The pitraemilogy of this ordinance, which entrusts metal authority and power In the firet place to the Mayor end committee in conjuuctien, and sobriquentiy devolves the same upon the Mayor, acting in conjunction with aid littler the advice of the committee, is by no monne 'wind!, but interpreted in connection with the prbvieion of the net cf consolidation. which prohibits members of Councils, whether m a committee or other win, from performing any executive ditty whatever, no question can be raised as to its legal import. The special committee or Domed., jointly with the Mayor, were entrusted with the duty of ascertaining the measures requisite to be taken for the safety and defence of the city, and the Mayor was empowered to execute those measures; hence the advice et the committee and the action of the Mayor in accordance therewith are both (impel to the Nilpotent of the torme of this ordinance. The exigency ut der which the ordinance was adopted by Coutes hat pawed away before the contemplated pur chase of these overcoats; and, however essential they may be to the equipment of the Monte' Guard, such promptness of action on the part or the committee was hardly needed for the defence of the city at that time.
