This is certainly a very bcautifol and excel
lent pear, and worthy the attention of pear
growers.
Pittsbuboh High Fraooi —The first session
ct this institution was opened yesterday. Ooe
hundred and fourteen scholars from the different
ward schools were in attendance, and wero eu
rolled as pupils. Previous to opening the School,
Prof MoEeowu delivered a very interesting ad
dress lu presence of the Board of Education.

Clarke tb. Henderson: action of trim con.
This was an action brought by plaintiff to re
cover‘damages from defendant, for an alleged
criminal connection with his wife, bat the pro
secaUon failed to make oat a case, and the jury
returned a verdiot for defendant The defence
did not hare an opportunity to present their tes
timony, bat they allege that they conld have
shown that the prosecution was a clear attempt
to extort money. Mr. Henderson was a con
tractor ob Section 9 of the Allegheny Valley
Railroad at the time the occurrence Is allcgeJ
to have taken place, and Clarke was In his ser
-vice as a laborer. The parties both reside at
Hatfield, near Lawrtooerille. In 1863, Claike
first made the oharge against Henderson, and he
was arrested, tried, and convioted before the
Beeßlons, of adultery. Afterwards, evi
dence that oonld not be prodnoed upon the trie),
was procured, showing his entire innocence, and
a pardon was granted by Governor Pollock. A
portion of this testimony consisted of an affida
•vit from Mrs. Clarke, in whioh she stated that
*Clarko had offered her $6O to make the ohargo
•ftgftinnt Henderson, and that the object of tbe
prosecution was to extort money from him.
After bis liberation a seoood suit for damages
was Instituted in the Distriot Court, and the
case oame op on Monday, when the falsity of
tho oharge was ag in shown. The prosecutor
was ordered to pay oosts.
Coleman vs. MagUl: by consent, motion for a
new trial withdrawn.
Playford vs. Express Company The Court
extends the time for filing an affidavit of defeoco
io the first Monday in November.
Baker & M’Kenney vs. A. Kirk Lewis: G. P-
HamUton for plaintiffs; Selden & Wm. M’Oand
less for defendant; —aotion to recover damages
for the loss of a ooal boat in tbe Ohio river, by
coming in collision with bo&tB belonging to do
fondant, moored along shore. Ou trial.

Mr. Moorhead offered a petition for gas lamps
•on Liberty street, between Fourth and Third
ots. Bead and referred to Committee on Gas
Lighting.
Mr. Kennedy read a reaolntlon directing the
Mayor to draw a dnolioate warrant in favor of
Win. Paul for $28,86, in lien of one dated Sept.
1866 No. 768, and mislaid or lost, provided be
give’bonds to indemnity the city against loss.
Resolution passed.
Mr. Irvin presented a report from the Market
Committee together with an Ordlnanoe for the
better regulation of the Diamond Market. 8- -
port aooepted and Ordinance read three times
and passed.
The business passed on by the 8. C. was tak
-en up eonourred in and Counoil adjourned.
Ms. Wu. B. Bcaifb, First street, between
Wood and Market, has for sale a new and beau
tiful ware for household purposes, called French
Stamped Ware, without seamß. All kinds of
utensils, such as ooffee cups, sauoepans, ladles,
Ac., are made from it. Thoae who have need
the new ware represent it to be an excellent ar
ticle.

day evening, three men named Williom Kano,
Biobard Jones and James Flood, were arrested
for disorderly oouduct on the streets and con
fiuod in the watoh bouse. Shortly after, John
Flood, a chum of the prisoners, through the
carelessness of the police, obtained acoess to the
hall of the tombs and forced open the look of the
cell with an iron bar; learirg at liberty iLo
whole party. However, about ten o’clock, tho
whole four wero again arrested f\t a house id
Prospeot street, and re committed to the tombs.
Yesterday morning they wore brought before
Mayor Volx, who fined Fiood $26; Kane $5;
and each of the others $l5.

for more than passing notice, and one like 'bin
wo now refer to, viz: the production of Conrad’s
play of Jack Cade, oa Monday evening last, by
Mr. Neafie. There almost seems temerity in
any actor to attempt any of the plays which
have long been identified withi the name* of
Forrest aud Addame, but we are impelled t
pronounce the performance ou Moodoy evening,
by Mr. Neafie, as one faliiug nothing tbort of
tho two great originals, it was at onoo vigor
ous,-bold, tender and truthful; and drew forth
prolonged plaudits from one of the largest au-Ji
euoes we have ever seen assembled within tbo
walls of our theatre. In fact many cf the higb

admission, and this is the reason (hat ihi* ready
great play will be repeated to night We applaud
the courage and entorprUo of Mr Nestis in pre
senting this play, because beib of the men we
have above named are either dead in reality or
