Section 10. It shall be unlawful f ni nny street iar to run upon or across uny street of the llorough, at a greater rate of speed than live miles per hour. Section 1U. it snan no uniaiui obstruct nnv stieet crossing within the limits of. tho Borough, by locomotives or cars standing upon any railroad track, for more than five consecutive minutes, or for any locomotive to stand upon or near any such crossing, so that the escape of steam therefrom mu cause fright to horses or teams stand ing or passing along or upon tho stieets of the borough. Section 17. If nny person, agent, 01 employe of any company shall violate anv of the foregoing ordinances, he shall, upon conviction, pay a line or not less than live dollars nor more than iltty dollars and costs for encli offense. TITLE VI. Offenses Against Public Policy, Econ omy and Health. Section 1. The High Constable and the policemen of the borough shall cause all putild or offensive substanc es, the heads ami hides of slaughtered animals, between the first day of June und the first dny of October of men year, and nil nuisances endangering tho public health and comfort, to be removed, and if the owners or occu pants of r-ny premises about which any nuisance may be found, shall, after due notice thereof, by nny Jn'ough olh cer, neglect or refuse to remove the sane Immediately, the person so or fending shall, for each offense, pav a line not exceeding ten dollars and ousts. Section 2. It shall be unlawful for any person to ca-t or deposit any kitchen offal or nnv othr offal into anv street or alley, or upon any side walk or pavement, or throw or depos it any ashes, decayed vegetable' mat ter, or nny unheclthful or offensive animal substances or filthy material, or matter, or thing whatsoever upon the said streets, or sidewalks, or al Icvs, so as to deprive the citizens of tho Borough of the free and full en joyment of the same. Anv person or persons so offending shall, upon con viction thereof, forfeit and pay a Iln- not exceeding ten dollars and costs, and In addition shall pav tho costs of lt removal. (Note correction.) Section 3. It shall be unlawful for any person to erect a slaughter pen or house, or carry on the business of" slaughtering within said Borough, or shall deposit any dead horses or car cass of any dead animal, excrement or filth from vaults, privies or pig pens, within said borough, and shall leave such carcass, carrion, or filth without burying the same at least four feet under ground, or shall bury tho same on or near any street or alley within the said "Borough. Every such person so offending shall, upon conviction, for each and every offense, pay a fine not exceeding twenty dollars and costs. Section 4. It shall be unlawful for nny person or persons to erect or main tain, or cause to be erected or main tained, within the limits of the said Borough, any urinal or privy, tho over flow from which shall How In or upon any street, sldawalk n- alley. Any per son ma'ntalnlng,or c using to be main tained anv such nuisance, after having received clue notice to abate the same, shall, upon conviction thereof, pay a fine not exceeding twenty-live dellats and costs for each week that said nuisance shall bo and remain unabated. Section fi. It shall be unlawful for nny person to expose for sale, within the limits of the said P.orough, the flesh of anv diseased animal, or the fleh of nny calf under four weeks edd, or unwholesome and unmarketable meat, fish, fruit, vegetables, provisions, or milk. Kvery person so offending shall, upon conviction, forfeit tho same and pay a line not exceeding thirty dollais and costs. (Note correction.) Section ft. It shall be unlawful for owners and occupants of property, to permit the limbs, broken tops, or branches of trees to grow or remain so near the ground a3 to obstruct In any manner free passage on the streets or sidew&lks. The Street Commission er, or other person duly authorized by th Council, shall cut away and re move such obstructions; the- expense thereof to be paid by said owners or occupants. Section 7. It shall bo unlawful for nny person or persons to erect or cause to be erected upon any public thoroughfare in said Borough, any barbed wire fence or any Iron fence having sharp-pointed or urrow-poluted pickets, or to placa; or cause to bo placed upon tho top of any fence or railing uny sharp spikes or nails so as to endanger tho life or limb of persons or anluals passing nlong such thor oughfare. Any person or persons vio lating any of the provisions of this ordinance shall, upon conviction, pay a fine not exceeding fifty dollars and costs for each offense, and shall forth with removo such fence or ratling; and, upon failure to remove such fenco or ratling, the High Constable shall cause It to bo removed, and tho ex pense of such removal shall be col lected from the owner of the propetty. Section 8. The head of every family or boarding house In which a case of contagious or infectious disease exists, shall fasten and maintain upon their front door or other conspicuous place, a yellow cloth' or paper, not less than twelve Inches square. Any person vio lating this ordinance shall, upon con viction, pay a flno not exceeding ten dollars. Section 0. No public funeral of nnv person who has died from any con tagious or Infectious disease, shall lm held In this Borough. Tho corpse In such caso shall be nl.iced In an air tight coflln. or otherwise prepared for burial, with such precautions us tho Health Officer may direct, and shall bo rcmov?d from tho placo of his or her death for burial between the hours of ten o'clock p. in. and live o'clock n. m. Any person violating this ordl ninco shall, upon conviction, forfeit nnd pay for tho use of the Borough the sum of twenty-five dollars and costs. Section 10. The proprietors of all ho. tels and restaurants within the mild Borough, shall cinso their bars from midnight on Saturday to midnight of Sunday in each week, ard no sale, of Honor shall bo allowed therein during said Interval, And any person violat ing the ordlnanco shall, upon convlc tl'm, poy'a fine of not less than twenty five dollars; ten dollars of which shall go (o the Informer, and tho balance ' to tho uso of tho Borough. Section 11. Tho proprietors of all ho tels anj restaurants within tho Bor ough, shall, Immediately upon nn alarm of flro "being given, Imvo their bars closed and no snle3 or drinking of Minor shall he allowed thoroln until nfter tho flro Is extinguished. It shall be unlawful for any person or persons to sell or nlvo any Intoxicating Illinois to uny minor. Any person violating this ordlnanco shall, upon conviction, pay a line not exceeding twenty-flvo dollars and costs for each offense. (Nolo correction.) TITLE VII. Offenses Against Ileal Property, and Malicious Mischief. Section 1. It shall bo unlawful for any person to wantonly mutilate, fell, or otherwise Injure or destroy uny shade, ornamental or fruit tiees or shrubbery, growing on private prop erty or along tho public stieets find sidewalks within tho Borough limits. And any person so offending shall, up on conviction, pay n line not exceeding twenty-live dollars nnd costs. (Note correction. Section 2. It shall bo unlawful for any person or persons to wantonly In jure or tear down nny sign, door, win dow, or other icnl propetty, or shall wantonly or maliciously open or close any sttect water hydrant or any street sewer, or shall throw stones or oth.-r missiles within the populated portions of the Borough, thereby Injuring nny person or property. Any person so of fending shall, upon conviction, pav n line not exceeding twenty-five dollars nnd' costs. (Note coneetlon.) Section ". It shall be unlawful for anv person or persona to wantonlv or maliciously injure the Bororgh pound or nny other buildings belonging to tho said Borough, or anv fence or any other public Improvements therein, or shall tnko any animal from the pound without the consent of the Burgess or hi? deputy. The person or persons so offending, shall, upon conviction, for feit and pay a sum not exceeding twenty dollars and costs. Provided. that tli penalty hereby affixed shall not be a bar to a civil action In tho courts of this Commonwealth for dam ages done to the property of the Bor ough. (Note correction.) Section 1. It shall be unlawful for nny person or peiors to dig any ditch or trench, or make my excavations whatever on the public streets and al leys of this Moroush. without written permission from the council, nnd In nil cases the said person or persons or corporation shall 1111 up said ditch, trench, or other excavation and thor oughly stamp the earth therein and leave the stieet or alley in ns good condition ns It was at the time of granting said permission. Anv person or persons, or corporation thus violat ing the provisions of this ordlnanco shall, upon conviction, forfeit nnd pay a flno not exceeding two hundred dol lars and costs for each offense, and shall Immediately fill np tho exeav tlon, or pav th'e cost of filling up the same by order of tho council. title vni. Offenses Against Public Morals and Decency. Section .1. it shall bo unlawful for anv person to publicly uso any Inde cent, profane c.r obscene language, or be guilty of Indecently exposing his or her person, or making rude or wanton postuies or gestures within the pres ence or hearing of nnv person or per sons passing along the streets, or offer ing to sell or dispose of any obscene becks, papers or pictures. Such per son or persons so offending" shall be arrested by any policeman upon his view, without warrant, .and upon con viction shall pay a flno not exceeding fifty dollars and oots. (Correction.) Section ';. It shail b; unlawful lor any persons to encage In games of chance or rambling for money or other vaulables within the limits of said Borough". Any person or persons con victed of violating this ordinance or enticing or soliciting others to violate the same shall forfeit and pay a fine' or not liss thnn ten dollars and costn for the Ilrst offense, and not less than twenty dollars and costs far tl(t sec ond and any rfuhsequenl offense. It shall be unlawful for any person or persons to engage In thc keeping of houses of assignation or prostitution within said Borough, and any person found In such a house or In the streets, alleys or commons, or oth er places, engaged in the business of prostitution, shall, up m conviction, forfeit and pay a (ln for each offense of not less than ten dollar.i and cost. It shnll be unlawful for the owner or ngent of any promises, within the said Borough, to rent or al low the same to bo used for tho nur po.ses of assignation and prostitution. It shall b" unlawful for any person to keen and maintain a common, Ill-governed, nnd disorderly house or place, to the encouragement of Idleness, rambling, drinking, or other misbehavior, to tho common nuisance and disturbance of the r.elgh bcuhood or orderly elthieni. It shall b unlawful for any person or persons to Incite) or en courage dog fighting, cock fighting, or prize lighting within the liorough lim its. Tho Chief of Police shall bo nn elector of the said Borough, over twenty-five yenrs of age. and shall sub scribe to the oath of office-. Ho shell recommend to the Town Council, nib Ject to their approval, n sufficient num ber of assistants who shall subscribe to tho following oath of office: ' do solemnly swear (or nl'lrm) that I will support the Consti tution of the United States and tho Constitution of this Commonwealth, nnd that I will discharge tho duties of my offlco with fidelity; that 1 have not paid or contributed, or promisee1, to pay or contribute, eiiher directly or l.i directly, any money or other valuable thing, to procuro my appointment, ex cept for necessary or proper expenses, expressly authorized by law; that I have not knowingly violated nny elec tion law of this Commonwealth or pro cured It to be done by others in my behalf; thnt I will not knowingly re ceive, directly or Indirectly, any money or other valuable thereat, for tho per formance or non-performance of any act or duty pertaining to my office, other than the compensations ullowccl by law. Section 2. All policemen shall be re quired to wear pome suitable and uni form badge, dress, cap or some, other Insignia of office, "by which they may ho known and rceognlzod. Section 4. Tho Chief of Police Bhnll sce that nil the regular police attend to their duties faithfully, execute all the ordinances nnd use their best en deavor to preservo peace and quietness In the Borough; and whatever occa sion requires, to detail a npen.lal police f aid him nnd them to suppress riots and rows and to cnll to h'ls assistance any or nil of tho citizens of the said Borough to aid him In quieting disturb ances and making arrests; and each and every policeman neglecting or re fusing to go with nnd assist tho Chief of Police in quieting disturbances or In t 'iiUlng arrests shall, on conviction, frrfelt and pay n line not exceeding twenty-five dollars ami costs for each and every neglect or refusal, Section 3. If any policeman shall bo found drunk or intoxicated, or loafing ti round or In any of tho hotels or res taurants iho council, upon proof shown, shall dismiss said policeman from the police service. Section 6. Each' and every person oli'cilng any resistance to, or In any wise Interfering with the policemen of the Borough In making arrests, or In the discharge of nny other duty shall, upon conviction, forfeit and pay a line not exceeding twenty dollars for tho llit offense, und not exceeding thirty dollars for each nnd every subsequent offense. And every person striking or otberwls" offering violence to any offi cer or his assistants when attempting to discharge th'clr duty shall, upon "Corvictlon, forfeit and pay a fine not x coning twenty-Jive dollars and costs for each offense. Sec ion 7. Kvery citizen of the Bor ough shall, when called upon by tho borcuiTli officers, assist the police and High Constable In the preservation of the public erdor and the prevention of all assaults, riots, tumults or dis turbances, and each and every citizen ri fusing cr neglecting to go with and assist the Chief of Police In quieting disturbances or In making arrests shall, upon conviction, forfeit and pay a flno not exceeding twenty-live dollars and costs for each and every neglect or lof'tisal. Section S. If any policeman of Mils Borough shall wilfully neglect or re fuse to exec ute the borough ordinances, or shall neglect or refuse to servo any writ, order, or notice Issued by the Burgess or Council In pursuances of the ordinances, ho shall, upon proof to tho Council, be dismissed fiom the pedice service. Section !'. Whenever nn arrest shall have been made by the police or High tVnstabl", or by th'elr authority and dlrcftion, the fcrson or persons so ur-re--ted shall be by them taken before tl.e Uurgess for hearing and examina tion, at as early a time as practicable: Piovlclt'l, If the person or persons so arrested are drunk or Intoxicated, or 'uch urrests shall have been made in Hie nlt'ht time, or for any other cause or reason, an Immediate trial of the c.'se Is deemed Inexpedient, such per son or parsons shall be conveyed or taken to the lockup of the borough, and os soon thereafter as practicable a rcpoit hereof made to the Uurgess, who shall fix as early a time as Is expedient when they shall bo brought before him for homing; and after said hearing or tiii'. said officer or officers in charge, shall obey such directions in th'e matter us the Burgess may make. Section 10. After an officer shall have made an arrest, the person or persors so arrested shall remain under the charge of said officer, subject nt all times to the direction of the Burgess, but no officer shall release such per son or persons so arrested, unless by direction of the Burgess: and in no event shall such officer receive or cause to ie received from any one arrestee', or from any one In their behalf, eith er directly or indirectly, nny money, premise or other consideration whatso ever whereby the person or persons ar rested may c-vnde a hearing or escape from his custody. Any officer violating this oidlnance shall upon conviction, be forthwith dismissed from the service and pay a fine not exceeding fifty dol lars and costs. Section 11. All police men np hereby required at the ter mination of their services to return all police equipments to the Burgess. Section 12. No person not a regular ly appointed policeman shall be per mit wcl to wear or carry any star, badge, or police equipment, nor shall any person other than an officer, be permitted to retain in their possession anv such equipment belonging to tho boiough. The police are hereby di rected to forthwith arrest any one vio lating this ordinance, and upon con vlcthm thoy shall deliver up all such equipments or property, and pay a line not exceeding five dollars and costs. TITLE X. Section 13. All members of the Town Coun.il of the said Borough shall he pollceinon of tho said Borough ex offlflo. Pavements, Grading, Sewers, etc. Section 1. Tho Town Council shall designate from time to time the streets, alloys ar.d places where new pave ments, gradlngs, sewers or ditches are necessary, and the kind, manner and material thereof, and give written or pilnted notice thereof to such owners or occupants of property, requiring them to cause the same to lAmade or elono within sixty days aftersald no tice, .or be charged twenty per cent, additional ns provided by Act of As sembly. Where It Is necessary to have flitches or sewers paved with cobble stoneg the owners of the property are required to dig the trenches or grade to the proper level and deliver on the ground the- requisite stone and sand, and tin; borough will then complete the w-orl; nt her own charge. Section 2. Tho owners or occupants t nil Unproved property shall, within twenty-four hours after a fall or de posit of snow or sleet, remove the same from their respective pavements nnd gutters, nnd upon neglect or refusal to do sj, they shall, upon conviction, pay a line not exceeding one dollar for each offense. Section 3. Tt shall be unlawful to ride, drive, or lead cows, horses or mules along and upon any sidewalk within the borough nnd any person convicted of said offense shall pay a line not exceeding threo dollars nnd costs. Section 4. It shall be unlawful for any prson to ride any bicycle or other vehicle upen any sidewalk lu this n0r ovcii, and any person convicted of tmlcl offense shall pay a fine not exceeding ten dollars and costs for each offense. Section 5. It shall be unlawful to obstruct the public crossing or foot walks ncioss the streets, with wagons, carriages, horses, or mules: and per sons guilty of the same shall, upon conviction, pay n flue not exceeding two dollars and costs for each offense Section 0. It shall be unlawful to throw or deposit any ashes, oyster or clam shells, rubbish, dirt or other filth or obstruction whatsoever, upon any sidewalk, street, ditch, or gutter, whether paved or unpaved, within tho Boroutrh, unless authorized by the Council or Street Commissioner In the repair of streets, etc., and It shall be the duty of ovcry ownor nnd occupant of property to keep the said ditches and sowers In front of the same open nnd clean at nil times; ahd any person causing such obstruction or neglecting or rofurlng tu keep Bald ditches and sewers open nnd clean, shall, upon ORDINANCES. conviction, pay a fine not exceeding five dollars and costs for ench offense. Section 7. It shall bo unlawful to erect nnv step or steps or construct any open cellar ways with or without railings, or bulk or projecting win dows or buildings of any kind any where within tho proscribed limits of any pnvements, sidewalks, street or alley, nnd all persons convicted of the same shall pay n flno not exceeding lvo dollars, with costs, and said nuis ance shall be Immediately abated. Section S. All owners and occupants of property shall preserve and keep In repair and proper condition, the pave ments nnd sidewalks and curbing In front of their respective premises after tho same shall have been completed. Section 9. Tho High Constable shall Inspect the pavements or walks In the borough, and when said pavements or walks aro found defective or In need of repair, shall notify the owners or occu pants or tho property on which pave ments or walks respectively front, to remove such defects or repair the same forthwith; he shall make a memoran dum of the date of said notice nnd tho necessary particulars thereof, and If, after twentv-four hours have elapsed from tho tlmo of tho giving of said notice, such defects have not been re moved or repairs made, ho shnll make the same or cause the same to bo made, and the expense of the same shnll'bo collected from the owner or occupant of the property aforesaid, and said owner shall bo held responsible for nny and all damages and costs that may be caused to the borough by reason of said defectlvo pavements or sidewalks. Section 10. The High Constable shall make a report monthly to tho Burgess und Town Council of tho general con ditions of the pavements and side walks throughout the borough, the re pairs which have been made under his direction and the repairs yet required, and may receive for his services as the Town Council may from tlmo to tlmo determine. TITLE NI. Dogs. Section 1. No dog or bltctl shall be permitted to run at largo within the limits of tho borough at any time with out a strap or collar around Its neck with tho owners' name thereon In plain letters, and from the 23th day of June to the 25th clay of September of each year without wearing a suitable wire muzzle. Section 2. No bitch shall be per mitted to run at largo within tho lim its of the borough, except as herein before provided, nnd the High Con stable and the policemen of the bor ough shall take Into custody and con vey to tho pound all clogs and bitches so found running at large in violation of these ordinances; nnd If such dog or bitch be not redeemed by the owner or owners thereof within twenty-four hours thereafter, by paying the sum of two dollars to the person taking the same into custody, the High Constable or policeman shall kill and bury the said dog or bitch, for which .sen Ice he shall receive the sum of one dollar. Section ". Every person or poisons within the boiough owning or keeping a dog. dogs, or bitch, shall be taxed in the following manner: For one dog, one dollar; for each and everv dog above that number, two dollars; for every bitch, two dollars; said taxes to be collected In like manner ns other taxes are recovered by law for tho use of the borough. And all taxes col lected under this ordinance may be ap propriated for the support and main tenance of any public library that may be established In this borough, accord ing to the Act of Assembly approved the 23rd clay of .May, A. D. 1SS7. Section 4. Every dog or bitch run ning at large within the limits of the borough from the 20th day of Juno to the 20th day of September In each and every year, shall have a good, strong, substantial muzzle, made of wire or leather, enclosing the whole mouth so as to effectually prevent them from biting or .snapping; and It is hereby made the duty of the High Constable or any regular policeman to forthwith kill all clogs and bitches found run ning at large contrary to the provis ions of this section, and to bury or cause them to be buried nt the expense of the owner or harborer, and In case no owner or harborer can be found, then the Borough to pay the actual necessary expense for so doing, not to exceed In nnv case one dollar. Section 2. The High Constable shalt have the custody of all animals so taken and confined, and shall take all needful care of them when so con fined, and shall keep a pioper register setting forth the description, time of detention, and release, and in case of sale thereof, of tho price received and the name of the purchaser. Section 3. Tho High Constable shall within forty-eight hours after tho seiz ure and detention of any animal as aforesaid, the same not having been redeemed by the owner, advertise the same by posting not less than five printed or written hand bills, one on or near the entrance to the pound, and the rest in public and conspicuous places throughout the Borough, fully describing the animal or animals, and fixing a dav and hour, not less than live clays thereafter, for the public sale thereof. Section 1. In enso no owner shall appear on or before the time fixed for the salo.or pay or caused to be paid the necessary expenses oPKcopIng the .same and the legal fees of the High Constable for the selzute and detention of said animal or animals, shall he sold and delivered to tho purchaser thereof, and the High Constable shall first de duct, out df tho price received, all law ful charges and expenses, and pay over cue uaianco to tne Treasurer of the Borough. TITLE XIII. Amusements. Section 1. Any person of persons holding or attempting to hold nny pub lic exhibition In the Borough, without llrbt procuring a license therefor, shall bo arrested and brought before the Burgess, nnd on conviction thereof shnll forfeit and pay a fine not ex ceeding llfty dollars nnd costs. Pro. vlded, If In the opinion of tho Burgess, any public exhibition shnll be for the advancement of any literary, moral or religious cause, or for any worthy cause or purpose, he may in his dis cretion, waive or remit all fees, as here in required, Section 2. All gift enterprises or lot teries, or traveling auction, or travel ing merchants, selling or vending their goods or wares within tho limits of the Borough In a rented room, pv place, or upon tho street, by day or night, shall pay to tho Burgess a sum not less than two nor more than ten dollars for each day or night so held, nnd any person or persons who shall sell or attempt to sell ns aforesaid, without first procur ing sild licenses, shall be arrested and brought before the Burgess, and on conviction thereof shnll forfeit and pay a line of not less than five nor exceed ing fifty dollars nnd costs. Provided, that no license granted for any sale or auction as aforesaid, shall bo con strued to confer uny right or privilege therefor contrary to the provisions of any Act of Assembly. TITLE XIV. Establishment of a Flro Department and tho Election and Duties of tho Chlof of the Flro Department. Section 1. From and after tho pass ago of this ordinance, a tiro depart ment shall be and is hereby estab lished In and for tho Borough of Tay lor. Section 2. All members of duly or ganized lire companies within said ORDINANCES. Borough, shall bo members of said department and have one vote In all matters appertaining to tho said de partment. Section 3. Said department, bo or ganized as aforesaid, shall havo power to elect such officers and tnnke consti tution and laws as they may deem ex pedient for the government of said department. Provided, that said con stitution and laws shall be approved by tho Borough Council. Section 4. Neither the said fire de partment nor any of Its officers or agents shall have power to pledge the credit of tho Borough In any way with out tho written consent of the Borough Council. Section ". Tho Chlof Engineer of tho Flro Department, shall bo appointed by tho Uorough Council at tho llrst stnted meeting In Mnrch of each year, and after subscribing to the oath of office, shall recommend to the council two nsslstants who shall bo designated ns first and second assistants respect ively. Section C. The Chief Knglncer shall li'.tvo the control und management of the Tiro Department ut all fires when piesont, and direct at such fires the efforts and labors and prescribe tho duties of the assistant engineers, fire men, citizens, and all other persons present. And In his absence or when a vacancy occurs In tho office of Chief Engineer, tho first assistant engineer shall perform these duties nnd possess all the powcis. of the Chief Engineer; and In ense the Ch'lef nnd first assist ant shall be absent, or a vacancy shall have occurred, then tho second assist ant engineer shall perform these du ties nnd possess such powers. Section 7. The Chief Engineer shall have supervision over all engines, car riages, hose, and hydrants within the Porough, and see that they are always ready for service; and shall have ac cess to and examine the entire appar atus after each fire, and he shall at least once a month, make a report to the Borough Council of the condition thereof and recommend such altera tions nnd Improvements In the fire de partment nnd apparatus as ho may deem proper and necessary. lie shall also report the names of such firemen, If any, who may have disobeyed his oft'clal ordern and neglected and re fused to do their dutv, and shall at the same time report the origin and lo cation of each fire which shall have occurred, as far as ho may be able, and the amount of loss and Insurance, If anv, upon tho premises; also tho name and occupation of each officer and fire man under his charge. TITLE XV. Poles and Wires. Section 1. The High Constable shall Inspect all poles used to carry wires erected upon the thoroughfares or pub lie grounds of tho Borough by any person or corporation, and the High Constable aided by the police under his charge, shall see that the said polos and wires aro kept in a safe and good condition; nnd If tho High Con stable or police shall find nny defects In th'e condition of the said poles or wires, ho or tre-v shall report the same to the Burgess forthwith. Sec tlon 2. The Burgess on receiving notice of any defect tu tho condition of the rlectrie- wires or poles within the limits of the borough, shall notify the owner or manager of the corporation or person owning the said wires or polos, to repair th'e same Immediately and put them In a safe and trustwor thy condition, and If the said owner or manager of the corpsratlon or per son owning the said wires or poles fall to do so with the despatch which the case may require, tho Burgess shall Instruct the High Constable to remove the danger. If any exists, by reason of any defective wires or poles, nnd the cost of such removal shall be defrayed by the person or corporation owning such poles or wires. Section 3. Uvery telephone, tele graph, electric and electric railway company, erecting or maintaining poles or wires within the Borough lim its shall pay an annual license fee of one dollar for ench pole and two nnd one-half dollars for each inilo of wire so erected or maintained; said license feo to be pnld on or about the first Monday in April of each year. TITLE XVI. Board of Health. Section 1. There shall be established, appointed and organized, In said Bor ough, a Board of Health, which shall consist of Cve persons, not members of the Council, and for this purpose said Borough shall bo divided Into live districts described ns follows: The Fiist district shall be composed of all that portion of said Borough ly ing east of the Kelsor Creek. The Second district shall be bounded as follows: On the north by the north erly Borough lines; on the south by Depot street, as far west as th'e Taylor mines, thence along a line, continuing In the same direction, ns far west as the westerly Borough line; on the east by the Kelser Creek, and on the west by the westerly boundary of the Bor ough. The Third district shall be bounded on the north by lepot street, as far west as tho Taylor mines; thence along a line continuing In the same direc tion, as far west as the westerly Bor ough line; south by Union street, on a lino running from Schultz's lane to the Lackawanna river: east by the Lack awanna river, and west by tho west erly boundaries of the said Borough. The Fourth district Bhall bo bound ed on the north by the aforesaid line running through Union street from Schultz's lano to the Lackawanna river; on the south by a line running through Grove street from Schultz's lano to the Lackawanna, river; on tho east by the Lackawanna river, nnd on the west by Schultz's lane. The Fifth district shall be bounded on tho north by a line running through Grove street, from Schultz's lano to the Lackawanna river; Eouth by a line running through Sibley street (the soutneriy uounciary or the Borough) from Schultz's lane to the Lackawan na river: on the east by the Lacka wanna river, and on the west by Schultz's lane. Section 2. The President of the Bor ough Council shall nominate and ap point, by and with the consent of the Council, a Board of Health consisting oi nve memoers, one or whom shall tie a reputable phjslclan of not less than two years standing In the practice of his profession, whose terms of office shall be as follows: One person to serve for one year; one person to servo for two years; one person to serve for threo years; one "person to serve for four years; one person to servo for five years, And annually hereafter, the President of said Borough Council shall nominate one person whose term of office shall bo five years, so as to keep up the continuity of said board. Section S. The secretary of the coun cil shall forthwith, nfter the passage of this ordinance, serve written notice on said persons of their appointment. If they accept the duties of their ap pointment, they shall proceed .within ten days from such notification, to or ganize by electing ono of their number President, but they shall first tako and subscribe the oath' prescribed for Bor ough officers. And thereafter they shall organize annually. Section 4. They shall elect a Secre tary, whoso salary shall be fixed by the Board. He shall also take and subscribe to tho oath required of mem hers of the Board. lo shall keep tho minutes of their proceedings, and per form such other duties as may he di rected by tho Board. The President and Secretary shall have full power to administer oaths or affirmation In any proceedings or investigation touching the regulations of tho Board, bu. shall ORDINANCES. not be entitled to receive any fees therefor. The Secretary shnll hold hla office during tho pleasure of the Board. Section 6. They shall appoint a health officer, who shall hold his office during the pleasure of tho Board. His salary shall be fixed by a resolution of the Board. His duties shall be to exe cute tho ordcra of tho Board, and for that purpose he shall have and exercise the powers nnd authority of a police man of tho Borough, He shall give a Judgment bond to the Borough In the sum of five hundred dollars, conditioned for the faithful performance of his duties according to law. He shall tako nnd subscribe the oath of office re quired of tho members of the Board. Section 0. All fees which shall bo col lected or received by the Board or any officer thereof In his official capacity, shall be paid over into the Borough treasury monthly, together with all penalties which shall bo recovered by the Board for the violation of any regulations of tho Board. Section 7. Tho duties, resnonslbll- Itles, powers nnd prerogatives of said Board shall be identical with those assigned to Boards of Health of cities of the third class, by sections three, four, five, six and seven of Article XI. of the Act of May 23rd, A. D. 1889, en titled "An Act providing for the In corporation and government of cities of tho third class," due allowance be ing made for tho difference In the municipal government of cities nnd boroughs, also ns set forth In the Act of Assembly under which this Board ot Health Is appointed. Section S. The said Board of Health shall have the cower to create and maintain a complete and accurate sys tem of tho registration of all marriages, births, and deaths which may occur within the Borough, and to compel compliance of the same upon the part of all physicians, medical practitioners, clergymen, magistrates, undertakers, sextons, and nil other persons from whom information for such purposes may properly be required. Section 9. The Board shall make and caused to be published, all necessary rules and regulations for carrying Into effect the powers nnd functions with which they are Invested, which rules nnd regulations, when approved by the Borough Council and Burgess, and when advertised In the same manner as other ordinances, shnll have the force of ordinances of tho Borough; and all penalties for the violation there of, ns well as expenses necessarily in curred In carrying the same Into effect, shall be recoverable for the use of the Borough In the same manner as pen alties for the violation of Borough or dinances, BUbJect to the like limita tions ns to the amount thereof. Section 10. Tho Board of Health shall submit annually to the Council, before the end of tho fiscal year, an estimate of the probable receipts and expenditures of the Board during the ensuing year, and the Council shall then proceed to make such appropria tions therefor as they shall deem nec essary. And the said Board shall, In the month of January of each year, submit a report In writing to the Coun cil, of Its operations for the preceding year, with tho necessary statistics thereof, together with such Informa tion or suggestions relative to the sani tary condition and requirements of the Borough, as they may deem necessary. Section 11. It shall be the duty of all physicians practicing within the Borough to report, within twelve hours, In tho manner directed by the Board, to tho Secretary of the Board of Health, the names and residences of all persons coming under their profes sional care, afflicted with any conta gious or infectious diseases. Section 12. It shall also be the duty of the Board to communicate to the State Board of Health, at least an nually, notice of Its organization and membership, copies of all its reports and publications, together with such sanitary Information as may be from time to time required by tho State Board. TITLE XVII. Fees and Costs. Section 1. All fines and penalties for the violation of any of the ordinances of the Borough Council, when recov ered, shall Inure to the use of the Bor ough, except In those cases where It may be otherwise specially provided by the ordinances; and the Imposition of a line In any ordinance shall also Impose tho costs of the officers enforc ing and vindicating the ordinance. It having been, and it Is hereby declared to be the true meaning and intent of the Burgess and Town Council in en acting and ordaining ordinances, rules and regulations, to Impose costs in all cases of violation ilnd conviction. Section 2. Thei-Burgess shall In all cases of arrests by public officers, and conviction before him, demand, receive and pay over to 'such officer or officers making arrests their proper fees for said services. The fees to be charged and collected by said Burgess shall be as follows: All cases on complaint tried before him, for each person and case. ..$1.23 All other cases tried before him, no matter how brought, for each person 1.00 Each of the police making the ar rest shall be allowed for each person arrested 1.00 Each witness In each case 2.1 Officer for btlnglng up from lock up 1.00 Officer for euch person remanded after conviction 1.00 Serving notice of nuisance 23 All other fees of Burgess shall bo the same as allowed in the general fee bill tc Justices of the Peace and Al dermen for like services. All other fees of policemen or tho High Constable shnll be the same as allowed by law to constables for sim ilar service. No fees to be paid to anv policeman by the Borough, but they shall be compensated, In all cases by arrests made, from tho parties themselves, unless otherwise directed by the council. I'OUND FEES. The High Constable shall be allowed to receive poundage fees as follows: Taking into custody any horse, mare, or muse, each $1.00 Taking into custody cattle or cows, each 50 Taking Into custody swire, sheep or goats, each , no Taking Into custody geese, each... .10 Taking Inventory, each Item 01 Levy nnd sale, for each dollar. above thirty dollars 03 Levy and sale, for each dollar not exceeding thirty dollars 04 Advertising anything 23 TITLE XVIII. Licenses and Fees Section 1. That hereafter It shall bo unlawful for any person, Arm, associa tion or corporation, or any agents thereof to hawk and peddle any goods, wares, merchandise, provisions, or other articles, except of their own pro duction, without first procuring a li cense for that purpose from the Bur gess, and paying the license feo here inafter required for the same. Section 2. The license fee to bo paid under this ordinance is ns follows: All manner of shows and entertain ments, a sum not exceeding live dol lars for eacli day, except for church or charitable purposes which shall bo ex empt. Circuses shall be charged the sum of twenty-flo dollars per day. Peddlers of clocks, watches, Jewelry, spectacles, medicine, etc., shall be charged five dollars per annum, Peddlers of dry goods, notions, cloth ing, and 'books, on foot, five dollars per annum; same with wagon, ten dollars per annum. Peddlers of bread, moat, poultry, fish, oysters, fruit, milk nnd vegetables, llvo dollnrs per annum. Peddlers of tinware, on foot, two dol lars per annum; same with wagon, live dollnrs per annum. Peddlers of bed springs, wringers, ORDINANCES. enrpota, lamps, etc., live dollars per?' All venders, hawkorp, peddlers, mer chants, nnd Other dcalbrs not named In this section, shall pay a llccns-j feo oC two dollars p?r annum. Section 3. This ordlnanco shall not Include nor apply to farmers or gar deners selling their owr produce, or to any person, firm, association, or cor poration, paying a mercantile tax In the Borough, or to commercial agents. Section i. Every person, firm, asso ciation, or corporation, doing business In this Borough without a licence, shall, upon conviction before tho Burgess, pay a flno of not less than ono dollar, nor more than five dollars with costs; said lines to be paid Into tho Borough Treasury, to be applied for Borough purposes. All offenders of tho provisions of tho foregoing ordinance shall bo arrested either on sight or by warrant Issued on complaint entered according to law by tho Burgess; that tho fees of such offi cers uhall be one dollar for each arrest, with six cents mileage for each mllo ttaveled on the service of any such cases, to bo collected as other costs are now collected by law. All licenses shall bo signed by tha Burgess and Secretary of tho Council, with' the seal of the Borough affixed thereto: the Secretary shall prepares and file all licenses, and shall furnish a supply of blank forms nt his office; and shall receive a feo of twentv-llvo cents (aside from his regular pay), to . he paid by tho applicant for each li cense Issued or prepared by him to bo Issued by the Burgess; That the Secre tary shall keep a proper record of nil licensee Issued, Including the names of those obtaining licenses, places of resi dence and business calling, with dates, etc. All applications must be made to the Burgess, nnd the applicant shall fill out nn affidavit and sign and swear (or affirm) to the same, stating tha place ot his birth', age and residence. Tl.e Burgess shall not Issue a license to any person of known Immoral char acter nor to a person of drunken hab its. The Burgess shall inquire Into 'he fitness of the nppllcant, and shall keep at his office application blanks, with affidavits, and shall receive all license; fees and costs und pay over th'e same to the Borough Treasurer, deducting therefrom the Secretary's fee and llfty cents for the Burgess for preparing ap plication blanks and swearing the ap plicant. Tho Borough shall pay for all 'blanks nnd license papers as other stationery Is paid for at present. " TITLE XIX. sdlctlon and Fce3 of Burgess. Jur: Section 1. The Chief Burgess shall exercise tho powers. Jurisdiction and authority of the Justices of tho Peaco within the Borough, for tho suppres sion of riots, tumults, disorderly meet ings and in all criminal cases; for tho punishment of vagrants and disorderly persons. i Section 2. He shall also exc-rclse tho criminal powers. Jurisdiction and au thority cf a Justice of the peace. In the enforcement of nil ordinances ot the Borough, and the collection of fines and penalties under the same. Section 3. In the exercise of tho powers and Jurisdiction conferred upon him by law nnd by this ordinance, as herelnbefcte set forth, h'e shall receive the same fees for like services as Jus tices of the peace are now entitled to. It shsll be unlawful for any person under the age of fourteen years to be. or remain In or upon any of the streets, alleys or public places In the Borough, at night after the hour of 9.30 o'clock p. m.. unless such person ia accompanied ny parent, guardian, or other person having the legal cus tody of such minor person, or Is In tho performance ot an errand or dutv di rected by such parent, guardian, or other person having the legal custody of such minor person, or whose em ployment makes It necessary to be up on said streets, alleys, or public places during the nlsht time after said speci fied hours. Section 2. It shall be unlawful for any parent, guardian or other person having the legal care and custody of any person under fourteen years of age, to nllow or permit any such child, ward, or other person under uuch age, while in said legal custody, to go or be In or upon any of the streets, alloys, or public places In said Borough, within the time prohibited In Section I of this ordinance, unless there exists a reason able necessity therefor. Any person violating the provisions of this section shall, upon conviction, be lined In a sum not exceeding five dollars for each offense. Section 3. The High Constable or any regular policeman, while on duty, is hereby authorized to arrest, without warrant, any person wilfully violating the urovlslons of this ordinance, and retain such person for a reasonable time In which complaint can be mude and a warrant issued and served, Bo It further ordained that no child or minor person arrested under the pro visions of this ordinance shall be placed In confinement, but the parents or guardians of such child or minor per son shall be notified of .such arrest, and if they or any of tbem after being so notified shall thereafter fall, neglect, or refuse to properly cars for such child or minor person, such parent, guardian, or other person having the legal cus. tody of such ch'ld or minor person shall be liable to the penalty provided lu Section 2 of this ordinance.
