The °stamina Railroad Company vs. The Phida delphia and Erie Railroad Company and the Penn aylvaula Railroad Company, and Joseph D. Potts and Samuel A. Black. Motion to dissotve pre liminary injunction. lids case mime up for argument yesterday on a pending motion to dissolve an injunction granted last week, by which the respondents were restrained from interfering with, or preventing in any manner, the use, by complainants, of the sidings at Williams port, and the road and its appurtenances from MR' ton to Williamsport. under the reasonable rules and regulations Of the Philadelphia and Erie Railroad Company, in accordance with the contract of Or. tober 31, 1860. A pending motion for an attachment for contempt against the officers of the railroad com panies, respondent, and Means. Black and Potts in disregarding the injunction, also came up for argu ment with the motion to dissolve. The bill upon which the injunction was allowed, sifter reciting the terms of the contract of October 31st, 1860, by which the complainants were to be al lowed the me of the track of the Sunbury and Erie Railroad Company between Milton and William- Port, subject to the conditions and restrictions there in contained, goes on to say that "on the 4th day of January, 1564, the said defendants, the said Sunbury and Erie Railroad Company, and the Pennsylvania Railroad Company, and Kende. Black and Potts, pro leasing to be the agents of the said Pennsylvania Railroad Company, locked certain switches and tidings at Williamsport, which are a part of the 7Philadelphla and I:tie Railroad Company, hitherto enjoyed and used by complainants under the said contract, and have from that time continually kept She same locked, so as to prevent the use thereof by your oratorkond have prevented the running of their freight oars over the laid road frOni William*. pert to Milton, Since that date, to the great injury or our orators, and, if continued, to the utter and en- Sire destruction of their freight boldness on any part of their road from and to Williamsport. Their said defendants have locked the awitchea with new and Unusual locks, and have plaoed men upon them arm ed with clubs and bludgeon., to intimidate com plainants from any removal of said locks or inter ference with said switches, whereby it has become Impossible for complainants to remove the same Without personal violence," fro., fcc,i The extract from the bill contains the gist of the ground of complaint upon which the injunction was granted ex parte. Yesterday an answer On behalf of the respondents lima Bled at bar. Also, affidavits in the nature of answers on behalf Of MOUra. Black and Potts, and additional affidavits, to meet the motion for attach lnent for contempt, Were filed. - the answer denies the equity of complainants , ern, but admit that they bad looked the switches at :Williamsport, as charged in the bill. Respondents Shen proceed to justify their action as a reason, the gast that the complainants persistently keep in their employ an incompetent and negligent conductor to nib trains over the road from Milton to Williams port, after his negligence or incompetency or both had caused a serious collision Cm not being on pro- a me nd by which life was secondd the locomotives a n d egra much injured. A ollision, respond- Santa say, was barely escaped, The natty in fault being She same conductor, and the complainants still Perused, upon the demand of the respondent; go discharge the conductor, Or transfer him to some ether part of the road, although respondent/ of 'bred to simply a conductor, or to furnish loco ;Motives without charge to draw the tufts of She complainants until some satisfactory arrange. 'Anent could be arrived at. Upon this, as the only means lett to protest themselves and the lives and property of others entrusted to their care, they put Sued the course complained of, but they claim that, under the contract before mentioned. they had a right to take such action. The case was argued by St. George T. Campbell and Charles W. Gibbons for the motion, and by Drayton and P. W. Hughes against. Judge Thompson thought that, in regard to the Motion for an attachment for contempt, the binds. vita read showed sufficient to purge respondents of any inteot to treat the coder of the court with con. tempt. He also thought that, as the case had been presented to the court on bill, answer, and affidavits, the injunction should not stand, but should be dig aolved. Ordered accordingly. The Richmond and Schuylkill Passenger Railroad Company et al., vs. Starr and Jobn Thompson, abet= In equity. This was a motion on behalf of certain trustees under the mortgage given by tl - e Richmond and Schuylkill Passenger Railway Company, for a preliminary injunction to restrain the defendant and the sheriff from proceeding to sell, under ajudgment writ of fieri Satins from the Dia. Diet Court, the equipments, horses, cars, Esc., of the said road. The injunction is asked for on the ground that the title to the same is now in the trustees, and that the equipments of a road are part of the road itself, and as such not liable to be levied upon and sold in such a manner. Argued by E. S. Miller for complainants. District Court—Judge Sharawood. Shook VII. King at Baird. Before reported. ver dint for plaintiff, $l4B. • PHILADELPHIA. BOARD. OF TRADE. S. W.
