A bench warrant was issued for the arrest of the defendant, who wet on his route to Californ, I on the application of Reis, on the gounde that he (Reis) had paid to defendant the cum of $5OO, as part of the purchase money for !lame real es tate, on the condition that if the title did not prove satisfactory to him, (Rein,) the:defendant would return the money; that the title bad,proved bad, and that the defenndant had refined to return the money; that defendant knew the title was bad at the time of making -the sale to him; that the defendant was removing hie property beyond the jurisdiction of the Court, with the intention to defraud his creditore;fand that he has property yet in this city, which he fraudu lecitly conceals. Tobias Myers was arrested at Harrisburgh while in the care, and brought to this city Yu .terday. Hie counsel, Judge Bhalei, then pre sented to the Court a written affidavit of Mr. Myers, to the iffeot4.hat he WO3 not indebted to Reis $500 ; nor in any other sum. The estate in question was purchased at an aseigeoe's sale, and eold to Mr. Rein for $2OOO, on which he was te-hue paid $755, but had really only paid $5OO, far which Myers gave his receipt, making the money retunaabiedo Reie if the title did not prove satiefactory. Mr. 0. 11. Rippey, Reia' counsel, had told him that the title was 'Austen tory. Rein had requested him to boy in the property of Judge Warner, lying next to the property in question, at the same price. After some diffi culty he (Myers) had persuaded Judge Warner to'sell at the same pita; of which he informed Rein, who than wished to back out from bath arrangement; on the ground that when Pierce came into the Government, Col. Samuel Black would be appointed Governor of Oregon, and that he (Rels) aad,a company in Philadelphia would then go into s annotation in 'Oregon-- Deponent:erased-to allow Rele to recede from the first arrangement. Deponent then went on to say that he had three hundred dollars of hie own, and that hie wife had $6OOO which had been given to her by his father, without his making any assignment of his property to him, or, verbally or by wri ting, agreeing to refund it: that it woe a mere gift; that he owed money to hie father; on the Thursday prior to hie, departure, he bad told Reis of his intended trip, and Role had promis ed to call that day and pay the $255, that Lt had not called; be also told-Reis that he would leave the title deed in the pomade° of Judge Warner, who would hand it to him (Reis) when he paid the balance. That he had no property fraudulently concealed from hie creditors, and that he had no creditors. • • • • • • On his examination Mr. ?dyers re•affiimed the above, and stated for the information of . the Court. how the proms of the Court was served upon him. - Two constables got in the cars at Harrisburg, and came in the car in which he and his wife were seated, and asked for Myers. He stood en and said that that was his name, when they cried otit that they had a warrant for his arrest for false pretences. He had the greatest difficulty in securing his baggage. Hundreds of people gathered around and prevented him moving. At last he succeeded in reaching a hotel where he left his wife dud baggage. He WAS then taken to a Squire's office, and put in jail until he bound himself by recognizance' to appear in Pittsburgh. He telegraphed to Mr. Hunter, en. - quilling into the matter, when he was informed that Rein •tiad had • bench warrant inened on the property subject, and that he had better coma home Immediately. Judge Shannon remarked that ho only wished to know the manner in which these warrants were executed for information merely, that Mr. Myers had abundant remedy in another action.
