Constitutionality op the Ninety-
HAY LAW.—Yesterday morning,in the Supreme Court,
Lefore Justices Woodward, Thompson, Strong, and Read,
an inti resting Cftae una heard on & writ of habeas corpus,
to teat the validity of tlio commitment of the relator as a
professional pickpocket, under the recent act of Assem
bly, authorizing tho arrest and commitment for ninety
stays of persons k> owe to bo professional thieves. The
court held that bj habeas corpus was not the proper way
of iofiting the cnnsiinitioimmy of an act of the Legisla
ture. and that a writ or certiorari had hotter bo tnod out,
and made returnable to the Saturday preceding the Mon
day of the mesting of the Supreme Court at Harrisburg,
when the argument m the case would be heard.
The Late Case of Illegal Voting.
—Yesterday, in the cast; of the Commonwealth vs. Kuatz
man, who was acquitted in the Court of Quarter Sessions,
B me days ago, of a charge of illegal voting at the army
elections, on the ground that the lAv authorizing volun
ieers, ui actual military &1-, tb VOtd ill tUdIP
camps, w*as unconstitutional, error was assigned to the
decision of the court. Counsel here statid that the ques
tion had been very fully argued in the case from Luzerne
county, and they were content to submit it on the paper
feo~ks. This was done.
The Society op Friends.— Yesterday
morning the joorly meeting of the Orthodox branch of
the Society of FrtaMia commenced at ihe meeting house

An Important Decision Relative
TO WHAT CONSTITUTES A LEGAL TENDER
A fow days since an important case was heard in one of
the conns of a* adjacent county, by which it was de
cided ihat the treasury notes issued by the Goyermneat
constitute ft legal tender in the payment of debts It
appears that Elizabeth Duke, late Elizabeth Boat©, al
tiiiiiistratrix of George Boate, deceased, issued an execu
tion against Henry Gramho, on which the sharin' sold
certain real estate for $ll,OOO. At the ptaititift
gave notice that the purchaser must pay in gold enough
to satisfy plalntid : a claim. After the sale, it appearing
that there were disputes between difl'ereDt Hen creditors
as fo tbo distribution of this fund, the sheriff paid the
Bioney into coiirfi and an auditor was appointed to re
port distribution, who decided to allow plaintiff the ba
lance of her claim in full—to wit: ftl ,962 SQ. The audi
tor’s report having beeu confirmed by the court,
plaintiffs counsel dtnmnded gold of the prothonotary,
who refused to pay it, bin tendered the amount—
alter deducting per centrums —n ivv .91,942.60 in United

in sufficient amount to pay this sum. But before the
hearing now, it had bten ascertained that the said act
embraced also the notes authorized by the act of July 17th

ly made, and the court discharged the r«i«, upon which
plaintiff's counsel recr iptfid fur and received the treasury
notes as tendered, being, as the law now stauds, the best
money the purchaser was obliged to pay him.
Maliciousness —A lad, named John
WVring. was sent to the House of Refuge a day or two
since, charged with malicious conduct. 11a had formerly
been nn inmate of the Puorhouse at Frankford, and was
bound as uu apprentice to Mr. John Kenworthy, residing
at Cellar Grove, m the Twenty-third ward. The youth
has frequently beea detected in committing fcilS6hl6VOU3
acts, and is also alleged to have made an attempt to lire
the barn belonging to Ur. Kenworthy.
Another Old Soldier Gone.—The
funeral uf Wiiliiun MniWusk twk pl»?o yesterday morn
ing, from his late residence, No. 92 T St. John street.
The dtcea&ed was in the 71st year of his age. Ho served
in the war of 1&12, and was taken prisoner to England,
where he was coufined in tho Dartmoor prison for a pe
riod if eighteen mot the. His remains were followed to
the grave l>y a circle of relatives and friends.
The School Teachers’ Warrants.
—Up to noon yesterday the City Treasurer hail paid out
about $80,0(0 of school teachers’ warrants. Tho bal ihca
will be all paid to-day, unless some of tho teachers should
col present the wan ants for payment.
Fortunate Escape.— On Saturday,
a child of Mr John Skully, about sovon years of ago,
clambered upon the wall along the Norristown Railroad,
at Alanaynnk, and fell upen the track, a distance of

No One Drowned.— lt has been as

canal boat Adventure, at Gorgas'e wharf, in the Eigh

time she sunk.

In pursuance of a decree of the Supreme Conrt of
PttUiMilvAuiA in Aud for tho Ear ter u district, made In
the above cause, the undersigned will sell at public sale,
at the Exchange, in the city of Philadelphia, on TUES
DAY, the 29th day of April, 1862, at 12 o’clock, noon,
the following-described estate, property, rights, and fran
chises, late belonging to the Barclay Railroad and Coal
Company, to wit:
No-1. All that tract or body of coal lands situate in
the township of Franklin, in the couuty of Bradford, and
State of Pennsylvania, containing altogether 2,416 a;reg
and allowance, boundid by landß surveyed in the war

veyed in the warrantee names of James Cox, William
Hall, William GoveL Joanna Curry t Aaron Lerji ami
Jacob Hiltzheimer, of which about 209 acres are im
proved land. On this tract, No. 1, are the Barclay Coal
Mines, yielding a superior quality of semi-bituminous
coal, and the works, fixtures, and apparatus for mining
coal. Also, forty-one Dwelling* Houses, and other build

No. 2. Also, the lUilro&d constructed by, aud hith
erto belonging to, t.’<e said Company, 16 23*100 miles in
length, extenqing from the Coal Mines on No. 1 to the
North Branch Canal at Towanda, in the said county of

nart to the said Raftroad, with the right of way, and
with all corporate rights, powers, privileges, and immu
nities and franchises heretofore belonging to or verted in

wanda aforesaid, bounded by tbo, Susquehanna river on
the east, Elizabeth street on the north, a lot of Tracy
and Moore on the south, and on the west by an alley.

acres, more or less, with a water Basin, trestle, and
fixtures for Shipping Coal, Engine House, Turn-table,

No. 4. Also, anrther lot or piece of land, situate at
Towanda ? aforesaid, on the aforesaid railroad, bounded

west and south, and by the Susquehanna river on tho

The terms of sale vrill be as follows: Nos. 1 and 2 will
be sold toeeiber, subject to a first mortgage thereon exe
cuted by !h« said Companj to ratriok Brady and Isaac
B. Davis, truetew, for 5150.000, with interest thereon at
7 per cent, from September Ist, 1857.
Nos. 3 ai d 4 will be sold separately, and clear of incum
