Cholera is more fetal in Boston at present than in any other city in the Union. For five days ending the 10th inst., there were 217 deaths from the disease. A grand complimentary feetival for the benefit of Mr: sod Mrs. W. J. Florence, is to come off to-morrow evening, at Niblo's Garden, New York. The arrangments for the occasion are in the bands of several prominent men, among whom are F. - A. Rol lins, of the United States sloop-of-war Cyane, arrived hero on Tuesday evening, and had an immediate interview with the President. From the same source we also learn that Governor Bart will take,his departure for Nebraska in ten days: COSIDIERCIAL There seems to be a reasonable supply of mo ney here, but it requires unexceptionable paper to draw it out; and heavy rates of discount are submitted to. Our millers find it difficult to get wheat as fast as they want it, and the stock of dour in this market is very small. But, although the facts stated by the herald are undeniable, its conclu -sion that a crash must come is not a necessary result, and we do not believe it. The amount of money in the country is constantly increasing, notwithstanding the exports or specie. It will probably be increased in a twelvemonth, ending on the lst.January, 'bb, from forty to fifty mil lion dollars. The mining accounts from Cali fornia are favorable. The yield of gold is as large as ever, and the number of misers larger than in previous years. The arrivals of go'd then will be greater than in former years. We learn that the Finance Committee of the Pennsylvania Railroad Company have determin ed, as fares practicable, to suspend, for the pre sent, all farther contracts for new 'construction work ; and that there is good reason to believe that the Directors of the North Pennsylvania Railroad Company, at their next meeting, will adopt the same policy. This course having been already adopted by the Reading Railroad Com pany, these three great corporations will cease to be competitor against merchants for the pur chase of money inducing thereby the moat ex orbitant rates ; end if their example should be followed by other improvement companies, and business men generally would adopt a system of rigid curtailment the community would soon be relieved from the pressure which now prevails. The ruling rate of interest in Boston is twelve per cent. For first class paper, however, there is money enough both in Boston and New York. The eastern merchants are expecting a very large western trade in the fall. The ,large amounts of money sent west for grain and pro visions, at high prices during the last twelve months, it is supposed, will lead to much heavier purchases of eastern goods this fall. In Cincinnati the current rate is 12 per cent on good commercial paper, and from 15 to 20 on railroad paper. We would adviee holders of notes of the In diana Free Banks not to be in haste to submit to a sacrifice. The Cincinnati Brokers may be mistaken as to the value of the money. If the report of the State Auditor is correct the money of their banks ie secured by sufficient stocks deposited. Send the money home, however, as fast as possible. Its credit is damaged. The cinedisati Price Current charges the Cincinnati Brokers with a fraud in this matter. Here is . its language " The rumor, started by the Cincinnati Bro kers, that the Rensaalear Bank, . and the State Stook Bank of Peru, Ind., had failed, was done with a knavish and malicious intent. The ob jeot was to create a panic among the holders of Indiana bank notes, and induce them to guff* a shave ; and at the same time to cause a run on the balks for specie, and the scamps have sue seeded to their heart's content. Large amounts of the paper of that State is in circulation in Ohio, scattered among the mass of the people— almost every man has more or less of it in his possession. To add to the panic, the Ohio banks have refused to take Indiana money, and the brokeis quote it at 95 cents on the dollar. Sim , pie minded people , became terribly alarmed— confidence is gone, and every man who has a del larin his ponsession—partionlarly the laboring . classes—make a rush to the " shavers "to ex change their Indiana bills for money of other States. Thousands of dollars in this city changed hands at a ruinous shave. The swindle succeeded, and they have, it appears, midi a grand speculation out of it. They bought large quantities of it at a shave as high as from fifteen to twenty cents on the dollar. Let every man sue; and he can recover his money with costs. A thousand or two suits of that kind would re duce their profits, and punish them suit-ably for the conspiracy. We ern not advocates for banks, but we like to see a swindle punished. It is the Cincinnati brokers that can be made liable. Brokers in 'other °Wee, who were no parties to the combination could not be hel liable for a shave. We hope the Cincinnatians who have angered will try it. It will succeed, if the statement we refer to is correct. NEAULT A FATAL CATASTROPHIL—On Wednes day morning, while a party of five hundred men, women and children, belonging to St. Paulo C.) Church, Philadelphia, were about starting on a pie-nit, they met with an accident which ;'wee likely to prove fatal to many, but fortunately only "dampened" the spirits of a portion of the party. - They were standing on Almond street wharf, ready to embark on the excursion steam er, when about one hundred of the party got on the slip at the end of the long wharf, and the structure gave way in the centre. Upwards of fifty, mostly children, were precipitated into the water, which was only some three feet deep. Fortunately the steamboat was lying at the wharf, as it prevented a number from rushing into the river, during the first moments of ex citement. A large quantity of eatables went to the bottom, and five or six cab loads of the ex. enrsion party returned home, feeling thankful I perhaps that none of them were soriously hurt. MINION BY WM= J. alioti This is a motion for a preliminary iejoni founded upon a bill of complaint entered by the trustees of this religious !society, alleging fist they base been in a disorderly and unlawful manner excluded from the possession and matt agement of the church property, and hindered in the performance of their duties by the defend ants, who are, or claim to be, members of the said sooiety, and to be acting on its behalf. The object of the bill is to settle the right of the re spective parties by a final decree; and the ob ject of this motion is to put and keep matters in the position in which they stood before the dis order commenced, and to prevent the defendants from gaining any advantage by their own wrong ful acts .c 13 not necessary to decide, lu order to main- Lain this form of proeeeling, that this ease falls within the class of irreparable injuries; and if it did, that would net give original jurisdiction to this court. But we have the supervision and control, in the equity form, of private corpora tionrts s ; and this involves the power of issuing all so of process necessary to effectu ate that con- trol. The plaintiffs are a religious association in corporated under the act of 1791, which allows any persons, whether church members or not, to be incorporated for religious purposes upon terms and principles declared by themselves. These terms and principlee are expressed in their charter, and are the law of their association. Following out the free thought of the act of Assembly, the society, es incorporated, consist of "Church and congregation, ' or those who ate full members of the spiritual society and those who are only pew holders. "The Church," therefore, comprises only a portion of the mem bers of the inoorporated society, and must be so regarded here. By the articles of union set out in the charter, the trustees are the representa tives of the incorporated society, and bold the church property for its use, and of course sub ject to its directions regularly expressed. They receive the income of the incorporated society, and apply it for the maintenance of the Gospel. They alone can represent it in making contracts, and from it alone they receive their instructions, which are not expressed in the charter. A meet ing of the church ntembere, as such, is not a meeting of the incorporated society, and it can not instruct the trustees iu their duties or assume any power over them. It is not disputed that the lest general elec tion of trustees, in November, 1853, was regu larly held and conducted, and five of the com plaining trustees claim title under that election. But a vacancy of two trustees is alleged to have occurred, and on the 28th February, 1854, two others were elected in their stead._ Judging from the church records, this epecialelection seems to have been regular; but this is disputed now. The question, however, is not important at present, for it is not denied that the two per sons then chosen have acted and been regarded se trustees ever since, until the outbreak of the present difficulty, and without them the other five trustees, undeniably elected, could present this complaint. Then, what excuse have the defendants for in truding upon the trustees, and interfering with their functions' Ido not inquire whether or not, all the defendants participated in the let I complained of, for it in not necessary in this preliminary proceeding. It isedmitted that some of them committed the act of intrusion, and are sill maintaining their position, and the inquiry is whet justification have they' They offer none except the resolutions of a re gular church meeting, that is, a meeting of the communing members of the church, which was not and did not profess to be a meeting of the incorporated society. it was held the 29th July last, and nothing could be more irregular than its proceedings. If it wan a corporation meet ing it could not exclude persons from church membership ; and if it was a mete church meet ing, as it professed to be, it could not control the use of the corporation property, or direct the trustees, or create, or remove any ; and yet all this, and much more of the same incongruous eheracter,.was attempted to bo done. They think they are justified under the Bth article of the church discipline. But this article is the creature of the church members, and can be altered by them at pleasure. The incorpora ted society had no hand in making it, and cannot by it be excluded from their chartered rights. They think that the (mom of Baptist churches authorise the proceedings of the meeting allud ed to. But, as Baptist Menthes are wholly la de pendent of each other, the customs of one, or many of them, can furnish very little aid in judging of Globe of another. Besides this, the customs of church meetings cannot take away the chartered right of the incorporated society —the customs of one portion of the society, cannot as, such, deprive the other portion of its rights. The meeting of the 29th July, was plainly dis orderly and revolutionary. liven if it had been a meeting. of the incorporated society, perhaps it could not thus have set aside the legal true trees, if they reit:teed their assent. There is no need of such a disorderly supposed rights; for there is of mode a their a e re bt gular g mode -provided by law for compelling trustees to per form their duties to those whose interest they represent. The proper corporation records are now in the bands of the trustees and will remain there. We should have nothing to do with the church minute books, were it not that they alone con tain the original evidence of the corporate mem bership of those, whose corporate member ship depends upon the fact that they are in communion rim the church. On this ground, however, the corporation has an interest in them. One of them was violently wrested at the meet ing of the 29th July, from Samuel Bargesser, who up to that time at least, wan the regular clerk of the church, and it must be restored to him, to be held and disposed of by him accord ing to the directions of the next, or any subse quent regular church meeting, and no alteration, of any part of it must be allowed. It is very plain that this congregation is dlvi ded into two parties, and that their pastor is the subject of their dispute. Of course, then, so far as their affections and purposes are concerned, and es they are indicated by their disorderly proceedings, they have no longer. one Lord, one faith and baptism, nor any other common bond of union. In a very huneble sense of the paral lel, some are for Paul and some for Apollos, but none for Christ. The aim of the contest is the victory of one party over the other, and not the progress of the church in Christian graces, nor its success against the kingdom of evil. Of course, then, we must expect to see very improper means used by both parties in order to succeed. And many indications of this have been referred to in the records, where persons unfavorable to the party haying the majority of the time, have been excluded from church mem bership. When any suspicion is cast upon the motive of such proceedings, they can do nothing but harm to the cause of the party conducting them. I venture this suggestion by way of ad vice, that is very relevant to the case; and, I might perhaps venture further, were it not that the excited state of feeling indicated by these disorders cautions me that it would be useless. When this society comes to its right mind, they will take the advice of their Master, and cut off their right hand, or pluok out the right eye, or sacrifice any common interest rather than to suffer it any longer to, lead them astray. Our duty now is to correct the state of things brought about by the disorderly meeting of July 29th.
