The trial of Powell retiuit, of this city, for perjury, before Judge It. W. Archbald, In cilminal court yesterday, developed one of tlioy exasperating holes In the law by which men fre quently escape the penalty that would follow their misdoings. In March, lftS, IVmtEt conducted a boarding house on Lloyd street In this city, and one oC his boanlers w.ts Alexander Smith. Tho latter was ar rested for some tiivinl offense and Potrust became his bondsman. Before the case was called tor trial Smith started for New Mexico and Potrust had a ball piece ii-sueil for him, but was unable to get It served before Smith started for the southwest. Smith could not be brought back from another state on n ball piece and 1'etrus.t decided to resoit to a. little scheme ho had thought out. He went to I'hlrf-of-Police Holding one dav and told him that Smith brolM into his room, forced upon a trunk, stole $300 from him and had fled to the southwest. The authorities nt Kansas City were connnunicati d with and Smith was nrrested as soon as he reached there en route for New Mex ico. SMITH HROUOHT HACK. Detective .lohn Molr was senn after Smith and In ought him back to this city. It then aipeaied that there was no truth In the chat go that Petrust lodged against him and the case was dismissed. The police department did notj tako kindly on being sent on such a wild goose chasp and Chief Holding had Petrust Indicted for perjury. After many delays the case was called yes terday for trial. Utorney C. W. Daw son, who appeared for Petrust, was not In the court room when the case was tulled for trial yesterday nfternoon. and Judge Archbald directed that the Jury be sworn nnd told District Attor ney Jones to proceed to open tho caso to the Jury. While this was being done Attorney Dawson appeared and entered a very vigorous protest ngalnst tho selecth n of ayjury In his absence. He was not pleased with the twelve men In the box and wanted the privilege of assist ing In selecting another Jury. Judge Archbald finally allowed an other Jury to be called and tho trial was proceeded with. The Common wealth put witnesses on the stand to show that Petrust had notified the police of the alleged theft and that he subsequently made an affidavit before District Attorney Jones, setting forth th. facts In the case. It was on thl.i affidavit that the requisition was granted. DAWSON OBJECTED. Sir. Dawson, when this affidavit was offered In evidence, objected to Its ad mission and after extended argument on the part of Sir. Dawson nnd Mr. Jones, court excluded it and directed a verdict of not guilty. It was ruled by the court that Pet rust could not be held for perjury for the reason that a perfon can be con victed of swearing falsely to an aill davlt only when such affidavit Is re quired by an act of assembly. There is no act of assembly which makes It necessary to have an a'TUlavlt to se cure lequlsltion papers. It Is merely a rule of the secretary of the Com monwealth's department at Harris burg. As Petrust hail not offended against a statute ho was allowed to go his way. The embezzlement case against At torney George Heale met with nn un usual obstacle yesterday. Mrs. Lu clnda Cook, an Important witness for the defense, was not present and an attachment was Issued for her. Pend ing her arrival the jury was stood aside and other cases taken up. The sheriff had not succeeded in bringing Sirs. Cook In up to the time that court adjourned. Norton, tho Penn avenue hotel keeper, and Mrs. Annie Deruy of Fianklln avenue, charged with unlawful relations, wai called, but the prosecutor, Thomas Norton, did not appear nnd the sheriff was dliected to bring him In. Ho la a son of SI. J. Norton, the defendant, and runs ,i saloan at Olyphant. Nor ton, the defendant. Is separated from his wife and boaids with Sirs Depuy, who Is srpaiated from her husband. Just before court adjourned for the day a 1ury was sworn in the case of William V. Fuller, of Carbondale, chniged with larceny and receiving. It will be tried today. This and That. The work of erecting tho new Oxford breaker was begun Wednesday. The new breaker will be about 200 feet to tho rear of the shaft, and the coal will be conveyed to It over a trestling. President Clark and General Slan ager Silllman, of the Scranton Hallway company, went over the new extension to Lackawanna yesterday, and were well pleased with the improvements made on that line. George A. Hayes, of Harrison ave nue, yesterday signed a contract with Harris Hros.. of Cleveland. Ohio, to tear down twenty old locomotives belong ing to the Delaware, Lackawanna and Western impany, which the latter firm has purchased. The work will be done In the yards and will be com menced at once. When tho locomotives are taken apart the material will bo shipped to Cleveland. The wholesale raids made Wednes day night bore fruit In yestorday'H police court. Alderman Kasson con ducted the hearings, tho wurrants having been Issued by him. Of the five houses raided only three of the proprietresses weie captured. They are Mrs. Lottie Smith, of 107, AnnU Gllmartln, of 32. nnd Mrs. Elizabeth Jones, of 2.50 Lackawanna avenue. Thoy were each taxed $25 nnd nil the other women aim men arrested were fined $2S apiece. Twenty-two women In all were lined and ten men. The total amount of fines was $250. The aldermen then retired from the bench and the mayor disposed of the police cases. Thero were un extraor dinarily large number of these, . num ber of arrests being nir after the raids were over. Among others Lillian Davenport, "Georgle" Williams, Car rie Johnson, May Thomas and Annie Mack were fined, each of these paying $5.
