I merely . stated a fact without ever naming Judge Mc- Clure or his office; therefore the charge that I made. u "savage attack" upon the Judge le a gratuitous affirmation of your reporter. That there has been some undue influence brought to bear in this case is apparent, as on the same day another Individual who bad been convicted of a theft of less amount was sentenced to two years in the Penitentiary. _Respectfully yours &c. The writer of the above communication shows .his ignorance of the facts of the case, 118 palpa bly as he had before shown his ignorance of the motives which governed his Honor, Judge Mc- Clure, in sentencing the prisoner. . The District Attorney,, Mr. Flanegin, was absent from the city at the time the plea was changed. • The• Associate Judges may, or may not, have been present. Both are rarelY on the Bench when sentences are passed, which usually oc curs on Saturday ; but whether they were, or not, if present, they concurred in the action of the PresidentJudge,—:hia,honOr, Judge McClure.— Without displaying some of the egotism which characterises the action of the very talented members of the Native American Convention, they could not do otherwise, being "unlearned in the law;" and it is to be presumed, except in casess - where he is manifestly wrong, acting in conformity with the views of the President Judge, who is. The concluding paragraph of the above communication is enough to prove the truth of what we asserted, for it contains a "savage al,- tack" not.only on Judge MOClure, but the Asso ciate Jmiges. That any unusual or "undue" in fluence was brought to bear on the minds of the Judges, is at once to charge them all with cor ruption, and is simply as fable as it is most laughable and ridiculous, provided it' be not viewed with the squinting eyes of the self styled " Native -American"- party.
