SCHOOL OF DESIGN FOR WOMEN—RE :roma OF mil COINMITTEES.—Yesterday afternoon The annual exhibition of the School of Design for Women closed, having been open since "Friday last. The exhibition was well attended, and more than ordinary interest was taken in the proceedings of this year. The reports of the various committees on the merits of the pupils swore submitted. The committee on designs for calicoes, lawns, delaines, Sc., report marked improvement in this particular branch, and say : The designs for calicoes, delaines, Sc., offered by Miss Emma Willits and - Arise Annie L. Colladay, are perfect in every particular, and show conclu sively that they are fully competent to assume the Important duties of practical designing. The outline drawings of small designs by Miss E. M. Singer are well done, and for figures so small and neat are very perfect and regular. Her colored designs for calicoes for two and three colored print ings are also very good. The designs by Miss Ophelia Lane for calico print ing of three colors are good, and show great varia tion of style, and good taste in coloring. Her de signs In plaid block figures, for printing in chintz colors, are novel, handsome, and well executed. The' large figured, high colored designs by Miss Mary A. Trenwith, for chintz printing, are beau tiful, and well executed, both in drawing and color ing, and show good taste in the combinations of coloring. The designs in chintz colors for lawns, Sc., by Miss Amelia Hory, are good in design, regular in drawing, and handsome in coloring. The variety of small, neat plaid and figured de signs, by Miss Lizzie Shreve, are very good, both in drawing and coloring. The small figured, two colored designs, by Miss Lizzie T. The unexpended appropriation from last year amounted to $139.50, which will be returned to the city. Dr. Chas'. B. Roberts was elected, in place of Dr. Moran resigned, as out-door physician. Mr. Server ottezdthe following resolution, which was adopted: Resolved. That the visitors of the poor be instruct ed to confine their expenditures for out-door relief, during the year 1863, to the following schedule, and in no case to exceed that proportion in any month : Jimmy, 20 per cent.; February, 18; Mareh,l2; April, 6; May, 2; June, 2; July, 2; August, 2; Sep tember, 2; October, 5; November, ii ; and Decem ber, 18. SALE or ..A. 72.kiLWAY.—The North Phila delphia Plank 'Road, as it was formerly called, but at present the North Philadelphia City Railroad, commences at Broad street and Columbia avenue, and extends, with sidings, and by a single track, northward along Broad street to Tiogs street, thence along Tioga street to the North Philadelphia Plank Road, thence along the said plank road to Manheim street, thence along Manheim street to Wayne street, thence along Wayne street to Chelton ave nue, and thence along Chelton avenue to the Ger mantown Turnpike Road, a distance from terminus to terminus of about six miles of railway, including the sidings or turnouts. It was sold at public sale on Saturday, at the Merchants' Exchange, because of the failure of the company to pay the semi-annual interest on the bonds, it having been agreed that the road should be sold if the company should "refuse, neglect, or omit," for any period exceeding six months, to make the payment. The road was knocked down for the sum of $21,000, Mr. Louty being the purchaser. The road has long been con sidered a useless nuisance, and if the rails were taken up and its site was restored to its original condition; it would be a source of rejoicing to the residents along its route and to those who have occasion to drive along the roads upon which it is laid. SICK AliD WOUNDED SOLDIERS IN VlE onvia.—Two ladies from the "Ladies' Association for Soldiers' Relief,” purpose to make a personal visit to distribute delicacies among the sick and wounded soldiers in 'Virginia. The sum of $69 is gratefully acknowledged from Alex. G. Cattell, Esq., on behalf of several members of the Corn Ex change, as well as contributions from numerous other benevolent gentlemen. Donations in money, flannel shirts, stockings, wines preserves, drie fru i ts, corn-starch, and other suitable articles, will be thankfully received until Saturday evening next, when the committee of ladies will leave for Vir ginia. Contributions can be forwarded to the resi dence of Miss Lithe C. Price, No. 1825 Mount Ver non street, or to the president, at the office of Edw. Brady, attorney at law, No. 135 South Fifth street. The various ladies' aid societies are requested to render such assistance as they may deem proper. MAJOR r fliOlfAi J. TOWN. .—Mnjer Tho nuus J. Town, of the 95th Pennsylvania Volunteers, has been in the city for some time past, on recruit ing duty. He has succeeded, however, in being re lieved from this duty, and has returned to his regi ment for active service. By a unanimous vote of the regiment, he was a few Weeks since elected a staff officer, having formerly held the position of captain. As his brother, the Colonel, is at present acting as brigadier general, the chargee, of the 95th Will temporarily devolve upon the Major, who is a young but gallant and experienced officer. The con fidence universally reposed in him, flattering as it might seem in other cases, is but just and natural in this. Such youth and such talent are not often united in this capacity. TILE GRAND PRIZE BALL, to be given by the Philadelphia "Mercuri Loquandi," on this evening, for the benefit of the sick and wounded of the West Philadelphia Hospital, is deserving of the especial attention of pleasure-seekers. The list of prizes, we are assured, embraces articles of a really elegant, useful, and costly character, and will be fairly and impartially distributed, by lot or other wise, at the choice of the visitors. Aside from the prize attractions, the .fact that the net proceeds of the fete are to be devoted to the benefit of our sick and wounded warriors should be sualulenr to' in -4lnee an overflowing attendance. THE POLICE. • [Before Mr. Mclennan Ogle.] Alleged Horse Thief. E. M. Ely was arraigned before Alderman Ogle yesterday afternoon on the charge of the larceny of a horse, valued at $ll5, the property of .Ir. Martin Fisher. Mr. Fisher testified to the value of the horse, and that the animal was stolen on the 17th of December, and recovered at Athenaville on the 23d inst. by Offi cer Hamilton, of the Reserve Corps. Officer Hamilton, on being sworn, stated that, from information received, he at once proceeded to Athens ville, Montgomery county, seven and a half miles from Market-street bridge, in company with Mr. Fisher; the horse was restored; then went to Lan caster, and arrested the defendant and brought him to Philadelphia. J. L. Stadelman sworn.—l am an employee of the Pennsylvania Railroad and stationed at Athens ville; the defendant came there just as the afternoon train was about starting, and seemed to act in ra ther a queer manner; he said he wanted to go up on the train. but had a horse at the corner of a road a short distance off; the defendant asked witness. to take charge of . the horse until he came back; wit nom got a boy to lead the horse to the hotel stable, at Athenaville; the -witnesscwhen ,he came to re-. Sect that the horse had only a blind halter on, and that the man had acted in a singular manner, thought the animal must have been stolen; subse quent developments proved this to,be so. Question. Are you sure the defendant is the man who had the interview with you about the horse? Answer. Yes, air, he is the man; am certain he is. Charles Rouse sworn.—l was at the stable of Mr. Fisher, back of Walnut, below Second street; the defendant came to the stable from Mr. Fisher's, and said he wanted to look at it; I put the horse in the stable, and we all went away together ; the horse was in the stable when we left ; the stable door had the lock merely stuck into the hasp, but was not fastened; when I came back to the stable, at half past 2 o'clock, the horse was gone. The defendant was asked if he had anything to say. He replied that he would like to make an ex planation. He speaks English, with the German accent. He said: I cooms to town mit butter and eggs, and I sells sixty or seventy pounds to Mr. Fisher, and stayed at his house that night. Next day I asks Mr. Fisher to see his sthable, and he tells me to go. Yell, I vent, and I look at the sthable, and I goes are); and gits on der cars for to go home, bedause the train vas most too late for me, and I hurrys, and I gits up to Laneasther, as I can prove i by my wife; and dese sh all I knows apout it. Question by the Alderman. Don't you remember asking the man at the Athensville Station to take care of a horsel Answer. No, sir ; I neffer said s a vord like that. • Question. Then you didn't take a horse there X. No, sir; I guess der man isti mistaken. Q. Did 3 - ou see Mr. Fisher's horse in the stable? . _ X. Oh, yea! he was there ven I paid a visit. Q. Ilow did the horse get to Athensville? A. Dat ish just rat I knows nothing about. By the Alderman to Mr. Stadelman, Are you sure in your identity of the defendant? A. Yes, sir ; he is the man ; I know I am certain. By the Alderman. Mr. Ely, you must enter bail, in the sum of $l,OOO, to answer at court. In a ease like this the bail must be entered before one of the judges of the Court of Quarter Sessions. The defendant went down stairs, and at SP. M. took passage in the van, and Was soon after lodged in the County Prison. Sound lug. The next ease was introduced by Detective Levy; Mitt of a young man, who might. be called handsome, well-dressed, and easy in manner. Ile gave the name of William Johnson. Officer Levy, on being sworn, said that he saw the defendant in a crowd of people, at the southwest corner of Third and Chest nut streets, putting his hands in the folds of a lady's dress, as though feeling for her pocket. The young man, in reply to a queationipropoundeil by the Alder man, said he was in the crowd, standing near a lady, and merely adjusting the front of his coat; it might have appeared to the officer that I was feeling the folds of the lady's dress. "Oh, no," responded Mr. Levy, " /otooped down, and closely observed you." "Well, sir, allow me to insist that you must be mistaken," blandly responded the defendant. "I am not mistaken," retorted the detective, with firmness. The • Accused wati let off in his own recognizance. He evidently gave a fictitious name, and it is quite probable that he is not known in this city. The oldest detectives failed to identify him—hence his discharge. The Revised Penal Code at Fault. A new question of misdemeanor; or perhaps crime, has arisen, to which no allusion is made in the re vised penal code. It is enough to bathe the skill of a Philadelphia lawyer. It Seems that quite a number of men have enlisted, many of them in the regular army, and, after receiving their clothing, have deserted. They go to a convenient shop, store, or place where they sell the uniforms, and even shoes and stockings, and then desert. It is esti. mated by several military officers, who have paid much attention to this subject, that at least three hundred thousand dollars' worth of property has been disposed of in this manner, in the city of Phila delphia alone. The question arises, how can the Government 'regain possession of such property? When a man enlists, he receives so much in money, and so many rations and uniforms per year. The uniforms belong to him, when once in his posses sion, under this law. Ile certainly has no legal right to sell them. But how is the Govern ment to get Possession of them, when once sold, as stated above 4 The affair has reached such gigantic proportions as to require an exercise of the wisdom of learned men. It is one of importance. Latterly, quite a number of men, on enlisting, have solicited dark-blue clothing. This kind sells much easier than the sky-blue fabric. It is believed by military gentlemen there are persons in different parts of the city who are systematically engaged in this kind of swindling—perhaps induce men to enlist, get the clothing, then desert. Yesterday morning about one hundred dollars? worth of U. S. clothing was re covered at a miserable-looking shop on South street, where it had been sold by men who enlisted on Sa turday, and deserted on the first opportunity that offered. The whole subject is one that demands at tention. LEGAL INTELLIGENCE. 'Matta States Circuit Court—Jaage Cad walader. THE ItEVENUE ACT-TAX ON 3tANUFACTURES Barton H. Jenks and Joseph 0-. Mitchell, trading as Alfred Jenks St Son, vs. John W. Cowell and Theodore S. Williams. A bill in equity, under the above title, was tiled in the Circuit Court yesterday, by William E. Hirst, Esq., praying for an injunction to restrain the defendants, who are the collector and deputy collector of the fifth collection district of this State, from proceeding to collect a tax of $597.07, which had been assessed by the assessor of that dis trict on complainants on the manufacture and de livery of muskets to the United States, during the month of October last, under a contract complain ants had with the Government, dated July 13th, 1561. A. tax had also been assessed against them on the manufacture of machinery for that month, which they have'already paid. The bill in this case, how ever, charges that the assessors, in Laying the tax complained of, have exceeded their duty, because of a provision of the act of Congress that " the taxes on all articles manufactured and . sold in pursuance of contracts bonctfide made before the passage of this act shall be paid -by the purchasers thereof, under regulations to be established by the Commissioner of Internal Revenue." It is further averred that the complainants have represented the matter to the I,Var.Department, but that department refuses to re imburse them In case said tax Is paid by them, be cause no appropriation has been made by Congress for that purpose. The application for the injunction will be heard to-morrow (Wednesday), at 11 o'clock. SuinTme Court at Mot Prins --1 Ir. Juitice Thompson. Armstrong vs. The Philadelphia and Erie Railroad Company. This case came up for argument yester day morning, on exceptions to the answer of plain tiff' to defendants' bill of discovery in a suit at law now pending'. The ease was argued by Charles Gib bons, Esq.; for the defendants, in support of the ex ceptions, and by John U. Knox, Esq., contra. Elstriet Court, No. 2—Judge Shorewood. The first period of jury trials for the December Term of the court commenced yesterday morning, but none of the caeca on the day's list being ready for trial, the court adjourned at an early hour. ProL cisely the same state of affairs existed in No. 1, and that court also was in session but a short time. Common Pleas Judges Thompson and 1111; TWENTY-YOURTII-WAIID .comccithtax AN INJUNCTION AWARDED. Yesterday the amended affidavit of Mr. Lowry was presented and read to the court. It sets out the grounds of his belief that he was elected member of Select Council from the Twenty-fourth ward, as follows : • -Firs!. That by the hourly return 3 of the several divielons of the ward, which were brought to a cen tral point, it appeared that he was elected. Second. That on the morning after the election all but four of the return judges met, and, by the re turns then and there made, deponent was elected. Third. That in the Sixth division he received 206 votes, and Mr. Miller 191 ; whereas the judges that morning stated the vote at X7l for defendant, and 196 for Mr. Miller, and that the mistake occurred by counting five votes for Mr. Miller that had been polled for deponent ; but deponent's election not being, as was then believed, affected by it, the mis take was not corrected, Fourth. That he believes the true vote of the third division was 67 for deponent and 91 for Mr. Miller, instead of 61 for deponent and 93 for Mr. Miller, as read by Mr. Simpson from a paper in his possession at the afternoon session of the board ; and, Fifth, sixth, seventh, and eighth, (substantially.) That he has not seen this paper read by Mr. Simp son, and he was refused permission at the Prothono tary's office to examine the package of returns from that division, although the seal was broken. Eighth. That he did not interfere with, or control the judges, in any way. Ain/h. That he believes they acted in good faith ; and, Lastly. That he has no desire or intention to hold this office unless entitled to it, anti he submits these statements in order that he m i sully discharge his duty to himself and his constituents, and that the court. may see that the proper tribunal to try this controversy is the Select Council; before whom all the facts may be fully disclosed. The court held that all his reasons were insuf ficient. and did not meet the allegations in the bill, and ordered an injunction to issue. A. decree was then drawn up and entered in the following words: "This cause came on to be heard this 29th - day of December, 1862, and was argued by counsel, and thereupon the court order and decree that an in junction issue enjoining and restraining said de fendant, Philip Lowry, Jr., from using said cer tificate certifying to his election as member of Select Council, being the certilleate signed by five of said nine judges in said bill mentioned, and from asking, demanding, or taking his seat in Select Council at its organization, by virtue thereof, or in anywise availing himself of the same for the purpose of ob taining a scat in said Council; and that Bald de fendants, Pey and Martin, their agents and servants, and all persons acting for them, or in their place or stead, as clerks of said Councils, be enjoined and re strained from using, or in anywise regarding acid certificate at the organization of said Select Connell, or calling said Lowry as a member thereof, or in anywise aiding or enabling him to take a seat in said Council, at its organization, by virtue thereof." Another case of election contest in the Twenty fourth ward was also disposed of. by the court. It WAS a contest for the office of alderman; a Mr. Allen alleging, that, by a true count of the votes in the Seventh division of that ward, it would appear that he had received 20 votes more than had been counted for him. The ballot-box was brought into court, and the result proved Mr. Allen's mistake, but, at the same time, added one vote to his and Mr. Warren's count. Messrs. Hirst and Miller thought this a good op portunity to count the votes of that division for member of Select Council, and their count resulted in taking one off from .Iffr. Lowry's vote and add ing five to Mr. Miller's, making a difference of si ; in favor of the latter.
