for plaintiff ; • Alden for defendant. This action
is brought against defendantoeand John Boyd,
on a promissory note signed by both of them.
Judgment was entered by default some two years
age, and was afterwards opened as to Margaret
Boyd, on the allegation that she was a married
woman. and the note being given for a debt due
by the husband, John Boyd. The defendant
proved that the note was made after the mar
riage of John Boyd. A verdict of 5129 77 was
rendered for plaintiff, subject to the opinion of
the Court on the points reserved, which involves
the question of how far, under our recent sta
tutes, a married woman can make contracts.

Shaler for defence . Plaintiff claimed
WISS 63, as wages for his services in bottling

amount he had obtained an award of arbitration,
from which defendants had appealed. After
progressing some time in the trial, the Jury was
discharged, and defendants withdrew their ap
peal from the award, thus leaving the award to
stand an originally made. Considerable sport
was occasioned to the audience during the trial,
by amusing descriptions of the manner in which
sour porter was converted into sweet, and mak.

Tswana—Manager Foster, at the urgent so
licitation of many of our old theatre-goers, who
were so well pleased at its representation the
first season the Theatre was opened under the
charge of the present manager, since which time
it has not been performed here, has concluded
to place on the stage again, the great American
comedy of "Changes." This piece, wherever
it has been presented, has achieved a success
only commensurate with its merits. It abounds
with many beautiful passages, excellent senti
ment, and dramatic effect. It has been in re
hearsal for several weeks, which is a guarauty
that lie. Foster is neglecting nothing that ia ne
cessary-to insure an effective representation.
The Theatre is warm and comfortable, and we
know of no place where a person can combine
pleasure and instruction better, than by ping
and seeing "Changes" to-night.
STABBING AFTAIH.—.9 fracas occurred yester
day afternoon, in the Ninth Ward, in which a
young Mau named John Law was severely
bed by a negro named George Grant. It appears
that a difficulty bad existed between the two for
some time past. Yesterday afternoon, meeting

into a wordy altercation ; Law, at last, loosing
his temper rushed into the shop and seized a pair.

Concert of the Metropolitan Serenaders will be
given this evening. This is the last opportunity
ottr citizens will have to hear these excellent
Minstrels, and we hope to see Masonic Hall
crowded upon the occasion. The burlesque on .
Monsieur JuMelee performances is decidedly
the best thing of the kind ever gotten up. and is
alone worrh the price of admission. Johnny
Booker, the bone player, is inimitable, and bee
a budget of new and original jokes for every
night. Monsieur Blank, thtrprinoipal violinist,
is a musician of real scientific attainments, and
excites the applause of the most critical. Go
and see them, by all means, they are well deserv ,
ing of patronage.

zember bas come to hand, and is the best num

Brown, who was employed as a !tailor, in the
:Fifth Ward, on Wednesday deserted his wife and
'eloped from the city in company with a young
girl, to whom he hod previously been paying
more attentions than were proper from a married
man to any woman who was not his wife. Be.
fors leaving, he drew from a broker's office, or
bank, seventy dollars belonging to .his brother,
which he need to make his escape with. The
scamp leaves his wife in a very destitute condi
tion, with, we believe, a family of children.
BIIROLART.—The dwelling house of Mr. J. B.
Canfield, on Penn street, near Wayne, was en
tered by burglars on the night of the 6th 111.4.,
and between thirty and forty dollars in money
stolen, together with a check, drawn by Lippin
oott & Co. on e Citizens' Deriosit Bank, in this
ity, for $6OO, the
dated December 6th, 1854. The
villains gained admittance through the kitchen
windows by prying off the shutters, after which
they went to the bed room of Mr. C. and aortic('
off his pants, in the pockets of which they found
the articles above referred to.
