indictment, that the Bank by so doing incurred the penalty imposed by the 48th section of the act of 16th April, 1850; and that the offer of a proposition .made to said. That if the jury should beiTeVe that the defendants, or any. of there, deposited bank notes with'said corporations and individuals, or either .of . them, and afterwards drew checks:in !vial or unequal amounts upon said corporations anddrolividuals; for the purpose of suing them. for the penalties provided - by the 48th and 49th seed= of the act of . 1850, neither the object nor the means of accomplishing it render theca guilty of a conspiracy to induce, solicit and pro- cure the said corporations and Individuals to via , late the said secthms of -the act of 1850. 10th. That in order tweonvict the &fondants, or any of them, upon the counts- in the indict ment, chaiging a conspiracy. to _defraud the county of Allegheny, it is necessary to aver in the indictment and to prove on the trial that the county had acquired an Interest in the penalties incurred by the Farmers' Deposit Batik in issu ing the fourteen notes' described in the inflict- 11th. That the county of Allegheny hid no In- Iciest in or right to any part. of the penaltieafor using mid fourteen notes described in mid in dictment.until action commenced in the - Courts - of said county for the recovery of said penalties, end that the defendazits, or any of them, cannet be coarlited upon the counts in said indictment, charging, a conspiracy to defraud said county out of her revenues sad money'. 12th. (That if the jury believe that the Fanners' ,_Deposlte ' Bank received in its ordinary .beialuess, notes of foreign banks of less denomination thon five dollars, and paid notes' of that description to its depositors, directly,. or to other persons, upon their Checks drawn upon mid bank, or sold said small notes or exchanged them for other money, or deposited them with broken., or checked upon thEm, it was a violntion of the 48th and 49th meatless of the act of lath April; 1850, and is strong evidence that it was their ordinary busi ness to payout and deal in foreign Bank bills Of . this description. . WATER PIPE BURSTT.D.-,-OR Thursday evening, we learn from the Allegheny Enterprise, the main pipe which supplies that city with water from the reservoir, bursted at the bridge over. Butcher's Run, (the city lint,) at Straub's brewery. The water gashed up out of the ground, throwing the planks in every direction, and threatened to in udate the low ground in that vicinity; but, - very fortunately, ono of the employees of the works,. who lived near at hand, had a plug-wrench with which he stopped off the water both above and .beloweho break. Mr. Ray, the Superintendent, "taid3lr. Painter, one of the Water Committee, were'soon at the scene of disaster. and men were bneily employed all night in remedying the evil; the whole extent of- the damage was not ascer tained, and it is feared that n duplicate pipe could not bo procured, so the one which bursted was of the largest size (20 inch.) It is, there fore, impossibTe to say when it will he repaired; it may not befor several daps. All the manufacturing establishments which relied on the Water Works for their supply of water, will, jn consequence, have to suspend op erations Until] the break is repaired, and the cit izens will be compelled to get their supply of water from the river.
