Bat In order to relieve the Couipany from any eztraordinary cost, the decree admitted that an elevation of the height of one hundred and eleven feet from low water, for a width of three hundred feet across the &meet of the river, would be regarded as an abatement of the nuisance and &removal of tho obstruction. When this opinion was pronounced, the Coun sel for the Bridge suggested to the Court, that the obstruction might be removed by making a draw, and it was ordered that Mr.ld'Alplae, the engineer to whom the eubject waarefeiTcd,ehould report his opinion before the Second Mondayln the ensuing May. When the Court er,ein Con , vetted the original decree was so modified as-to allow the Bridge Company to nonunion a draw of two hundred feet in length acrese the western channel, to be used when navigation Pas inter rupted under the Suspension Bridge which was -toJie considered en abatement of the cabanas. This compromise was acceptable at the time and both parties named gratified. Congress was In session at And after both these periods. As soon as the first decision of the Court was rendered, the opinion of the dual minority tree printed and circulated through the western country. Miss meetings were oenrencd in the States of Ohio, Indiana, and Illinois , and their Representativeuwere instructed to vote for each leg - fellation as would effectually vitiate the decree of the Supfeme Court. Accordingly an amendment was offered to the Net Otrote Appro. viatica BIS, declaring the Wheeling Bridge a post route and a legal etracture--in other words, precisely what the Court had decided it was not This amendment became the law of 'the land, and as each it stands' to-day. The Bridge Com pony bare noVeshibited any disposition to com ply with the order of the Court, and claim to be absolved from all responsibility by the interven tion of Congress. When the modified decree of the Court was; given, it Wu ordered that the counsel on either eido might move in regard to the execution on the first Monday In February next. 'And It is to be presumed the State of Pennsylvania till be represented hero then, to dernand the execution, and the adverse party to • mat the motion, on the grciand that the legislation cited Interpose' constitutional barrier. Now eoppolte the Court sustaining its own deliberate judgment, should hold that the nuisance had, not been abated according to Its order, and Should direct the U. & Marshall to remove the bridge, what would occur? , The peo ple of IV heeling would probably resist the ld sr sigd, under the pretext that they were upholding the low of Cougrees, and then the questiov would arise whether the President would sustain the Court by the military power or allow it to be restrained by the mob? ' No one doubts the full commercial power of C.greer, and its right to legaltze this strnoture under the ordinary exercise of that power. Bat here was a special case under ezistlatt laws, der cided by the highest judicial tribunal, and the legislation woe intended—whatever it professed to the contrary—to subvert that decision. Now which will Stand—the law as interpreted by the coostltutional authority, or a law contrived to defeat the exercise or that authority?
