On August 14, U")7, the 3-year-old Bon
nf the plaintiffs was so badly Injured
by one of the cais of the defendant
rnmpnny that he died In the Laeka
vnnnu hospital n few liours later.
It Is undisputed that the boy was
crossing Penn avenue near bis home
and that an Inw.nd bound Providence

along the tuck fiom Mulbeny to Lin
den streets. The boy bad crossed the
track in safety when be collided with
n bicycle ridden by Simon AVaid. Thl

The witnesses who testified for the
plaintiff were Simon "Ward, the man
who lode the bicycle; A. I How by,
Michael Denier, father of child; Hairy
Dorshlmer, Dr. Pclnberg, M. It. Con
htant, Fredeiick Phlnney and Saiah
Denier, mother of the child.
Mr. Ward testified that bo ciossed
the car tiack in fiont of the car to
aold a wagon which blocked the load
way. Just after he eiosscd the rails
be struck a little boy and knocked
him down He was thrown from his
wheel and before lie could get on ills
feet and pick up the child, the car bad
lun him down.
Mrs. Denier said the child was In
barge of a boy named Kit-man when
the accident occurred. After the
plaintiffs rested, the delense asked for
a compulsory non-suit, on the ground
that no evidence bad been ptoduted
to slinw that the defendant company
wns u. sponsible for the accident.

suit was lefused by Judge (Junster
and the c.iso for the defense was
opened. Hnotli T:ans, who li.id chat go
of the car on the day of the accident,

when the child was knocked down by

the car. He ieersed the power and
brought it lo a standstill as soon as
possible. When Mr. Jl vans' cross-examination

injuieel by the defendants. The juiy
returned in the afternoon. In the
meantime, another case had been called
and put on trial. The Kllleen c.T-e will
begin as soon as the foimer goes to the
Juiy.
When the Kllleen jury went to Car

the case of Mathilda Faihlg, admlnls

Walsh, who Is contesting W H.
Thomas for the office of constable of
the Klghth ward, was filed with Clerk
of the Courts Daniels yesterday. He

suspects of having voted for Thomas
on evory possible ground. Altogether,
801 votes are challenged. That Is a
much laigcr number of votes than Sir.
Thomas received altogether, but many
of the votes aie challenged for moro
than one cause,

The new No. 3 school building, the
most recent acquisition to the many
handsome schools In the city, situated
on Plttston avenue, corner of Hickory
street, was given a thorough Inspection
by seveial school controlleis nnd others
who flgute In that portion of the city's
goernnient.
Contractor M. J. Ttuddy, who erect
ed the building, and Atchltcct John A
Duckworth, who deslgnal It, guided
the Inspectors through the school. Con
trollers Peter Neuls, of the Hleentb
waid, where the building Is loeated,

In Storrs' hall, Monday night, a new
lodge of the Knights of Honor will be
oiganlzed. William J. Hoblnson, of
Hrle, grand reporter of the national
order, has been In the city several days
and has enrolled a luge number of the
leading men of this side. Hon II. W.
Allison, of Allentown, grand dictator of
the order, will bo present at the organ
ization. Dr. Albei t Kolb, of Cedar ave
nue', bas been engaged as medical ex
aminer. Mayor Molr, who is a mem
ber of the older, will be present and
give an address. A social session will
follow.
County Commissioner John Deniuth,
Alderman Lentes, Fied. Klichhoff and
James F. Best, of this side, and Geoige
K. KhchholT, of New Voik city, will
spend today at Lake Ariel on a fishing
trip.
