The cases of John Williams against Charles Gets and SI. A. 1'aily against Joseph Krett weie non-suited by rtason of the failure of the plain tl'Ts to appear The case of W. R. Fress k Son against James Flynn was refered to 15. I. Tinkham. Except to the Grand Jury's Boport. William Connell, Ezra H. Ripple and Alfred Hand, by Attorney W. J. Hand, j'estcrday filed the following exceptions to the report of the grand jury, ap proving the petition for the annexation of Pyno, Sloan and Archbald villages to tho borough of Taylor: t Firjt The application should have been dissp proted by the gland piry Inasmuch as it was ap psnnt from the leccni that the application cf petitioners was not propuly advertised as ie cpiireil by law, and tint the notice cf tha n jentation of the petition to court was not prop erly giten as required uy law. Second lite grand jury erred in receiving etl lence against the proUst of exceptants' counel, that the court was Mvrahle to the scpiraticii of 'h- territory .ought tu be annexed to the borough of Taylor In ir.ese proceedings fiom the township of I.ack.ianna, and its annexa tion to the borough of Tajlor or the city of Scranton; counsel for the petitioners having stated to the grand jury that his honor, .l.i'h'e Archbald, in an epinloi fled in the mtttcr of the incorporation of the borough of Pyne, (hat the territory in question ought to 'jc anncved either to said boiough of Taylor or the city of Scranton, and, further, followed up such state ment with etidence to the same effect. Third The grand jury erred in approving the application, inasmuch as the undisputed etidence ehowed that the territory sought to be annexed, constituted two-thirds of the awrsiert taluatlnn of the township of Lackawanna, and that the re malnlng one-third was utterly inadequate to pro. tide revenue for the support of the scluols for the remaining three-fourths of the population of said township. Not an Incurable Defect. The omission of a revenue stamp on a legal document Is not an Incurable error, Judge Archbald says, In an opin ion filed yesterday in the case of M. A. Scanlon, administratrix, ngalnit Ed ward Burke. Tho defendant was a tenant of the plaintiff's hotel property, corner of Main avenue and Lafayette street. Judgment was entered on a confession In the lease for rent amounting to $116. The defendant sought to have the Judgment stricken oft on the ground that, at tho time tho lease was exe cuted, no United States internal reve nue stamps were affixed, as required by law. After the judgment was en tered the plaintiff, by her attorney, Thomas P. Duffy, went before Internal Revenue Collector Penman, confessed to the neglect, paid the prescribed pen alty of $10 and had the stamp affixed. This, Judge Archbald says, cures the defect. The judge remarks: It it not every omission of a stamp that nukes the unstamped instrument invalid, the court says, but only where It has been omitted with intent to evade the law; the other restric tions almnlv affect, not the validttr. hut th. . use of the document; It Is not to be received in evidence or allowed to be registered or record ed. The remedial features of the statute in re lief of the penal part of It are to be liberally and not nairowly construed, and when the act itself declares that the Instrument, upon being properly stamped by the collector, shall be held valid to all intents and purposes, the same as If tamped originally, how can we say that it shall not? The provisions quoted are substantially re-en-aetmt-nts of the statutes passed to raise a levc nue to meet the expenses of the national govern, ment growing out of the war of the rebellion and the decisions under those acts are, therefore, pertinent with regard to which it was decided by the collector related back and gave the Instru ments validity from the beginning, Discharged From County Jail, The following defendants who were In jail In default of ball on charges Ignored by the last grand Jury wera yesterday discharged by order of court. Another Development in the Cor coran Murder Case. It Is probable that the brutal murder of Michael Corcoran, of Duryea, on De cember 3, 1858, will be avenged. One of the men Implicated In the crime has made a confession, and although ho mentioned no names the detectives ex pect to succeed In their efforts. The man who made the confession lived In Wllkcs-Barre. Several weeks ago he was placed In Jail on some triv ial charge and was taken 111, dying a few days ago, A short time before his death he stated that he and two other men had planned to rob Corcoran'a place. One of the men Is working somewhere In this part of the state, and the third man Is In the west. When they broke Into Corcoran's place they went directly for his room. They forced open the door, and by this time Corcoran was awake and wai against the door. Although Corcoran was of powerful build there were three against him, and the door was forced open a little way. One of the men then became excited, and pulling out a re volver, placed It In the narrow aper ture In the door and fired. The bullet went Into Corcoran's neck. The three then went Into the room and bound the Monohan woman, who had by this time appeared. The robbers and mur derers broke open the "safe and got $33. WIlkes-Barre Record.
