[Reported for The Press.), The Court of Quarter Sessions was in session yester day exactly thirty minutes by the State louse clock, al though the bendhes 'were filled by', Witnesses who hail been summoned to appear in eases that had been posi tively fixed for trial. It was clearly understood that the case of young John Sweeney, charged with the murder of Richard Parks, would be Riven to akin' for final dis nosition; yet, notwithstanding the fact that all the ten • timony was present. a postponement was had until Fri day,, the ?fah inst. Sweeney, whom many believe to ho entirely innocent of the crime alleged against him, has been in prison for a very long time. and it would to but a simple matter otluetire to give him an early opportu nity of regaining his liberty, if lie is entitled to it. The case of the - colored man, Robert Douglass, Who .is eharged with perilry, was postponed, mien applica tion of the defendant is counsel, fpr three weeks, on the groped of the absence era material witness. The appli cation for a postponement was 'strenuously but unsue easefully opposed by David Paul Brown. Esq., who re presented the Commonwealth in the.prosecaltion. Don glue appears to have constant business in the cowls, and in his suit against the Mitchell estate evinced con siderable Ingenuity. In the present under:es, he has repeatedly naked for a continuance of the caee. on va rious grounds. The last time it wee continued was on account Kan alleged Redden and violent Sickness which confined Jilin to his bed. After thin had boon sworn to, Douglass, it le said, mule his appearance at Powelton. during the progress of the recent State fair, in Ina usual healt. The eine of the colored man Hall, who is charged with the murder of a woman in Bedford street, se else conbnped Wit the latter part of this month. In the case of the four or five members of the Shiftier Bose Company who were arrested for the deliberate murder of the proprietor of a Inger-beer saloon In the lower section of the may several months since, it is quite pro bable that they will never ba brought to trial. A motion for their discharge bas already been made ander the two term rule. and it is very likely that this tenn will pass without finding the prisoners disposed of. These de fendants belonged to a bold and dangerous gang of ruf fians. and their net of murder was unprovoked rind heartless without single extenuating circumstance connected with It.II The District Attorney has not Delight proper, however, to bring them to trial. It is a little weenier that White an immense quantity of trivial assaultand battery eases, that ought never to have been brought into Court, are allowed to consume public time and money, the murderers and felons of all grades who have been arrested during the past few ii months are apparently unthought of. It Is indeed a mat ter worthy the most serious attention of the communi ty, that the proceedings anima noted scoundrels cane rally terminate with the binding over to court, and it is equeny a subjeet for thoughtful consideration how this glaring and monstrous ovate to be remedied. -We notice that the bills thus far acted upon by the present Grand Jury ere mainly for the most petty of , fences, and ag the trial of prison cases begins to-day, we may anticipate a week or a month rimed in the all-abambing duty of agicertaining whether J o hn Smith struck John Jones. and whether the hydrant rip the al ley belongs to hire. Broomstick or Mrs. Brickbat. Men of business are nailed from their stores and workshops to deliberate upon silly and nonsensieal suite. which. notwitastending their insignifican at i ng l ee public, are tried by the tens and twenties in day, yieltlinse to the officers of the Commonwealth the trifling sum of 830 or 100 per diem. This is the reason that we rarely hear of important criminal suits being tried, unless the evidence of guilt is conclusive, and there in an absence of defence. and alio wombs the strongest argument why the offidh of District Attorney should be a salaried position UNITED STATES CIRCUIT Curay—Judge The case of Battin vs. the Lehigh Coal and Navigation Company r any was resumed at ten o clock yesterda morn ing. he case of the plaintiff, as Is endeavored to es tablish by the testimony is as follows Up to the year 1043, coal, after being mined, wan bro ken with hemmers, and it It estimated that one man could, in this meaner, turn out about, two tons per day. In 1513 Mr. Hattie, the plaintiff in this action, procured a patent for the machine which is now the eubject of controversy. By this machine SOO tons of coal can be Woken in one day. The importance of the Invention may be understoodoviien the statistics of the anthracite coal trade are examined. In Itral, the tonnage for thin description of goal was three hundred and sixty-five tons; in 1843, when this =chine was invented, the ton nage hail increased to over amnion tons, end at the pre tend time the average is about nine million tons. One of the important feature. in Mr. Benin's machine is said to by the saving, by lessening the_milveriza tion complained of under the old plan. Mr. B.'n inven tion is the gearing together of two roller& armed with teeth. ao arranged that theteeth of one roller come op posite a vacant apnea' in the other roller. The large masses of coal failing between these rollers are veleta on the totter one set of tooth. while the other set strike it in the middle, and the rollitramak mg rapid revolutions the moment the pressure is, removed, the coal falls through into screens. and the work is done A patent was granted for the invention on the ether Oeteberani, the first zenehine was erected in February, 1844, and the next year fi fty-seven were in operation. Now the ma chines are in general use throughout the coal regions. Notwithstanding these machines used at the different eollierioa were constructed nocording to the specifica tions in Mr. Battin'a patent, yet it is alleged that he never received any, compensation for their use, •and he commenced a series of suits for the recovery ef damages. In the first suit tried in this court, Mr. B. was non-suited, the court ruling that as the patent ..be , ing merely for the confirmation of machinery, could neither be supported norassailed byproof of the novel ty or plot of novelty of the parts. 11 alleged that the defect in the specification here referred to was the fault of the patent agent, to whom Mr. B. had intrusted his business, when about to apply for a patent. in 1849, however, thepatent was surrendered. and a re-is- PIIO granted. Another attempt was made to recover damages,, but again Mr. 11, failed, in consequence of the mimeo(' lie court. This ruling was taken to the &t -rireme ,Conrt of the United States, and reversed ; and. three years rigo.seven cases were tried in the United States Circuit Court and verdicts given in Mr. Battin's favor. In' liter the patent was extended for .seven years. The different parties using the machine in Sehuyikill county entered into nn arrangement with Mr. It.. by which lie was to receive one cent for every ton broken.' The defendants, however. whose collieries are in Lehigh and Carbon empties. refused to pay this sum alleging, among other thin ea , that the machine now used by them is different from that of Mr. Benin, in that It has "point coming opposite point." and not point enmintoppettite viteantspace, as in Mr. We specifica tion._ To this the plaintiff answers that, in the machine seed by the defendant, Winn teeth are placed between large ones, and that, as the temper coal cannot, by any possibility, exactly fit the space thus canned, the .laree teeth must necessarily break the coal when oppo site a vacant sPaCei The testimony yesterday was of it lengthy and tedious character. The case had not been concluded at the ad leurnment of the court. DISTRICT Counr Judge Shorewood. —J. L. Lounsbury vs. A. M. Eastwick. Austin Allibone says "The invaluable recem mendationsof this noble volume appear to be: great typographical beauty and neatness; the Incorporation of many terms heretofore retarded as entirely technical, but within the last taw yeareof considerable currency in (+consequence of the multiplication of scientific hand books and public lectures on special topics of cosmology, ethnology, natural history, kr.; a remarkablattilluencie in the etymological and defining departments; the ex treme oare observed in guiding the inquirer to a cor rect pronunciation; and the position of synonyms and illuAtr ,, tions in the body of the text saving all trouble of reference." Prof. Charles IL Cleveland, in .the " Compendium of American Literature," says: " It is at length announc ed that the great and long-promised Dictionary of that learned and veteran lexicographer, T. E. Worcester L.L. D., will be ready in October, 1869. It will Its em bellished with pictorial illustrations, and, as a whole, will in fullness, in consistent orthography, and in cor rect orthoepy, be in advance, doubtless, of anything o the kind we now have." Prof ,Heo. Allen says: "The familiar use for many years of two of Dr.Woraester's Dictionasiealias made me snore and more disposed to put my confidence in him aa a sure and safe guide in the domain of English Lexicography He has always remained trite to the conservative twin-. ciplee which guided him in his first publication—the edition rf Johnson and Walker comlnned. in 1829. His works everywhere exhibit competent learning, a con scientious love of accuracy, systematic, unPormitY without extravagant innovation, and never-failing good sense and sobriety of Judgment. The specimen sheets of his new Dictionary give satisfactory assurance that the mature results of Dr. Worcester's life-long labors in lexicography are to lie exhibited in the most perfect form, in combination with the advantages of an illus trated technological vocabulary. Geo. ALLEN, rfOreBSOT of Greek and Latin in the University of Pennsylvania. September 20,1859. I concur in the opinion of Prof. Allen as expressed above. Wm. H. Maxi. President Girard College. Rev. Dr. Boardman nos: Woroeeter'e Dictionary is one of my Indispensable table books. I particularly like it—l. Because of its very comprehensive character. 2. Because it adheres to the accepted orthography of our noble language ; and, 3. Because in the department of pronunciation it is greatly superior to any other Dic tionary with which I am acquainted. The new quarto edition promisee to be all that could be desired in a work of this kind. Irrinir A. BOARDMAN. PII ILADELPH u, Sept. 27, Hon. Edward Everett BIM " I have made constant use of Mr. Worcester's Dictionaries since their first publicatmn. His orthography and pronunciation repre sent, so far as I am aware, the most approved usage of our language. His dcsnitions seldom leave anything is desire." Hon. Geo. Bancroft, LL. D, goys "On questions o orthography I shall Make it my standard, allowing my self rare deviations, or, perhaps, no deviations what ever." THE LIBRARY EDITION will be ready in Novem ber, and will be sold only to S IBSCRIBERS. It will be printed on extra fine raper, and bound in half Tur key morocco. The price will be 47.50 per copy. AND PARLIAMENT OP ENGLAND DURING THE REIGNS OP EDWARD SIXTH , AND ELIZABETH. BY SAMUEL HOPKINS. Royal Bvo Vol. I. $240. The Puritans have at last found a historian adequate for his work. Mr, Hopkins unites thoroughness of re search to a style of singular f - scination; and his dra matis narrativeand life-like portraitures of the preach ers, nourtiers, and popular leaders of one of the most stirring periods of English history will secure a multi tude of admiring readers. The book has all the charm of a romance, while developing with great clearness and forge the origin and growth of Puritanism. " It will ben most valuable nu it is a needed, addition to the history of the great Puritan movement in Eng land, which is so vitally connected with the religiong, and civil Minor) of our own country. No work on the subject brings out so faithfully the nausea and bonringeof these great event' ; and they are depicted in such lucid and yraphio order as to interest readers of all claeses."-11Ennr B. SNIT'', D. D., Union Theo!, Seminary, N. Y. In my judgment the work possesses all the qualities requisite to insure, if published, a wide circulation and, when completed, will furnish, I doubt riot, the most vivid and valuable ,representation of the early Puritans In our language. —ALVAH Hovey, D. Mr. Hopkins has brought to hie work the spirit of high appreciation, of candor, and of conscientiousness. lie hag been atient of that laborious research and keen scrutiny of pop u lar views and accepted relations which alone can discover and rectify any current errors. As his work is one of the fruits made possible for tax by the zeal with which annals of Hinespast have been re corded in various places so its faithful digestion of all existing materials will largely help to the writing of General History for the time to count.
