Mr. Jackson encloses a copy of a letter to the Austrian Minister of 'Foreign Affairs, presenting . the circumstances of the case, end odds that he hopba the individual may be permitted to leave the Austrian dominions; but it is more than pro bable, he continues, that at the present time, the Austrian governibent will be particularly senli rive upon a matter touching the citizenship' of one who woo formerly en Austrian subject, ac quired under our Naturalization Laws, and that it will insist upon retaining possession of his per aon. Should, therefore, the facts of the case as they may hereafter be developed, confirm the statement of Tousig, a serious question may arise . for settlement. Tousig in his letter doted at Prague, states that in 1819 he csme to the Uni ted States with p New from Austria and set tied tied himself in ew York and became a citizen of the United States. In 1853; he obtainei a passport from the State - Department at Washing ton-and went back to Austria to conduct a help less family, a widow and five young children, to their relatives in Prague. The Pollee, lie says, obtained his passport rind refused to return it to him, that he might come home, and they Said to him, "You are an unlawful emigrant- and ought to pe punished, and you cannot beoome a citizen or any country before you get lease of your sov ereign." lie relates his vain efforts totet back his passport, and appeals to the American Min ister far an interposition of his authority. The letter of Mr. Jackson to the Austrian authori ties, concludes with expressing en expectation that no further obstacle will be offered to Tousig, bat that his speedy departure for the United States will be permitted. A second letter from Mr. Jackson mates that the Austrian govern ment claims Tousig as a subject and as a fugi tive; thatdsc had been away from the country but a few months, not long enough to have be vim° au American citizen. Mr. Marcy wrote a letter to Mr. Jackson da ted on the 10th ult., in which be states that he has examined the mac, and regrets to find that it is ono which will not authorize a more effect ive interference than that which our charge has already made in his behalf. it is true, he says, that Toysig left this country with a passport, but as he was not a naturalized citizen, nor na tive born, he was not entitled to it, mai he finds that it was obtained by perjury. , The documents were laid on the 'table, after which the House adjourned. The Erie Etattread DlElenity . Berraxo, Feb. 3.—The railroad moo re-laid the track where it was torn up yesterday, but two hours afterwards, in consequence of the ex citement among the people. Mayot King ordered it to he torn up again. Got. Bigler is said to be displeased with this gct. The Mayer has signi fied that it shall he ro-built to-day. ' The excitement runs high and the people seem disposed to act independently of the Mayor or Governor. Yesterday, a mob headed by Mr. Loomis, col lector of the port, endeavored to prevent the de parture of the freight train on the Western road. Gov. Bigler has. appointed Col. Parker to take charge of the Western road, thc charter of which has been revoked. - Gov.
