The case was given to the jury at
0.30 Saturday morning and at i) In the
afternoon it reported to the court that
it could not agree and united to be dis
charged. The mqnent was refuted.

FELL FROM A TREE.

on Saturday evening in a most peculiar
manner. Mr. Lewis climbed oue of
the trees in the yurd to picit som.i cher
ries for the children. He wus followed
by his young daughter Annie, who
came up and perched upon a limb
underneath hiiu. Lewis would pick
the cherries and place them in a pail
which his daughter held.
At this point John It. Williams, of
Cellevue, a friend of the family, came
along and began to climb the tree. Ho
stepped on the limb where Miss Lewis
and her father were, und a moment
later it broke with a snap, precipitat
ing all three to the ground. The one
that suffered the injst from tho acci
dent was tbe youug lady who sustain d
a contusion iu her loft side, extending
from her hip to her shoulder. Lewis
and Williams are nursing slight
bruises, but not severly injured.

Andrew Swift Struok Hit Head Against
a Ston.
Andrew Swift, of Archbald, a young
lad of 10 yeursj came to this city on
Saturday evening to visit a family
named Eaton on Ninth street. Tester
torday afternoon in company with sev
eral other boys he weut to Nay Aug
falls to bathe.
While doing the feat of diving from
the rocks, which form the side wall for
tbe basin, Swift struck a stone with
his head as he tsared the water on bis
downward shoot, making a deep gash.
The cut was made across the forehead
and for a time young Swift was uncon
scious. His companions conveyed him
to Elton's home, after which he wus
removed to the 'Lackawanna hospital,
where me wonnd was sewed.
