Dennison Granted n, Divorce Ar gument Court It Is now moro than likely that tho murder of Anlello Dl Santo will go un avenged. Tony Vlllolo, the man who was In custody awaiting trial for tho crime, was yesterday discharged on habeas corpus proceedings before Judgf Edwards, and tho authorities know nothing of the whereabouts of any of the others Implicated In the killing. Tho murder was committed In Joseph Stcmplanger's "bottling establishment," at No. C, on Sunday afternoon, Oct. 1. There was a Jubilation going on at tho Itnllan colony near the brlckyard.whlch was attended by a number of Carbon dale Italians, When the latter started for home, half a dozen of their friends accom panied them to the street car. On tho way they stopped Into Stemberger's place to have a parting drink, and had only been seated at the table r. fw minutes when a general light broke out. Dl Santo was mortally wounded by a knlfo-cut In the abdomen and Steven Vlllolo, Tony's brother, had his leg gashed by a razor, while Mrs. Stem planger, who was conducting tho bot tling business that afternoon, sus tained a gash In the arm In attempt ing to quell the disturbance. Dl Santo died on the premises, n few hours later. Tonv Vlllelo was arrested that night by Ch'.ef Robllng. His brother was taken to the Lackawanna hospital. The othf-rs scattre-l and tho author ities have een unable to find out who they are or where they have lied, If they have fled. Steven Vlllolo, upon recovering sufllciently to leave tho hos pital, decamped and his whereabouts, like that of tho others, is unknown. Who inflicted tho fatal wound Is not known, but It Is quite cerinln that It was not Tony Vlllelo, for nccordlng to Mrs. Stemplangor's testimony ho was wielding a razor during the melee, while the coroner's nutopsy showed that the wound was Inflicted by a long, sharp-pointed and thlck-bladed knlf. very likely a round stiletto. Judge Edwards was satisfied that there was not enough evidence agal.ist the prisoner to warrant the case being submitted to n Jury, and, consequently, granted tho release as asked for by his attorney, John M. Harris. Beale Wants a New Trial. Application for n now trial for At torney George W. Rcale, convicted of embezzling 51,500 which ho held as ex excutor for Mrs. Esther Mend, was made yesterday by his attorney, John F. Scragg. In presenting his petition, Mr. Sragg took occasion to remark that the pros ecution savored of revenge. Inasmuch as the prosecutor had redress In the civil courts. Ho nlso referred to Mr. Kealo's standing In tho community and the great hardship that would en sue from the Imposition of sentene" under a conviction of embezzlement. Court refrained from granting a rule for a new trial until the papers' had been carefully examined nnd consid ered. Divorce for Mrs. Dennison. Judge Archbald yesterday granted a divorce to Mrs. Josephine M. Dennison from her alleged unfaithful husband, John J. Dennison, a former bartender at Hotel Jermyn. Tho evidence in the case tended to show Dennison to have been n very unfaithful husband.
