The following is the opinion of Judges Bell, Eastman, Gil christ and Woods:. 1. The Nit:orders on justices an extent Of authority the Constitution does not sanction, particularly in respect to the power - it gives them to pronounce a sentence of forfeiture of liquors seized fora violation of the Law. IL The Bill provides for no trial _by jury, or for appeal and trial by jury before a high er Court. The Constitution provides that in in all controversies concerning properly, the parties have a right to a tnal by jury. 111. The- seventh section of the aci con filets directly with the Constitution of the United States. This section provides that no action can be maintained in any Court in the State, either in whole or in part, for in toxicating or spirituous liquors sold io any other State or County. ,No law of this State can deprive a citizen of the United States of the right .to enforce a claim of debt before the tribunals of the State. •1 00 - 83 60 500 - 800 3 00 IV. Liquors are property. The:law in cognizing them as such in the fourth section, when in the hands of town, authorities for sale and mechanical use, cannot, by the force of a few phrases, make property lose its cha , meter when in other custody. V. Double at` - increased penalties in' cases of conviction under appeal, beciuse it oper ates as a penalty' upon the party claiming appeal, conflicts with his right to an appeal, and cannot be supported by the Constitution. VI. The Bill is designed by its provisions to .demand excessive bail and render it diffi cult for the accused to procure , sureties.. it had beeu added that the accused should not have the benefit of counsel to defend him, the parallel between the present law and the practice in England in former days, would have been completed. VII. The conviction of a principal thro' any act of one agent, is held to be unconsti tutional. - The accused should be confronted with the witnesses against him, says the Constitution; but the Liquor Bill says no, and is therefore opposed to the constitutional rights of the citizens. VIII : The people have a right to be secur ed against all unreasonable search of their dwellings, and all search-warrants must be under oath. according to the Constitution; but searches and arrests may be made accor ding to the bill without Warrants on oath, and it is thus unconstitutional. In conclusion, the Judges state that some of the objections are of the moat serious cha• racier. The Philadelphia News notices the pro gress on thisload, as follows: We learn on authority which is entire ly reliable.' that the Cattawissa Railroad Company have entered into contracts for the building of their road from the town rof Cat ! tawissa, Columbia county, to Tatpaqua, Schuirlkill county, or within some five miles of tha( point, and that contracts have also been made for the construction of the road from Tamaqua to Beaver Meadow. The funds' necessary for the construction of both theselinks have been raised in New York, where The stock of the Catawissa Company is now mainly held, and the par ties who have taken the contracts, we are informed, are entirely respopsiole tor the prompt progress and early completion of the work. The present object of these movements is doubtless twofold, the stock being principal ly held in New York, one object is evident ly to secure the coal trade of a portion of the Schuylkill fields to that city, whilst the oth er, doubtless looks to a conversion of the Lake trade to be reached by the Sunbury and Erie road.' The. Gap, from Easton to Beaver Meadow, we are also informed, is now being occupi ed by the construction of a mad, which, it is said, promises in' early completion. This will give a continuous line, except the cross ing of the river. at Easton, from New York to Tamaqua, Catawissa and Sunbury.
