New Yolk, Jan. 13. Judge Osborne, In the Supieme court, Brooklyn, handed down a decision this morning, lullng ltlley Grauiian, the well known plunger off the tracks of the New Yprk Jockey club, On September 20 last, the West Chester Racing assoplatlon, which owns Morris park, and which does business under the supervision of tho New',Ypik Jookey club, ruled Grahuan oit tho track for giving Jookey Fred Taial a present of J500. A few days later Gran nan, through his lawyer, Genet al B, F, Tracey, applied to tho Bupreme court in this city for a temporary injunction restraining the West Cheater Racing association from forbidding him to en ter Its tracks. Taylor, aged 40; Henry Fllnn, 35; John Taylor, 24, and Peter Tlnco, a Polander, 30, woio Instnnly killed and Theodore Frankenstein, aged 1C, fatally huit at the Philadelphia and Rending Coal and Iron company's new shaft at Wades vllle this morning. Frankenstein died soon after the accident. The men composed a part of the day shift and stood on the brim of u big lion bucket to be lowered to the bot tom of the shnft, a distance of six bun dled feet. The rope passed tluough a heavy cross head, made of angle Iron which served as a guide for the rope. On account of the bitter cold weather the cross head did not move when tin men started down the shnft. After they had desponded about 300 feet the cross head fell crashing on top of the bucket and pieclpltatlug the four men and boy to the rocky surface below, a distance of about 275 feet. The bodies of the four men were horribly mangled. John Taylor had never -seen the bot tom of the shaft, this being his llrst day to enter the workings. The men who weie killed nil have families.
