Com. vs. Jas. McDonald, for surety of the peace, on-information of hie wife. Prosecutria testified - that defemiant bad threi4ened to:cut her thi.catt. when she sleepitietind to burn his property; she was afraid, and " tied the•latch-of the door ~to her left foot" when she' went to bed. = It wakin evidence that Mrs. Mc- Donald was in the'habit of imbibing - 1o? freely ; thatshe was'frequently inebriated. • The defendant Was sentenced to pay the dock-1 et costs only; witness to get their fees as they could. • Com. vs. John Pool, Surety of-Ahe•Peace : on informaticin of James Elammersly. The parties reside in Birmingham. Each had to pay their own costs, and defendant : to pay the docket costs. Com. vs. John Paisley and James Hendricks,- Surety of the Peace : on information of Capt.- John Hutcbingon,.of the Ninth Ward. The com plainant was sentenced to pay the docket costs, and his case was dismissed. Heis an infirm old man, and the Court remarked that he Was hirdlY a responsible anent—that they sympathized with his infirmities, but advised him to be more care ful in future. Several other Surety of the Peace cases were disposed of, when the case of the Com. vs. Sarah Boley, and the Com. vs. Caro line Adams, cross bills for assault and battery, were taken up. Caroline Adams testified that she sent her little girl after sweet milk ; she re turned with dirty soar milk. She sent her back with _it and told her to tell the woman, Sarah I3oley, that shn wanted sweet m ilk, but the little girl came back with the. same milk, tuittaald she, Sarah Boleye, wouldn't give her any other. Wit ness then took the milk 'twit herself end spilt it ant, when ,Sarah Boleye cursed her, knocked her down and kicked her, and otherwise abused her. Mr. Bruce testified that he saw Mrs. Boleye catch Mrs. Adams by the hair and strike her. A witness testified that shg saw Mrs: Boleye run after Mrs. Adams and tax herby the hair, and throw her down. Mrs. Boleye testified that it was owing to the vessel that the milk was dirty, and that Mrs. i Adams threw it in her face, and then witness took her by the neck, pushed her down, and probably fell on her with her knees, and then struck her on the head twice; didn't do anything to provoke her to throw the milk.
