YESTERDAY'S PROOREDINOS.

The Court of Quarter Sessions was in session yester
day exactly thirty minutes by the State louse clock, al
though the bendhes 'were filled by', Witnesses who hail
been summoned to appear in eases that had been posi
tively fixed for trial. It was clearly understood that the
case of young John Sweeney, charged with the murder
of Richard Parks, would be Riven to akin' for final dis
nosition; yet, notwithstanding the fact that all the ten
• timony was present. a postponement was had until Fri
day,, the ?fah inst. Sweeney, whom many believe to ho
entirely innocent of the crime alleged against him, has
been in prison for a very long time. and it would to but
a simple matter otluetire to give him an early opportu
nity of regaining his liberty, if lie is entitled to it.
The case of the - colored man, Robert Douglass, Who
.is eharged with perilry, was postponed, mien applica
tion of the defendant is counsel, fpr three weeks, on the
groped of the absence era material witness. The appli
cation for a postponement was 'strenuously but unsue
easefully opposed by David Paul Brown. Esq., who re
presented the Commonwealth in the.prosecaltion. Don
glue appears to have constant business in the cowls,
and in his suit against the Mitchell estate evinced con
siderable Ingenuity. In the present under:es, he has
repeatedly naked for a continuance of the caee. on va
rious grounds. The last time it wee continued was on
account Kan alleged Redden and violent Sickness which
confined Jilin to his bed. After thin had boon sworn to,
Douglass, it le said, mule his appearance at Powelton.

The eine of the colored man Hall, who is charged
with the murder of a woman in Bedford street, se else
conbnped Wit the latter part of this month. In the
case of the four or five members of the Shiftier Bose
Company who were arrested for the deliberate murder
of the proprietor of a Inger-beer saloon In the lower
section of the may several months since, it is quite pro
bable that they will never ba brought to trial. A motion
for their discharge bas already been made ander the two
term rule. and it is very likely that this tenn will pass
without finding the prisoners disposed of. These de
fendants belonged to a bold and dangerous gang of ruf
fians. and their net of murder was unprovoked rind
heartless without single extenuating circumstance
connected with It.II The District Attorney has not
Delight proper, however, to bring them to trial.
It is a little weenier that White an immense quantity
of trivial assaultand battery eases, that ought never to
have been brought into Court, are allowed to consume
public time and money, the murderers and felons of all
grades who have been arrested during the past few
ii months are apparently unthought of. It Is indeed a mat
ter worthy the most serious attention of the communi
ty, that the proceedings anima noted scoundrels cane
rally terminate with the binding over to court, and it is
equeny a subjeet for thoughtful consideration how this
glaring and monstrous ovate to be remedied.
-We notice that the bills thus far acted upon by the
present Grand Jury ere mainly for the most petty of
, fences, and ag the trial of prison cases begins to-day,
we may anticipate a week or a month rimed in the
all-abambing duty of agicertaining whether J o hn Smith
struck John Jones. and whether the hydrant rip the al
ley belongs to hire. Broomstick or Mrs. Brickbat. Men
of business are nailed from their stores and workshops
to deliberate upon silly and nonsensieal suite. which.
notwitastending their insignifican at i ng l ee public, are
tried by the tens and twenties in day, yieltlinse
to the officers of the Commonwealth the trifling sum of
830 or 100 per diem. This is the reason that we rarely
hear of important criminal suits being tried, unless the
evidence of guilt is conclusive, and there in an absence
of defence. and alio wombs the strongest argument
why the offidh of District Attorney should be a salaried
position

The case of Battin vs. the Lehigh Coal and Navigation
Company r any was resumed at ten o clock yesterda morn
ing. he case of the plaintiff, as Is endeavored to es
tablish by the testimony is as follows
Up to the year 1043, coal, after being mined, wan bro
ken with hemmers, and it It estimated that one man
could, in this meaner, turn out about, two tons per day.
In 1513 Mr. Hattie, the plaintiff in this action, procured
a patent for the machine which is now the eubject of
controversy. By this machine SOO tons of coal can be
Woken in one day. The importance of the Invention
may be understoodoviien the statistics of the anthracite
coal trade are examined. In Itral, the tonnage for thin
description of goal was three hundred and sixty-five
tons; in 1843, when this =chine was invented, the ton
nage hail increased to over amnion tons, end at the pre
tend time the average is about nine million tons. One
of the important feature. in Mr. Benin's machine
is said to by the saving, by lessening the_milveriza
tion complained of under the old plan. Mr. B.'n inven
tion is the gearing together of two roller& armed with
teeth. ao arranged that theteeth of one roller come op
posite a vacant apnea' in the other roller. The large
masses of coal failing between these rollers are veleta
on the totter one set of tooth. while the other set strike
it in the middle, and the rollitramak mg rapid revolutions
the moment the pressure is, removed, the coal falls
through into screens. and the work is done A patent
was granted for the invention on the ether Oeteberani,
the first zenehine was erected in February, 1844, and the
next year fi fty-seven were in operation. Now the ma
chines are in general use throughout the coal regions.
Notwithstanding these machines used at the different
eollierioa were constructed nocording to the specifica
tions in Mr. Battin'a patent, yet it is alleged that
he never received any, compensation for their use,
•and he commenced a series of suits for the recovery ef
damages. In the first suit tried in this court, Mr. B.
was non-suited, the court ruling that as the patent ..be
, ing merely for the confirmation of machinery, could
neither be supported norassailed byproof of the novel
ty or plot of novelty of the parts. 11 alleged that the
defect in the specification here referred to was the
fault of the patent agent, to whom Mr. B. had intrusted
his business, when about to apply for a patent. in
1849, however, thepatent was surrendered. and a re-is-
PIIO granted. Another attempt was made to recover
damages,, but again Mr. 11, failed, in consequence of
the mimeo(' lie court. This ruling was taken to the &t
-rireme ,Conrt of the United States, and reversed ; and.
three years rigo.seven cases were tried in the United
States Circuit Court and verdicts given in Mr.
Battin's favor. In' liter the patent was extended for
.seven years. The different parties using the machine
in Sehuyikill county entered into nn arrangement with
Mr. It.. by which lie was to receive one cent for every
ton broken.' The defendants, however. whose collieries
are in Lehigh and Carbon empties. refused to pay this
sum alleging, among other thin ea , that the machine now
used by them is different from that of Mr. Benin, in that
