The deceased was employ ed on Section fiityottvett of the Hempfield Rail road ; and, in company with a number of other workreewleft tbeneetion on Friday, for the pur pose of coming to this city. They came down to Port Terry,. and walked to Brinton's, in tending to take thelxprees Train which arrives in this city, at 4 o'clock, A. M. The train was detained by snow on the mountains, behind the usual time, and did not arrive at Brinton's until five o'clock. In order to make the connection with (he Lightning Train on the Ohio and Penn sylvania' Robot the train did not stop at Brin ton's,-but cams direct to this city. The de ceasefl, before the cars passed the station, was standing on the track, with a comrade. The enginitei;AlL A. Shattuck, sae the men, but be auppeitCtheijoloped front the track, and did not stile the train. ' McGiveny did not, how ever, and he 44:is struck on the side by the bunipsr,_'Sto which the cow catcher is attach ed,) and• dragged-fifteen or sixteen yards, when he was thrown from the track. He was in stoutly-killed. The train was going, at the time,",attfie.rate of 25 miles an hour. Tht'body of the deceased was brought into the city-on Saturday morning, on the Accom modation 'Trititt,:and Coroner Lowry held an inquest 'on it, at Ilio.ltailroad Depot. A num ber of witnesses were examined—among them, the fieetttaii, engineer and conductor of the train. " Mr:Parks, - a superintendent on the see tien of; the Hempfield Road, on which IlleGiveny was employed, stated that the deceased had been at work on that section but four days prior to his death. The jury, in their verdict, ,exonerated the officers on the train from blame. Thti deceased was a middle-aged man, and was a native of county Cavin, in Ireland. He had in his possession, a five dollar note, and a certificate showing that be was a member of the Shamrock , Peace Society, Plane No. 3, Portage road. AsolisEa RAILF2OAp Acct DEXT.—On Thursday .evening last, Patrick Brackin, a brakesman, on vibe Ohio and Pennsylvania railroad, was so bad- Ay injured, on the Rest Common, in Allegheny -city, that he died on Saturday morning at six . o'clock.. Thu deceased was on a stone oar at rtachetftO alotiometive; when the car had arriv •ed at spotlit on the West Common, he stooped down to uncouple the car, his foot slipped and die fell on the middle of the track, and under the ear. He was so badly injured by projections from the bottom of the car, that he was taken home near the scene of the accident, where he lingered until Saturday morning, when he died. The'dse.eased leaves a wife, and two children. Re was about twenty five years of ago. Coro ner Lowry trekd an inquest on the body on Sa- Inrday afternoon. .53a.r.mrros FOUND !—On Saturday, the men engaged in clearing the rubbish from the ware house en Liberty street, occupied, prior to the fire, which laid it in ruins, by Atkins & Keemle, found ,ou the ground floor, and under a large mass of rubbish, the skeleton of a boy, apparent ly about fourteen or fifteen years of age. The scull, .and many of the principle bones, were fractured. No clue can be discovered as to the identity of the boy. The bones were entirely free from flesh ; and a felt Eat, a part of a shirt, and a pair of pants was all the clothing found. In the pockets of the boy, were found a bank note, out from Kennedy's Detector, and a prin ters' brass composition rule. The skeleton was found about mid way between the street and the canal, and under a mass of bricks, five or six feet high. Coroner Lowry took charge of the skeleton, and isliew engaged in investigating the cause, and circumstances attending the death of the un fort:mate being. A Coroner's Jury was organ ized on flaturday, but it adjourned over until this morning at tan o'clock. —Since the above was written, the Coroner has discovered that the skeleton found is that of -a lad named Martin Brown, whose parents reside in Kings' alley, (which runs from Fifth street to Virgin alley.) The day after the fire occurred, be left home, telling his mother that he was go ing to see the ruins of the fire. lie never came back: and his parents, it appears, were not alarmed, supposing be had gone down the river. The lad,-no doubt, while within the ware room, was killed by a portion of the walls falling in. Tar Jaw Eta. CASE. — This ooze was finally de eded on Saturday, by Chief Justice Black, who delivered the opinion of the Court, sustaining the notion of the Court below. Long before the time had arrived for the open ing of the Court, a large crowd of persons had congregated in the rotunda. When the Court area opened, there was a general rush,lind in a %short time the Court room was densely crowded. When the,Chief Justice commenced reading the decision, the noise was so great that the Sheriff was directed to eject a portion of tho crowd, and close the doors. This was promptly done, and the reading of the opinion proceeded with. When it was concluded, the prisoner was taken back to jail by the Sheriff and Jailor. Jewell did not appear to be affected by the deci eion of the Court, but maintained throughout the same firm demeanor which characterised him in the various trying scenes through which he has passed since he was first arraigned for inzrder.
