Newell was buried deeply, and was, when extriexted, quite dead. He resided in Lserenceville, and leeves a wife and five children to lament his untimely end. Tarp, a young man of about twenty two year's old, was not so deeply buried, but his leg was broken, his !mad @sashed and he received other injuries of so emit a nature, that he only uttered an exclamation of pain on being exhumed, and died. Most important presumptions are derived from tin conduct of parties. And in general where a party has the means in his po'wer of rebutting and explaining the evidence adduced against him, the emission to do so furnishes a forcible inferrence against him. When a man commits an unlawful act. Ileac eompanied'by any circumstances justifying the commission of it, it is a presumption of law that he has acted advisedly. and with au intent to produce the consequences which have ensued. • A presumption is where acme facts being pro sod another follows no a oatmeal conclusion trom them. Violent ,presumptions are where the facts and circumstances proved necessarily tend the fact presumed. Circumstantial evidence is receivable in crimi not to well as to civil cane, moo the necessity of aubmitting each evidence in criminal cases is morn obvious than in civil ems ; for in criminal sans the possibliity_of proving the matter charged, by direct and positive testimony, is more rare than in civil eases. Evidence lereither direct, where witnesses tes tify no to facts .of which they have had actual knowledge, or it is indirect, presumptive, or circumstantial, where the feet is not proved by direct evidence but is deduced or inferred from one or more other facts which are directly proved or admitted. • Circumstactial evidence Includes all evidence which le not positive and direct. A presumption le an inference as to the existence of one fact from the existence of some other fact foundea cn a previcus experience of their connection. . Natural presumptions, or presumptions of fort, depend on their own natural force and efficacy in generating belief in the .mind, derived from those natural connections pointed out by experi ence; and where natural presumptions are de rived wholly by means of the common experiences of mankind from the course of culture, and the ordinary habits of society. It is evident that a witness who had never seen such a transaction before, or a 'juror who had believed the testimony of such I witness, would as readily come to the proper conclusion as one who had actual experience of similar facts. It follows that reason and com monsense, and not experience, supply the infer ence.
