Ho observed that he had nib:lusty examined the testimony which had been brought before him on behalf of the defendant, and bad come to the conelnston to remand him The cherge brought against him, was of a very serious es tore, and he had bren rem milted by the Coro .nee, a ,cry of twelve men haring charged hint with being concerned indite murder of Samuel Mitchell, the deceased. His honor, could not for a single moment forget this fact. The find ing of a Coroner's jury was, in England, and probably -in the United States odmiseible evidence la courts of justiaa. From the testi mony taken before there. it appeared that the prisoner on thr.afternou of tb, Fifth of July, had had n quarrel rith the deceased, on Water stmt. He went away, bat retitrnedenbsequeugy with three men, an 1 atfirUked Mitchell, who fled. The defendant sod threeothers, pursued him— stones were thrown and he wee overtaken.. The miscuer might not have had any idea of killing the deceased, hut from the evidence which had been brought forward, and as it stood, without explanation, the learned Judge could not but believqin his guilt. The view ofJudge King, was, he thought, the proper test In a case such as the, namely -Would the Court sustain the verdict of a jury, of reorder in the Gredde gree, on the evidence"' For his part, he thought that he would ba compelled tooto se. SO far as regarded the accretion that if ti hum. loide occurred when a party only intended' to commit an aeeaolt and battery the offence was rikuced to murder in the second degree,-Mr. JUsticeirewis bad very properly remarked that the Intention was immaterial, being excluded in case of felony. Mr. Caldwell, one of the witnesses, had a tater! . that he eaw two men endeavor In pull the man who need the knife, eft the deceased, and the minute' for the defendant hat contended that the defendant was one of those persona, but no evi divine had been cffered to curtain that nssertion. Upon the whole, be had arrived at the conch'- . sionin remand the prisoner, for the ',resent. It might, however, be, that the circumstances which appeared in evidence were tomeeptible cf ex plat:Winn, and if the connect for the prisoner should desire a farther hearing, be would per ' adt the defendant to he brought before them • . again. W. W. Irwin, Esq., stated that the Coroner's Jury had not (toad biaelient guilty of murder but of having been concerned in nn offray in Which the defendant was a participant.
