SCHOOL BOARD IS
NOT IN CONTEMPT
OPINION OF JUDGE EDWARDS
IN FELL CASE.
Gives Some Advice to tho Members
of the Board as to What They
Should Do Hereafter in the Way
of Purchasing School Books Judg
ment Reversed in the Case of Mary
Ann Giay Against John L. Ben-

ions.
Opln-
Two opinions wctv liandVd down
yestetelay by Judges H. M. Kdvvnrds.
One discharged tho "rule to show
cause why em attachment for con
tempt sdiall not lsstlo :igaln3t the de
fendants," In tho case of Nicholas
Olynn, and otheis, against John Mc
carty nnd others, school directors of
tho school district of Kell township.
Thu opinion follows:
On November 1, lit".i, In an opinion Illcrt
ul that time, wo adjudged a ceitain
contract entered Into between tho school
boaid of Pell township and Olnn Ac Co.
to I o Illegal, and dlicctcd tho Injunction
to be continued until tho lurther order
of the cotiit lost raining the said school
bcurd fiom can lug out tho terms of tho
contract.
When wo made tho order contlnulm;
thu picllmliiarv Injunction our Intention
was to lestrain tho school board lrom
miking any putcluifcs under the con
ti iit-t which wo adjudged -void and not to
prevent tho boaid fiom purchasing such
books as were necessary to leplaeo nth
cis that wcio worn out or lost. Subse
quent to that tlmo an allldavlt was pie
sentiil to us alleging that the school
be aid wcte replacing the book In use In
tho public schools of Vanclling by books
funiMicd by (linn it Co, and that tho
books so furi.lshed were purchased In
violation of tho terms or the Injunction.
Wo thcici.pon granted a rulo to show
cause why the school boaid should not be
adluilged to be lti contempt. Depositions
wtio taken and tiro now beforo us. (liv
ing to the testimony contained In the de
positions its greatest probative force we
Und th.it alt the school bo ml has eloiiu
has been to ic place books that aro woin
out and test and books that weie iie
lroed by a tiro with the books that are
furnished by Olnn A: Co. Wo know cf
now law to pi event the school board
from meeting such emergencies In tho
w ly they have done.
It must be remembered that the school
board of Pell township for sevei.il years
havi- failed to comply with the reiitlie
mi'lils of tho law providing for the selec
tion of text books alter the annual elec
tion of the teaohois aril that books hivo
been bought by them from tlmo to tlmo
to supple the nccissltles ot the school.
'Iho only way the school board can
siitiaro themselves with the law is to
piocced Immediately after the net an
nual elee tlon ot teacher to call the
tenihcrs together us an advlsorv body
and to adopt a. rerb s of test bonks for
tho ensuing thrco cars. Once thov are
started In tlm right direction It will be
an easy matter lor them ulteivsants to
obseive and carrv out tho inamlitoiy
provisions of the statutes governing tho
selection of text books.
We aie clearly of tho opinion that tlin
school board Is not In contempt and wo
theicfoie dl-chargo tho rule and refill
the attachment, and we cliiict the plain
tiffs to pay tho ecsts of these proceed
ings. CRAY-RRNOOUGU CASH.
The other opinion was In the cae
of Maty Ann Gray against John L.
Hengough. It Is as follows:
Wo have examined this caso carefully
and urc satisllcd that under uidlnary cir
cumstances tho l ei old ought to be sus
tained. It appeals that u summons for
board ami an attachment under tho act
of 1S7C wcio Isiuod at thu sanio time. At
the healing befoio the justice the at
tachment was ell"solvvd and judgment en
tered against tho defendant upon the
proceedings commenced by tho summons.
We havu laid lcpeatedly that an at
tachment for board, unsupported by a
pi ev Ions jiulgmi'iit. Is not valid, but it
the- attachment Itself Is dissolved tho l'lo
ceedlngs under tho summons lemaln, and
wo know of no reason why tho Juilg
inciit under the summons should not bo
sustained.
The pioceeellngs are regular, tho causo
ol ae lion Is clearly stated, plaintiff and
ch fend int appealed, nnd Judgment was
leul.iilv entered against the defendant.
Whv Is not sech ii Judgment valid to.
gaieties-, of the fact that an att ichment
was IssiioJ a in subsequently dissolved o
tin- Ju-tii-'i at tho lime ot the hearing.'
Notwithstanding th.it this is our view
of tho law. and that wo shall continue to
so hold until otherwlsu convlnceel, we
aie constrained In this ease to reverse
the proceedings. The attorney for tho
defendant tolled upon tho caso.of Thutch.

Reap Case Argued.
Judge Putdy, of Honesdale, yester
day heard the reasons for a new trial
In the case of Jane Reap ngalnst tin
city of Scranton. The plaintiff lives In
the Thltd ward and recently obtained
a verdict of $200 against the city, she
claiming damages caused by wat'if
running on her ptemlses from tho
bridge built over a creek. The city
appealeel from the verdict and jester-
day morning City Solicitor Vosburg
appealed for the city and Attorney 0.
Comegys for the plaintiff.
The reasons given by Mr. Vosburg
weie that there was no negligence on
tho part of the city, the defendant's
houe being below the street level nnd
furthermore that tho defendant lial
been notllled suveial times to lav a
sidewalk, which would have prevented
any damage fiom water.
Attorney Comegys argued that the
city was liable, Inasmuch as a ditch,
the blocking of which caused the over
flow, should have been kept clean. II?
further contended that tho city could
not compel piopeity owners to lay
sidewalks, which Is a legal point never
bi ought up In this city before. Judge
Purdy took the papers In tho case and
will hand down an opinion later.
