Since the abovi; was written, we have pro cured the opinioti . ; of Mr. Tower, the Prosecu ting Attorney of Sehfiylkill County, delivered for the benefit of the County Treasurer. The opinion sustains our Vil!IVSp of the provisions Of the new Liquor 'LaW; and we ask for it an attentive perusal Tio: recent Act, entitled "An Act to restrain the sale •of intoxicating Liquors," says. in the first section, "That trim and after the first day of Or to her next, it shall be uhlita Cul to keep or niaintlia boorrs. efp.re,l parr ; 11 here vinoio, spiriLllol.le, malt or brewed liquors, or'any admixtm es thereof, "oaf! ~ l drank," excepted us thereinafter pro vbied. , It i- notianywhere in the said act provi ded that any such iodise, room or place may. un- • der any circumstances, he kept or taainbiined.— I The second section prohibits any person "tit keep for sale And sell," "fly' any inlifasurc whatever," and at the same time furnishiany -canyenienee or indueetuent for wrinking sue y liquors, - or any ad mixture thereof. ,Therc two sections, and the next folfew ;ng one, all have evidently but one object, that [ is,--ro till J tiiirctv, where , the said liq Mir, or adinixtUTC: , thereof..may be, at the saute time. sobi The 'mirth section of the. Act says, "that it shall be unlawful for any pettom to evil ur keep aloe ionic any" of the said liquors, or any ad mik turds thereof, "ill any rrt,rt 8 nor hcreiill” : 10), 1 11,- hio , 4 c , 101, g nanfit,y Shari tair'i i rrirrt, nor with out license granted by the Court of Quarter Ses sion_ of the proper County." Tic design of alit. e.ction appears to have• been to prevent s'i,c colt , nor been before prohibited; except when connected with a place to drink in) of the said liquors or any admixtures thereof, by 'neji.-1 body t,'.4. than C vwrt." That this was so. and that the restraint of this section was a einnotativo one upon those imposed by the'', three preceding sections,,is evidenced hy the see- I , Oad proviso to the section, to wit:--"That nr, li thr the;sale of liquors as aforesaid, shall he! granted to the keeper of any hotel, inn, tavern, restaurant. eating house, oyster house, or cellar, theatre, or other places of entertainment, amuce ment or refreshment. The ( I .seprof the law is, then, to extinguish ev ery house, rebut, or place, in which liquors can, front :cud alter the first -day of October next, be rad cud drank, and at the same time to restrain every one who would tell--before and on the first day . of 'October next, to he drank where *old, anti "from and after" that day. to be carried away -from the place of sale—to selling not a less quantity than one quart. nor without licenre grant ed by the Court cf.Quatter Sessions or th? proper Counly." True, there is an exception, in the twelfth section, ill favor 9f ;importers,. duly coup.; mis:ioned auctioneers, "dlioimestie producers, brow; err or distillers. sei'ling in quantities not less than live pitons: . awd druggists: and the fourteenth sehion provider that the: t act shall not interfere with the IthteKpire,i term 4.)1' a IIeCtINC, which was "ranted before the passage of the act. But with these enumerated exceptions only, tiro effect of the law runt be as above rtatcd. A question 3rires here, as to whdit the restraint. in regard to s ! fairig not "in a less quantity than one quart, nor without license granted by the I Court of Quarter Session of the proper County," is to take effect. In my view, it is to take effect immediately. The whole art is to take effect . inn "mediately. • It tolerates "illooller, roans* or place*. , ' where liquors may be " l ad and drank," until "from and after the first: day of October next." and then (doses them an to "1,11 5 measure tehat r ter," except for the unexpired teem of any license already granted. o. But'it dots not tolerate the sell-, mg, except for the unexpired term of such license. "in a less quantity than one quart, nor without li cenSe granted by t h e Court of Quarter Sessions of the.proper county," for one moment after its 'pas sage. On the contrary, and as if designed to show that it was to go into ,effect forthwith, the very first section of the act declares that "all laws. or parts of laws, inconsistent with the provisions of (hit; act be, and the same ure hereby repealed!" Repealed when? Not "from ,and after rho first day of October next," but instantly. This view of the net appears to me to be sus tained alro, by the prollsions it contains in regard to licenses: The fifth section directs the Court, to fix a time - for hearing applications for "rind that, and the next five succeeding sectiuna I which relate wholly. to the subject of licenser, are; 'all founded upon the averment in section 4, "that it shall be unlawful" "to cell or kee7p for sale," "without license granted by the Court of Quarter Sessions of the' proper county." "All laws or parts of laws inconsistent with the previsions of this act." and of course then, all laws relative to iihe granting of licences, except "by the Court of Quarter Sessions," were, as we have seen, repealed by the first section. As if, however, to put the Setotions of the proper County, grouted, in puma ati've of this. new restraining law. - • The couclehlotts I have eotne to, in' , regard to this new'Act, are different tiout my first linlico ei(Me about it. The tenants were forced to make all the im provements themselves—they would not 'even erect a sufficient number of !Miners' Houses for the aceomwdation, of the Miners. The tenants we learn have expended upwards of one .hundred and fifty thole and. dollar., on these lands. Expenses of ;about $25,000, which properly belonged to' thh landlords, had been incurred by the tenants, in an important improVement, and after great importunity they agreed to leave them take 1 ,515,000 of the ' amount out of their rents When they. mined the Coal. They have pocketed rents from these lands We learn' amounting to 'upwards of two hundrd thousand dollars—tind now, find ing'that the, Coal is pretty well worked out of the upper levels—they want a charter to sell the land in stocks, at $750,000, and pocket that npionnt also; and the stockholders may then make the improvements themselves.
