This is the first oase in our Courts presented under the late Act of Assembly. The offence is alleged to havo been committed on the first of April, the day on which, the Act went into operation. Tho defend ant keeps a lager beer house on the cornor of Smithfieid street and Virgin alley, and the suit was brought by Watohmau Johnson, who, pass ing the house on the night above stated,’heard considerable noise in the bar-room. Placing' his eye to_ the key hole, bo observed a number of persona insido seated around a table drinking. While endeavoring to effect an entrance, a man, ■in an. intoxicated oondition, was thrust out of the back door of the establishment. Considering this strong presumptive evidence thet the pro prietor was selling liquor contrary to the statute Johnson arrested tho drunken man, and next day Qaae information against Lenze. r„. The first witness called was the intoxi cated individual arrested by the watchman ; but as he swore positively that ho procured the beer which he drunk without the knowledge of Lenze and Without paying for it, the prosecution broke down from the BtarL Watchman Johnson was next called, but os he did not get into the bouse nothing could be proven by him The defence on their part, shewed by the testimony of several. Witnesses, that no beer bad been sold on tho premies during the whole day. The jury, there fore, after an absenco of but a few minutes ro turned a verdict of not guilty. ’ A bEVEB* Rebuke—Miss Crampton con cluded quite a successful engagement at our theatre on Saturday night, ou which occasion she appeared as Riobnrd 111 and the French Spy Between the pieces, after being loudly called for, she came forth and made an excellent speech of about fifteen minutes duration in which Bho administered a very caustio aud cut ting rebuke to the local of the Dispatch, that paper haring seen fit to criticise her performan ces and personal appearance in an extremely shabby manner. The lady said the reporter’s remarks wero not a fair criticism, but were dic tated in malice. He resembled a toad in a hole, spitting hih venom on all around, until he was himself covered with the vile stuff. This part of tho performance not being down in the pro gramme, was greeted with immense applause by the audience, many of whom, doubtless, had suf fered themselves from these malicious attacks of the Dispatch reporter The language employed although perfectly refined and lady like, was the severest and most pungent we ever heard from female lips. The Thbatee.— Mr. Couldock appeared to a fair audience, in poim of numbers, last night, and was received with an enthusiasm which showed that few ectore have a firmer held on the affections of our play goers. The character of Robert Tyke, in whioh he appeared, is one in which Mr C. compels all to testify their appro bation; like his groat part of Lake Fielding, ho baa no equal in it.
