In equity court yesterday the hear ing of tho case of Thomas Davis against the Lackawanna Coal com pany, limited, was concluded before Judge Savldge and Wedncuday next fixed as the time foi licuilng argu ments. The defence was, m told in yestei day'fl Tribune, that DjIh' leasehold had lapsed by reason of his failure to begin mining within u specified time and further that the lease was signed by the Davenports tinder u mlsappie henslon. Mr. and Mis. Dnenpi t both testi fied that they were led to believe they were to receive $20,000 for their Inter est In the property, but It afterwards developed that the agreement which they had been Induced to make would give them much smaller returns. They further alleged that certain papers en tered In the case purporting to bear their signatures weie forget les. The cases of the city of Sorunton against Charles Du Pont Uieck and others; tho Northern Co.il and lion company against the City of Scranton, and C. J. Keogh and otlu-ss against the 1'lttston and Scianton Hnllw.iy company were continued. In the answer filed to the suit of the Real Estate Tiust company, of Philadelphia, trustee, to have a re ceiver appointed for the Cnibondale Traction company, the officers of tho defendant company admit all the alle gations of the complainant nnd declare the company to be Insolvent. The case Is set down for a hearing this week, but It Is In process of set tlement, report has It, and may be dis continued. Church Against Winton Again. Another equity suit has grown out of the contest between the Church ana Wiinton estates over tho Griffin tract: coal royalties. S. B. Price, representing Charles J. Church and Charles J. Church, admin istrator of Joseph Church, has sued to compel the representatives of tho Winton estate to acknowledge the Church estate's alleged one-fourth In the land nnd give an accounting of the royalties so far collected.
