Cochran was intoxicated. Shortly ;af terwards he - stopped at 'Wilkins' Ball where he met Jewell, to whom ho related the circunistan: ces of his ditScultiwith Mitchell, which resulted in an offer by Jewell to go down and see fair play. Jewell, Cochran; and several others then proceeded -to; the corner of Wood and Water street, where theilnet - The latter ran towards Market street, followed by the others, Jewell in the lend: When they caught up, Coch tin struck - Mitchell with his Got, and at the earns . time, Jewell cut him with a knife. - . Mitehell fell and immediately expired. Coch ran surrendered him Self to the pollee. Dough erty and Reed started after Jewell, and after a desperate chase and struggle, arrested him on 7th street. - Jewell and Cochran were fully committed for trial for murder. Shortly afterward a man named Gaw,'one of Jewell's party, surrendered himself. . • . On the Bth of July Cochran was brought be fore Judge Forward, on a writ of habeas corpus, and his release on ball demanded. IV. IV: Irwin, Esq., appeared for the prisoner. The motion was overruled. On the Bth of December, November term of Oyer and Terminer, 1852, Jewell was placed on trial for the crime, Judge 111.`Cloro on the Bench. Messrs. Darragh, Skater. Umbstaetter and Stan ton, among the most celebrated lawyers in West ern Pennsylvania - appeared for the prisoner. The trial occupied two days and nights, and was conducted with consummate skill by the at terniee for the defendants. Their speeches will long 'be remembered for their tattling clo •quente. Judge McClure charged the • jury strongly— reviewing first his duty to himself, and to the jury --to the Commonwealth and to the Prisoner —specifying Vivi - various degrees of the crime of murder. his Honor then recounted in brief, the various circumstances testified to by the irjt flosses, anti which wore uncontradieted, and A pe:act' the particulars-of the arrest, and the endeavors of Jewell to escape. The charge occupied about half an hour r and excited a preload sensation.-- After an hemi'S deliberation the jury brought in a verdict of guilty of murder in the first de gree. Cochran's trial was immediately proceeded with; and resulted in an acquittal. - • On the 14th of-December, the trial of William E. Gaw was proceeded with, — "with the same re sult as in the case of Cochran. On Thursday, December 23, 1852, n motion in arrest of judgment and for a new trial was ar gust by Jewell's counsel. Oa the succeeding thin Judge McClure read a written opinion, re viewing the arguments advanced.hy the prison er's counsel at some length The motion was overruled. Jewell Was then sentenced, by Ids Honer, to be executed. Upon being asked If lie had anything to say why the sentence,of deatlf should not be pronounced upon him, he replied, "Nothing fur ther than that I am not guilty of the crime al leged against me:' Daring the 'whole trial;-the Court room was densely crowded, end greatsympathy was shown the prisoner. application fore writ of error, to hare the case reviewed by the Supreme Court, was mule shortly afterwards by the counsel for Jewell, but tins refused. . lu the meantime, petitions were circulated, and very numerously- signed, for his pardon.- 31any of the inset influential citizens took direct interest in Lim, influenced by the fact that- his companions had been entirely acquitted. Ho received intelligenue from Harriaburgli.Almost official, that the-Goveruor would never Sign his death warrant. He felt perfectly secure and ' was even disposed to protest againa the delay of the Executive in forwarding his pardon. In the midst of all these hopes and ttssurances, when he was almost calculating upon matters he would become enraged in when he became free, Sheriff Magill, received and read to him un Thant <lay the 21st of July, 1853, his death .warrnnt, fixing the day of execution on Friday, the second of SepteMber., So nnerneeted was it, that the prisoner eiould barely realise the fact His family new noth itig of it until, they , called upon him in his cell. Ile then began to prepare for his awfel.fate, and 1 was visited by ministers of every denoirdnation: I By the unwavering efforts of Jewell's counsel; they succeeded in obtaining, from Judge- Lowrie; of - the Supreme .Coiirt a special- allocutur, to . , have the proceedings reviewed by the Court.- 1 Governor Bigler forwarded an indefinite respite for the prisoner. The case - wits argued before the Supreme Court on thelatter part of October. On the the opinion of the Court was read, affirm ing the vv . :cue:hogs of the Court below. The alleged errors were carefully examined . and titled lit NOvember, Governor Bigler forwarded an , other death 'warrant fixing the 10th of February as the day of execution. A few days previously to the day-named for his "execution, a bill was introduced into the Sen ate to grant him a new trial Judge McClure was bitterly assailed by the friends of the pris oner. The bill was, however, lost in the House, by a majority of one. A respite from the Gov ernor was received on the very day named for his execution. The prisoner suffered a dozen deaths from, the rumors in circulation. Telegraphic dispatch - 0 - ' were constantly passing and repassing, some bearing hope, nmlothers speaking despondingly. Oar readerr, are all aware of the subsequent occurrences. A few days before the-action of the Legislature he very nearly succeeded in es caning jail Ile had sawed his irons nearly off, and could have broken them at any hour. -His friends had procured him every instrument need- ful to break jail, and he had otherwise abundant opportunity, but it appears, he bad not the nerve to attempt it. Jewell is probably about thirty years of age. When he was first locked tip he was very heavy, full faced, and sinewy. However,. anxiety and grief, hare worn him down very much. His fleshiness vanished, and great wrinkles covered his cheeks. ' His career has:been rather eventful,'at least as much as we could -ascertain.
