Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennfylvama, in General Assembly met, and it is hereby enacted by the authority of the fame,"Vhat it any person lhall, after the -passing of this aft, take possession of, enter, intrude or fettle on any lands with in the limits of the counties of Northampton, Northumberland, or l.uzerne, by virtue or under colour of any conveyance of half Ihare right, or any other pretended title not derived from the authority of this commonwealth, or of the late proprietaries of Pennsylvania before the Revolution, such perion, upon being duly convifled thereof, upon indictment in any court of oyer aud terminer, or court of general quarter fefllotu, to be held in the proper county, lhall forfeit and pay the Cum of two hundred dellars, one half to the use of the county, and the other half to the use of the infor mer, and lhall ajfo be fuhjeft to such imprisonment, not exceeding twelvemonths, as the coyrt before whom luch conviction is had may in their discretion direct. Sec. 2. An<tbe it further epafted by th» authority afore faid, That every person who lhall combine, or conspire for the purpose of conveying, pofl'effing or fettling on any lands within the limits aforefaid, under any half ihare right or pretended title as aforefaid, or for the purpose of laying out townships by perfo.is not appointed or acknow ledged by the laws of this commonwealth, and every per son that (ha 1 be accessary thereto, before or after the iaft, flmll, for every such offence, forfeit and pay a sum not less than five hundred, nor more than one thousand dollars, one half to the use of the county, and the other half to the use of the informer ; and lhall alio be fubjeft to such imprisonment at hard labour, not exceeding eighteen tnonthy, as the court in their discretion may direst. Sec. 3. And be it further enacted by the authority a forefaid, That the court wherein any such conviction ftiall Jiave been had, lhall iffuc their writ 10 the ffiertfl of the county wherein the said offence has been committed, or the said conviftion,had, or.it the said court lhall be of o piaion that the Iheriff or conner are not impartial, then to any other person or persons they may think proper, commanding him or them, together with the pewer of the county, if he or they Ihould judge their affifCance ne cessary, to proceed totheJandsijiquetlion, and therefrom to expel and eject all and every the person and persons thereon intruded as #forefaid ; and if the said (heriff, or other person or persons appointed asafoj-efaid,lh«uld make return to the said writ that he or they have been unable to execute the fame, by reason of the forcible refiftancc of the parties or any other persons, or from a just apprehen sion of such rcfiitance as wouldrender the execution there of by himfelf or themselves, and the power of the coun ty, impracticable, the prothonotary of the court to which such writ is so returned lhall forthwith transmit a copy of the said writ and returp, under-the seal of the said court, to the governor, and if upon the said return, or if upon a certificate signed by the president, or one of the judges of the court of common pleas of the proper county, or /by one of the judges of the fupremt court, that the pro cess of the court has been refitted, or that ther* is realon to believe that the civil authority will be incompetent to the execution of thi- law, the governor {Hall deem it ex pedient to order out a portion of the militia of this ftatc to assist the civil authority in carrying into effect this aft, or any part thereof: Th? detachments so called out lhall receive the fame pay and rations, and be fubjeft to the fame rules and regulations, as are provided in other cases. Sec, 4. And be it further enacted by the authority a forefaid, That if a judge of the court of quarter feflions for the proper counties, or a judge of the fjjprerac court lhall apprehend that the (heriff and coroner are not impar t al, it'lhall and maybe lawful for thefaid judge to direst the venire for the grand inquest, afid for the traverse jury, to any person or perlons he or they may think-proper. Sec. J. And be it further enacted by the authority ' aforefaid, That if any person or persons shall refill any officer, or other person duly authorised in the execu tion of this aft, or any part thereof, every person or per sons so offending, and every person vhat ftiall be accessary thereto, before or afterthe fact. (hall, op conviction, for- , feit and pay a sum not more than five thousand nor less than live hundred dollars, and undergo an imprisonment at hard laDour for any period not less than three nor mare i than seven years. Sec. 6.
