This was an action on the case, brought by the plaintiffs against the Mayor, Alderman and eitirens of Pittaburg,h, recover-damages sus tained by, the sinking of the steamboat Mary And at the wlearfin.thiseity, in consequence, as it was alleged, .4 the default of the defendants, in allowing a lot of pig metal to lie - au unrea sonable time upon the landing. The testimony showed that the plaintiffs were the owners of the steamboat, and that a ehott time before the loss they had been offered $9,000 or $lO,OOO for her; that the said boat arrived at this port, and anchored at the Monongahela Wharf, January 9th :or 'lOO3, A. D. 1850, the water being about four feet' deep; that there were sundry piles of pig - metal then lying on the wharf, some 85 or 40 feet' above'the water's edge, and abo'vilhe log which was placed at low water line, and which was then visible; that the river catimented rising about the 15th day of January, and continued till it wan seine twenty feet high; the boat coming up with the rise of the water, and keeping as near as pessible with the water line. On the night of the 16th or 17th of January, the - river commenced falling very rapidly, - and the Mary Ann, retreating with the water, was obliged to back further out in the stream thadthe boats above and below, in order to avoid one of the piles of pig metal, lying at or neat her bow, and that; 'While in this position, Shp was struck about ,the water line, by some floating object, supposed to be a coal boat or raft, torn from its moorings at some point above, by the violence ct the current, and a hole was knocked in her side, by which she sunk. She was raised again at an expense of $420, and afterwards sold for the sum of $B,OOO. The right to erect private wharves is ta ken away—the grant is repeated—and the pub lic nee is declared. And the defendants, by their Ordinances have so declared it, and have invit ed to it nil those engaged in the trade and com merce of oar vast and beautifel navigahlo streams from the Falls of Bt. Anthony and the months of the Mississippi, as well as from the Upper wa ters of the Missouri. It is, and must be, free and open to all the citizens of the country, enga ged in the lawful and benign pursuits of corn• mores; for trade must not be restricted or res trained, unreasonably or unnecessarily. The invitation of tho Mayor. Aldermen and Citizens of Pittsburgh, has gone forth to the country. and tiers they have erected a safe, con venient and commodious wharf, and whereupon goods and merchandise, from all quarters of the world may lie loaded and unloaded. It is for the interest of the defendants them ' selves; it tends to the increase of population, to the wealth and advancement of the entire corpo ration, to the benefit of the whole people within the limits of the city, that it !bell be kept in proper repair. and that no improper or un reasonable obstructions—much morn that no nuisances—shall be permitted to exist upon this public highway. And. moreover, under the laws of tha United States this has been declared II public port. and the agents or officers of the general government are here in our midst. The owners of a public port or wharf, arc of common right bound to keep it in repair; for the neglect of which they are liable to an indictment. They are under nn implied right to repair, and to attend, and this is a consideration for the toll which they demand and receive. A corporation laboring under such obligation in respect: to their wharves and docks, will also be liable for special damage arising to Individuals, for its violation. it is well settled that when a corporation or an individual is bound to repair a public highway, or navigable stream, they are liable to indictment for the neglect of their duty. The farmer constitutes apart of the mass of corporate powers which they base sought, for the promotion of the poldio good, the execution of which is scarcely at their option. They are bound to execute them when demand. ed by the public interest. The means put with in their reach are ample, If not exclusively ten der their control. To relieve them from original expenses, and to make a profit, if you please, they derive and are em powered to receive a toll or duty. The owners of all vessels navigating the Mo. tongahola, Ohio, and our other connecting streams—all our citizens, in a word, have a right to land at this wharf for the purpose of trade and commerce, as common carriers, or otherwise, tinder the legal roles and regulations establish ed, upon paying the toll or wharfage. The consideration of these principles of law, leads me to answer the first, second, fourth and ninth points presented to the Court by the coun sel for the plaintiffs, in the affirmative. Baying accepted the charter of incorporation and assumed the control and management of this wharf, they be, on payment of toll at all events, legally bound to repair. It coneeres the public, and an action will lie for special damages. In a case where injury was sustained becauee of sand banks or accumulations of mud, which were occasioned by the improper creation of a dam, although tho dam was authorized by act of Assembly, yet this deemed - not too remote. 4 Watts, 487. Tho common law holds that the wharf ought to be used only for the legitimate purposes in • tended by its construction and dedication to pub • lie use. A wharf, as stated to you already, is a place for the reception of merchandise from a ship or vessel, and for the convenient and safe loading and uhloadlng of such votmel. Merchan dise unloaded may remain upon a wharf a rev. seeable time, in accordance with the ciroum. stances of the locality, and the nature of the trade. But to allow it to remain beyond such reasonable time, to the Inconvenience and injury of others, would be to defeat the objects Intend. ed by the vary struotnre of a public landing,and would injure the public. So with regard to merchandise placed upon a wharf to be put into a vessel. Id the operations of commerce there aro proper planes for the storage of goods, and there are pertionsppeoial• ly engaged in that branch of trade. A public wharf cannot, of common right, be used for a place of storage for merchandise, for purposes of profit and revenue to the °vinare, or otherwise to the detriment of the public, or to the injury of individuals, beyond such reasona ble time as I have indicated. Nor ought pecu liar privileges to be given to one class of dealers or ode kind of merchandise beyond those con ceded to others. One cannot recover for an injury from negli gence, unless he Is free from negligence on his part. It is an ancient maxim, that no man in hie prosecution or defence against another shall lake advantage of his own wrong or negligence. A kindred principle is, that one is bound to use anything that is his, so as not to hurt another by ouch use. - If you believe the defendants were acting un lawfully and negligently—that the piles of metal were within the .60 feet—were larger-than the ordinance required—remained there longer than was proper or reasonable—still all these facts would afford no excuscttosjastify:Capt - Duncan -and his.arew to, fold „their arms, lie down su pinely and-make no effort to-save-the boat from destruction.: They were •Ifound to exercise or dinary eare,in-suCh-eniergeneyi . .,forlint prrpos 0 - sffsafety: Did - the - plfdlitiffeor those in.:charge. Did they (the plaintiffs, or those in charge,) exert themselves to prevent the occurrence of the ao cident?' ;Did they take all reasonable and pre eaationary means to avoid collision with the me tal? These areAuestions, I ask you again, to heir in mind, which you must decide from fall survey and careful examination of all the evidence on both Bides. Can you say, that by remaining at the wharf, they consented to take the risk of a probable rise in the river? The particular manner in which a loss happens, must always be n question for a jury. These plittititle were common carriers; and bound, In navigating ourrlvers and entering our ports, to act in conformity with:public regulations. They are bound to take notice of such rules, and may not sot in contravention of them. - - In conclusion, it is for the jury to determine all the facts presented in the case. And in in vestigating them, it is your duty carefully and calmly to endeavor to arrive at such conclusion as truth and justice may point. It is for you to say, furlong other things. -whe ther or not the plaintiffs exercised ordinary care and reasonable diligence on their part. Were there fault and neglect on their side, snob as no man of ordinary prudence and skill would have fallen into It Is for you, also, to say whether or not the plaintiffs, in endeavoring to de what in them lay to get rid of the metal, necessarily and inevitably got into such position as occa sioned, under the circumstances, this loss and damage. If such is the case, and you so con clude from all the testimony,—if the plaintiffs were honestly attempting to get clear of an oh ' straction ,were they not endeavoring to do that which was for the mutual benefit of both par ties ° You will inquire where was the Wharf Master all the time of the danger, and what was his course of conduct? These and all other con siderations properly entering into the facts of the case, are for you. (The points presented by counsel, next explicitly answered. Vide the eamo.) The Indian Insurrection in Rogue River Valley— Consternation oniony the inhabitants-- War of Eztervinsation Begun. The Portland (Oregon) Commercial of the2sth gives the following particulars of the Indian troubles Late on Saturday evening last, Mr. Ettlinger arrived here direct from Jacksonville, bringing a despatch announcing that a general outbreak had'taten place among the Indian tribes in the vicinity of Rogue river. It appears that for some time past the various tribes In the vicinity of the above named river have made great com plaints, and became generally dissatisfied at the number of Bortons who were congregating on their former hunting grounds, and this dissatis faction has sprung into the burning desire to ex terminate the whites from the region of Rogue river valley, and regain their former footing, and reserve that entire valley for their own use. In order more effectuallyto carry out these designs, several tribes have joined, among which are the Klamath, Rogue river, Smith river, Shasta, and It is supposed that a large portion of the Snakes had also agreed to co-operate with them. A portion of each of these tribes, to the num ber of about 300, have established their head quarters and strongholds at a point called Table Sock, said to be one of the moat impregnable fortresses in the territory, and about eight miles distant from Jacksonville. If, therefore, any engagement should take place, we may pre sume that this fortress will be the scene of action. At the time Mr. E. Left Jacksonville nearly twenty persons had been butchered by the Indi ans. Among them are Dr. hose, J. It. Hardin, Thos. Wills. R. Nolan. and Messrs. Orerback, Dunn, Griffin, Smith and Edwards, and the In dians had burned upwards of &dots! dwellings. The following despatch from the once of the donutsin thrall Downtevitte, received among our Sacramento exchanges by Adams et Co., glees other p.irticulars: On the evening of the 11th lost., Dr. William It. Rose and John It. Hardin, while on their way to Dr. Ambrose's, from Capt. A.lden's encamp ment on Stewart's Creek, were waylaid by the Indians, and the former instantly killed, and the latter dangerously if not mortally wounded- Dr. Rose was horribly mutilated, being found the next morning with his eyes dug oat and nose cut off. The Indians captured his rifle, revolver end clothing, together with SGOO in cash. Oa the same day Geo. Anderson was badly wound ed on Upper Applegate in a 'skirmish with about thirty Indians. The company was under com mand of Lint. D. V. Urlilin. On the 12th, Lieut. Griffin made an attack upon the Indians on Lower Applegate, but teas compelled to re• treat. with the loss of one man, (Frank Garrett,) and himself shot in the leg. In the afternoon reiuforcement was sent from Capt. Alderee com mand, and, at two o'clock this morning, upon receipt of the news of .Lieut. Griffin's defeat, another detachment was sent, and at this pees ent momenta portion of the Humbug volunteers are mounted, awaiting orders to march to the scene of battle. The Indians have burned down the houses of Mr. Patrick, Capt. Jones, and also that of Mr. Anderson, together with his hay and oats.-- Night before last they burned Mr. Griffin's house and some haystacks; they also shot some of Mr. Griffin's fine American horses. It appears that Mr. Earley fired a shot gun, loaded with shot, at Mr. Given, and inflicted a mortal wound; but before Mr. Given expired, he fired a revolver several times at Ur.
