The boy bad crossed the track in safety when be collided with n bicycle ridden by Simon AVaid. Con htant, Fredeiick Phlnney and Saiah Denier, mother of the child. Mr. Ward testified that bo ciossed the car tiack in fiont of the car to aold a wagon which blocked the load way. Just after he eiosscd the rails be struck a little boy and knocked him down He was thrown from his wheel and before lie could get on ills feet and pick up the child, the car bad lun him down. Mrs. Denier said the child was In barge of a boy named Kit-man when the accident occurred. After the plaintiffs rested, the delense asked for a compulsory non-suit, on the ground that no evidence bad been ptoduted to slinw that the defendant company wns u. sponsible for the accident.
