This was an action brought by plaintiff to re cover‘damages from defendant, for an alleged criminal connection with his wife, bat the pro secaUon failed to make oat a case, and the jury returned a verdiot for defendant The defence did not hare an opportunity to present their tes timony, bat they allege that they conld have shown that the prosecution was a clear attempt to extort money. Mr. Henderson was a con tractor ob Section 9 of the Allegheny Valley Railroad at the time the occurrence Is allcgeJ to have taken place, and Clarke was In his ser -vice as a laborer. The parties both reside at Hatfield, near Lawrtooerille. In 1863, Claike first made the oharge against Henderson, and he was arrested, tried, and convioted before the Beeßlons, of adultery. Afterwards, evi dence that oonld not be prodnoed upon the trie), was procured, showing his entire innocence, and a pardon was granted by Governor Pollock. A portion of this testimony consisted of an affida •vit from Mrs. Clarke, in whioh she stated that *Clarko had offered her $6O to make the ohargo •ftgftinnt Henderson, and that the object of tbe prosecution was to extort money from him. After bis liberation a seoood suit for damages was Instituted in the Distriot Court, and the case oame op on Monday, when the falsity of tho oharge was ag in shown.
