Bunch Wakbant John S. Wolff was arrested yesterday, on a hooch warrant, and taken before Jndgo Adams, of the Court of Common Pleas, on a oharge of attempting to defraud John Bohcuetctt out of $lO. Tho oiroumatances of the oaso are as follows: A few days ago, Soheuaten obtained judgment against Wolff, bo fore Juetloo Hageman, of Birmingham, for the amount above stated, and whona levy was mado no property could be found. Tho plaintiff al’ leged that defendant had fraudulently ooncealed his property, and sued ont the warrant. David Keod, Esq , appeared far Wolff', aud contended that aooording to tho eot of 1842, a bonoh war rant oan only be issued for persons who have commenced Bust, or obtained judgment in n Court of Records, and must apply for a warrant to a Justice of the Peaoe, instead of the Court of Common Pleas. He, therefore, moved to •quash the whole proceedings. Mr: Conoghan replied for tho plaintiff, that as n transcript of judgment had beon filed, it was now a judgment of n Conrt of Rooord. Jndgo Adamß, howover, took the same view of the case as Mr. Iteed, and discharged the de fendant. Thus far, vory little interest has been eioitod In tho ranks, and unless our firemen stir themselves tho ooming parade will be a failure. Tho truth is, tho department is weak, especially in the oarer Wards, where there is just enough spirit mini foatod to keep alivo the organizations.
