RAMBO/XI ACCIDB/fTl3.—Accidents on the passenger railroads seem to be On the increase of late. Almost daily are the reporters called up the discharge of their official on, in duties, to chronicle the feet of Men, women, children being run over, and either killed or maimed for life. In case or death the coroner is summoned to hold an in , /"S t • Hrs examination is - merely exparte. To some extent be is a committing magistrate, and cot an arbiter to judge whether the conductor or driver of a car is to blame. The jury may or may not be composed of intelligent men, and though their verdict may ex *aerate conductors And drivers, yet this is no reason why such parties should not be belied over b to an swer at court. This is a tribunal appointed y . well digested jaw& joeges well learned in law; furors selected with care, form a court where all eases may have a calm, irmo.rti al investigation 3 where both sides are heard upon welMetined principles or law. The contra are as near perfection as human Ideas, intelligence, integrity, and wisdom can make them, and to such a tribunal all eases of death from violence should be returned It is an entirely mistaken notion that the verdict of a tom net's jury is Huai. We have known of parties being committed by mAoriers to answer the charge of Wil ful murder. but who were really guilty only Of man slaughter, as court verdicts attest. Take a care in point: A passenger car is being driven along a rail road track. The driver rune over sperm:in, and that person suddenly finds himself in another world. An inquest is held. Witnesses are examined all tes tify to the fact; the jury renders a verdict exonerat ing the driver from all blame; he is therefore die. charged. Thus ends the affair, and it is speeilly forgotten in the bum , world. A vacant chair in some household perhaps keeps the sad circumstance in gloomy remembrance. Blackstone defines homi cide in all its phases. There Is such a thing as in. voluntary manslaughter, to which were is a penalty. If a carpenter, on the roof of a housa, should let a board drop, and said board should strike and kill a person. i= is involuntary manslaughter. The lame principle is involved in the case of a driver of a passerger any other vehicle running over and killing he individual. We trust that our pre sent coroner, Dr. Tayldr, who is, without exception, "the best educated and meat intelligent one that we have had in this city during the past twenty-rive yearn, will return to court every driver and conduc• for ol a car that turnover and kills at once or causes the deathol any human being. Cases of damages arising in suits are simply a branch of the tame subject, which must be left to civil courts and juries, and whenever au opportuni ty arises, the heaviest amount of damages should be awarded in accordance with the facts and the nature of the injuries received. /t is only the calm application of stern justice and the raw that will, to some extent, throw a 'ateguard around the people, and thus better protect th em from violent deaths: THE GRAY RE:SERVE SOIRICE.—Tire pro menade concert anti %soiree, given by the Gray Rl selves at the Academy of music, on Tuesday eve ning, netted nearly tnree thousand dollars to the treasury of the Sanitary Commission. Toe Act. dewy never presentee so brilliant a spectacle, and it bore a flattering testimony to the popularity of the creek regiment of our env. The ladies, in their most fascinating gorgeousness and sweetest smiles, indicated in no stinted degree their admiration of the Reserves, themselves, and the Sanitary anoints aion. Ititilepromenalleconcert they were admiring and admired, and when the hour came for the dance they tripped through the "misty mazes' , with a freedom and grace that was bewitching, we know, to all male beholders. The occasion wan the hap piest of the SiSIO-D, gay and festive in all its particu lar.. The ornamentation of the house accorded With the gaiety el the participants. The parquet WAS loored over even with the stage. Toe latter was CAt with The tented scee,e from ".Thseph in Egypt)/ The balcony mud upper tiers were decorated with red, white, and blue °sating, and thenational shield was placed at ;,gular interval. around the house. From the private boxes the National and state Raga were displayen. snit upon the large pillars beside the boxes the coat of arms of Pennsylvania was suspended. The music r , Ldered by the lively and always well.pleased Eirgfild was not lacking in excalence or spirit, and in the promenade and ball did itself credit. The memtwis of the regiment were mostly in uniform. >There is very little to be said in praise Of the outfit of the Resolves, especially 0 4 it ap pears in a ball room. It is more rugged and awk- ward than pleasing and conspicuous on such an oc casion, but the nimbly is that it is for war times. for which the suit. they say, is suited. Should the Gzi vent meat require the reghmentio the field, they will be ready at a moment's notice. and show no ilouht es great an aptness in that sphere as in the one they go signally exhibited themselves on Tuesday eve. ning. Two well known pickpockets, one of whom has Just served out a term, were arrested on Tuesday night, on the charge of picking the pocket of a Mrs. alller, In one of the passenger can on Fourth street, near Callowhid. The ponies were arraigned, and gave the fictitious names of George Eldridge and William Smith. The evidence developed the follow ing curious elicumstaneee The prisoners were in the car; Mrs. Miller entered, whereupon one of the defendant" puthed her against his accomplice ; this IlldeLets was observed by a gentleman named White the lady took a seat, and the neat moment .she m issed h.r pocket book; she charged one of the prisoners with having taken it; he stoutly denied the accusation, and assumed an indignation that seemed to be genuine and not counterfeit. There Was considerable commotion in the car, and the Wrangling began to be quite general. In . the m id s t of this, one of The defendants passed out to the hind platform, and very adroitly threw his right arm around under his left, and something dropped. This was unobserved by any one on the ear. it s o happened that a gentleman named Mc- Connell saw , he movement, and picked the pocket -book np. Like a good sultan he ran after the car, and the stolen book, containing a valuable diamond ring and other things, was restored to the owner. The car Was stopped at (Merry street, and the two young men were taken into custody by Officer Reed. They were ordered to fled ball in the sum of 0000 'each to anawir at court. We learn that another charge is pending against them, but it has not yet 'been publicly investigated. (Before air. Alderman Dougherty. 2 Larceny of a Watch. Samuel Lewis, a colored man, was sem Ulie •ed - yesterday to answer the charge of the larceny of a watch, the property of Hannah Ann Harm It seems that on Saturday evening last Lewis was at the residence of complainant; the watch was in a room; she absented hereell, and after returning dis covered the timepiece gone. He was eharged with stealing it; be submitted its a search, but the watch -could not be found On Tuesday night he returned to the house, whereupon one of the women declared that "she heard a watch ticking in his pocket on Saturday night." He replied that a " colored lady presented the watch to him, and he had gone to see his uncle." DIM Davis went to The pawnshop and found her watch. The accused was committed to answer. Bead Walter in Trouble. Robert Gibbon, a colored -man who occupies the distinguished poaition of head waiter at the Ashland _ Timm, w iz arraigned, yesterday on the charge of committing an aismdt and unsay upon Coeliac Biddle, One of the domestics. Ile also threatened to and brandished a large carving kalfe over her. The complainant wanted him put under "good, solid, freehold bail, to answer lOC the attempted murder." The defendant was bound over to mower at court. [Before Mr. Alderman White.] Internpekance. The most of the cases that were brought to the notice of the police magistrate of the Firth ward du ring the past week were generally for drunkenness, possessing, of course, no great interest, except as so many good, sound, practical lectures On temperance. It is a moat astonishing thing Mat, in these days of general intelligence and high prices of liquor, men and women will still continue to drink liquor to ex cess, and make beasts of themselves. A well•dressed woman, so entirely drunk**s to be Unable to stand, was carried by the police along Fourth street to the Union-street station-house, on Monday afternoon, followed by a crowd of urchins whooping and hallooing at the top of their lungs. Decent females looked with shame and incrboestion upon the picture, and men passed by with eon• temptuous pity. While this was progressing an other woman was on the way from the purlieus of Bedford street. The poor, miserable, disgusting creature was in a " go. cart , ' and the scenes she en acted and the language she used might well crimson the cheek of modesty. fi house of correction is sadly needed for the reclamation of such miserable wreaks of humanity. Among the eases yesterday before Magistrate Wbite was a specimen. of a man who had seen better days. Oue eye was badly dustigured; his clothirg tattered ; hie matted /Air covered with, a shocking bad hat ; in feet, his shivering form stood late a dilapidated Monument to the power of bad whirky. 6, What is your name'!" said the magistrate. "John Smith, sir." 66 Drunk again, John, are you!" " No, sir, Pm not the other Smith." "You were here before me the other morning." "Yes, sir, but Pm not drunk again, sir." "How can you stand there and say sot" " Yer honor, it. the same drunk, 1 assure you." The magistrate scatted. "How did you get that bleak eye?" " From a blow." "How I" I was splitting Wood." Yes. you were splitting wood; you poor, mise rable drunkard. You have been before me a dozen of times; you have promised to reform; you are unable to ten the difference between using and abusing liquor. Besides this, such villainous stuff as you drink is sending you with railroad speed to per dition. You are sacrificing your very soul. Every glass of the whisky you drink has a devil's imp in it John, it is liquefied damnation that you drink. You are an outcast; a decent person Would recoil from you with loathing contempt. It would give me pleasure to send you to a house of correction, if there was an institution 01 this kind, but, as it is, I'll send you below as a vagrant, (or thirty days, where you ought to be left, and not let out, as is too often the case, before that length of time." The renuoks of the magistrate were decidedly to the point, entirely truthful, and, through the medium ci poor John and the prams, are taus submitted to the world at large. THE COURTS_ District Court—Judge Sliarswooti. James Barber vs, John D. Sioenotham, adminis trator, &a. An action to recover for money loaned. Verdict for plaintiff $1,319 91. George Thompson via Bocce Stain. To recover no a preminorp note. Verdict for plaintiff $347 79. Iristriet Court—Judge Hare. Anna M. Smith vs. Lucas Hirst. Tnis was an ac tion to recover damages for loss alleged to have been sustained by reason of dekndalit. , s action as counsel for plaintiff It was alleged by idaiutiff that in 1800 sne held a judgment note for SOO, which defendant advised her was good, but subsequently recommend ed should be substituted for a eater or more valuable security. He suggested a bond and mortgage, and plaintiff, through ter son, as her agent, assented, and the mortgage was executed through one . Charles B. Nudd, the judgment note befog given as part of the consideration. At the time or tile transaction plaintiftaverred that the defendant represented that lie had made the proper searches, and found the property unencumbered, and that it was good mar ketable real estate. Plaintiff alleged that the mort gage was valueless, as the mortgagor had no right, title, interest, or estate In tne property. The defence denied, absolutely, the allegations of misiepresentattoe, and averred Mitt the Judgment note which plaintiff represented as worth $6OO was not worth anything ; that she knew it to be worth leas, and that plaintiff's son, the real owner of the mortgage, as deiennant alleges, was fully aware of the nature of the transfer and the value of the mortgage. As the case progressed it became appa rent that the title of the mortgage in the land was gond. Plaintiff thereupon suff.ied a non suit. Jane Toner ye. Hoffman Immel. A feigned issue. Jury out. Isaac Langebartel and Edward Bradley vs. The City of Philadelphia. This was an action to re cover for the paving of certain intersections of streets ; but as plaintiffs were not prepared with testimony to meet an objection that there was no -evidence that they were the choice of a majority of the property owners interested, the case was with drawn. The court then adjourned. 130PARTNERh'IlIPS.
