All the ele ments that could possibly oppose a ready selection of a Jury seemed pres ent. It was a most remarkable coin cidence that a long line of Jurors would follow ulih the snine Idea as to circumstantial evidence. The 11111J01 -Ity of them. In fact, nearly all of them, nveired that they could not pos sibly convli t the defendant on clremn Ktantlal evidence, no matter how clear or strong or how conclusive It might he; they all Insisted that It would be necessary and essential to hear the testimony of an eye-witness of the happening. Reside this peculiar condition, there was uuother just as strange, Theie were numerous of the jurors who af firmed thai they had formed an opin ion as Iti the defendant's 'guilt, based on the newspaper reports, which, while thev might set aside In the face of the law and evidence, but when pressed by Jlniphy. of the defense, they declared they would not say posi tively that they could set thl-t opinion aside. Those were the circumstances that piled up the challenges for cause 011 both sides: the dlsbellel In circum stantial eldence for the common wealth and the presence of an opin ion or prejudgment for the def'iise. "SVIuit appeared to threaten the commonwealth'.- side or the ease, arose when the name of Charles r.lhnan. of Ilawley. was called and there was no response. tl developed that the juror had not been summoned by per son: he moved 10 Huzleton some months ago. and while the summone. had been mailed to him. the sheriff (otild not locate the reply Rellmau sent. .Mr. .Murphy then raised the question as to the regularity of the panel, there not being a rull one by reason or Rellinan not b"lii(5 a resi dent of the county. At the opening of the afternoon ses sion, lie presented in writing reasons why the Indictment should be iuasbed, based on the fact that the panel was not regular. The district attorney anil Mr. Seniles met this with a decision of the Supremo court, which so impressed Judge 1'urdy that he denied til- mo lion, allowing a bill to be sealed for Ih" defendant. When court adjourned, the defease had exhausted twelve of its twenty challenges, while the commonwealth used only half of that number. The prospects of selecting a jury to day is looked upon as brighter, as there will be a different class of men, those who, II Is expected, will not be so unwilling as those of yesterday plainly appe.ui d to be.
