ThoniitH Coleman, of Parker street, aged 19 yenis, and Frank Parks, of Depot street, aged 20 years, the two most serioi'sly Injured, were employed as driver boys. The reasons given by Mr. Vosburg weie that there was no negligence on tho part of the city, the defendant's houe being below the street level nnd furthermore that tho defendant lial been notllled suveial times to lav a sidewalk, which would have prevented any damage fiom water. Attorney Comegys argued that the city was liable, Inasmuch as a ditch, the blocking of which caused the over flow, should have been kept clean.
